What is the FSB of Russia? Is there mass surveillance in our country, are there any safe ways to communicate on the Internet, or can intelligence agencies read any of your correspondence? About this and not only - an interview with Andrei Soldatov, journalist, editor-in-chief of the site Agentura.ru

“This is not a telephone conversation” - how often do you pronounce this phrase? And how often do you hear her? Why do Russian citizens perceive the idea that they are being listened to for granted? Why are many ready to read their mail? Are intelligence agencies totally monitoring the citizens of their country or is it fears from the past?

Journalist Andrei Soldatov, along with colleague Irina Borogan, has been studying the recent history of the FSB for many years. Together they released several books. One of them, “The New Nobility: Essays on the History of the FSB,” is considered to be almost the only and comprehensive study of the activities of the FSB in Russia.

What is the FSB today, what methods do they use in work, what remains of the KGB in this structure, and what has changed - Melanie Bachina talked about this with Andrey Soldatov.

- Andrei, tell me, these phobias that listen to us all, follow us, read our messages - how many reasons are there, and how much paranoia?

- These phobias grew from the Soviet past, when everyone believed that they could be listened to, that the KGB was behind every corner. Then the phrase "this is not a telephone conversation." It is clear that this was technically impossible then and, in general, impossible now. If you remember, a year ago, Edward Snowden asked a question to Vladimir Putin at a press conference:
“Is there mass surveillance in Russia?” and Putin then said that by law this is impossible and that we have no technical capabilities. Of course, it was half true.
There are really no technical capabilities, but from the point of view of the legislation, in fact, everything is allowed, and the Russian special services could conduct mass surveillance, but they lack the capabilities. Roughly speaking, they do not have such capabilities as the NSA (US National Security Agency) to collect data and store them in some place. In addition, the Russian special services have technical problems in creating their own database processing systems. Basically, until now, Russian special services and other government agencies are dependent on American technology. The best databases are created in the United States. Russian systems exist, but they are small, maximum per department. So they, perhaps, would like to organize mass surveillance, but technically this is not very successful so far.

The system that exists in Russia is not massive. Rather, she is able to keep track of those people who are already identified as activists or as people who might be a problem for the authorities.
This is not to say that Russian systems come from the content of, say, correspondence. There are technologies in the world where you can calculate by keywords what people say and then find out who actually said it and start monitoring him. The Russian special services, basically, are the opposite. They first calculate, determine for themselves - who is the problem, for example, Navalny and his friends, and then they are followed. Another thing is that periodically, knowingly, the materials of such wiretapping and surveillance are merged on the Internet and used against activists. You know, these films are like Anatomy of Protest. This sends a very strong signal to everyone and people psychologically understand that it is better to be careful, because if they get on these lists (people to watch out for, approx. TV-2), then their negotiations may not only be with the special services , but also anywhere and anywhere can be represented.



- But you now have an idea about the capabilities of the special services, about what resources are spent on it, money, with which it is comparable ...

- This is a difficult question, because the budgets of special services are closed. The money allocation system is so complicated that few people know how much money is spent on the maintenance of special services, because there are a large number of articles on which they receive funding. For example, there are articles on which they directly receive money, and there are programs for which money is allocated and then it turns out that they go to finance special services. All this is absolutely closed. In Russia, there is no parliamentary control. It has been officially recognized. Former head of the State Duma’s security committee, Vladimir Vasiliev, said in an interview with Irina Borogan that we do not have parliamentary control, because random people can get into parliament, how can they be trusted with secrets. This answer looks somewhat schizophrenic. That is, on the one hand, we must trust these legislators, and on the other hand, they do not trust themselves, because you never know who gets there.

In general, now you can’t say what kind of money is spent on this. Although in the fall it was possible to at least roughly understand what funds are spent on surveillance equipment - on the public procurement website. For example, using this site
we found out that now not only the FSB is building its wiretapping system, but also organizations such as the Federal Penitentiary Service.
Earlier, by decree of Boris Yeltsin, we had eight special services that had the right to engage in operational-search activities. But technically the FSB was responsible for the system, its creation and for using it.

It was like this. For example, in the city of Tver, the local FSB comes to the providers, indicates what equipment to install, and lays cables from them to itself. If other departments that have the right to conduct operational investigative activities will need to put someone on wiretap, they came to the FSB and they put someone on wiretap and then gave the department materials. This system began to change in the mid-2000s, when other structures began to build their parallel systems and also began to come to providers and we know this thanks to the public procurement website. All this, of course, increases corruption risks. Unfortunately, then a law was passed, according to which now such contracts can not be published on the public procurement website openly, so that citizens know about it.

- Are there safe ways to communicate on the Internet now? Is it possible today?

- No one gives a 100% guarantee now. But you can try to reduce the risks. Firstly, we need to monitor how the law on server migration, which came into force in September 2015, is being implemented. You can see that Viber announced that it has moved its servers to Russia. Accordingly, this messenger is better to exclude from the number of those that you trust. You can see that Microsoft, the owner of Skype, also made statements that they are cooperating with the Russian authorities. This is also probably a sign.
In general, it is better to use those applications that are physically located outside of Russia.
Because there is one big technical problem for the Russian special services, which they do not yet know how to solve. Briefly, without going into technical details, the Internet now works on two HTTP and HTTPS protocols, the letter S means Secure. If the site works on HTTPS, this means that the traffic between you and the site you are visiting is encrypted. Intelligence agencies have repeatedly acknowledged at narrow meetings that they cannot intercept this HTTPS traffic. What does this mean in a practical sense? This means that they do not know what to do with Facebook, what to do with Google services, because all such companies live on the HTTPS protocol.

The only way to bypass this encryption is to get into the server until the moment the message encryption begins. But for this, in fact, the Russian authorities are asking to transfer the server to our country so that there is an opportunity to plug in and intercept traffic. Therefore, it is critical for them where the server is located.
- Well, here is Pavel Durov (a programmer, one of the creators of the VKontakte network, approx. TV-2) positions his Telegram as safe. Are there any more like him?

- Yes, there is Signal, even Snowden recommended it. You can even use the usual Facebook messenger for now. The situation with Apple is not very clear, more precisely with the messenger that is on your IPhone, because there were reports that Apple seemed to agree to transfer the server. But this is not a very clear story, because it was stated by Russian officials, but Apple did not confirm this. Here we hang in this gray zone and do not know whether it is true or not. You just need to follow the news.



- In 1991 there was the possibility of changing the system. Do you think that something fundamentally important wasn’t done then and would you be able to change something, reconstruct now, what should be done first of all?

- Many things. From the media to the point that no lustration was done. In principle, Yeltsin wanted to reform the special services, but he chose the most primitive option. He simply took and divided the KGB into parts. He had no clear idea how to reform this. That parliamentary control, public control is needed, the entire workflow needs to be changed, that a modern, agency built on other principles needs to be created - it never occurred to me. There was only one thought: look, we have one monster - the KGB, and in America there are more than a dozen special services and therefore they have better. Let us also take and divide it into parts of the KGB and they will work more efficiently. This approach did not solve anything. And it became clear very quickly. When we wrote the book "The New Nobility" we ourselves were surprised.
In our country, many have the idea that Putin recreated the KGB. But no. Nothing like this. Do you know that the main things changed in the opposite direction back in 1995?
This period, when it was possible to do something with the special services, it lasted only four years - from 1991 to 1995. Then, when the FSK was renamed the FSB, and the word security implies a broader concept than counterintelligence, it started. They were returned to prisons, the right to conduct investigations, and created a political investigation unit. This all happened before Putin. He actually came to a system that already looked very much like the Soviet one. Time is very important here. They lost time, and instantly the system begins to recover itself. That is, of course, you need an idea of what needs to be done.

- You said that the current FSB inherited a lot from the KGB. But times have now changed and, probably, there are still differences. What has still changed, how is the FSB different from the KGB?

- What is often forgotten about the KGB? The fact that even when this special service was perceived as omnipotent, which spied on everyone, the KGB remained the front party detachment. And that was not words. There was a system of party control, and this was written in all the KGB regulatory documents. Party bodies were required to report on all problems within the KGB. Each KGB department had its own party cell. And what happened?
There was a system of external control over what was happening inside the KGB.
Moreover, due to the fact that the Politburo was very afraid of the Stalin purges and did not want to repeat them, the KGB, in contrast to the CIA, was forbidden to prepare analytical materials. The idea was this: let the KGB collect information, and we will write an analysis in the Politburo ourselves and report to the first person. That is, they tried as much as possible to keep the KGB under control. The same thing happened with the GRU. The Central Committee had a special department that controlled all appointments within the KGB, from the level of almost a major. If a person was sent somewhere by a GRU resident, he was invited to this department. Information was collected just through the party organs. There was a system that tried to somehow control the intelligence services. What happens in the 91st year? They did not create parliamentary control, as I said, but destroyed the party control. I am not saying that the party control was destroyed in vain; the problem is that a void has formed.
Intelligence agencies were on their own. On the one hand, they did not create sane modern control, democratic control, on the other, they destroyed the old.


They were left with the idea of competition. Yeltsin somehow lived with this for some time, but Putin destroyed this system, making the FSB the most important intelligence service. And what did it come to? There is one big special service, which is more important than others, there are no competing systems for collecting information about what is happening in the country, and they themselves control themselves in the FSB. Moreover, a funny system was created when a sensible thought appeared to someone, but what would happen if an FSB officer committed a crime? What to do? They created inside their own security management. That is, the FSB controls itself, they have their own security management inside. When such departments were created in other organizations, for example, in the Ministry of Internal Affairs, there they were partially at least controlled by the FSB. There was an idea of external control. What about the FSB? There is no other special service.
It is no accident that the FSB’s own security officers were often suspected of corruption. Why? Because nobody is above them at all. They are like gods. So the main difference between the FSB and the KGB, no matter how ridiculous it sounds, is the complete lack of external control. The FSB is a thing in itself.
This sometimes leads to paradoxical results. For example, to the fact that
they are not very controlled not only by society, but also by the Kremlin.
Think for yourself, Putin is sitting in the Kremlin and he needs to find out what is happening inside the FSB. But as? If you have a small intelligence service, such as the British counterintelligence MI-5, where less than four thousand people work, you can still understand how they work. And if you have a huge country and each region has its own government? How to understand what is happening in Vladivostok? Where is the mechanism? There were such initiatives, in the mid-2000s, Putin gathered regularly generals. So what? So you gathered five generals, but how do you understand what is happening in more than 80 regions of Russia. This system was given more and more privileges and it became increasingly clogged. And she does not respond well to external stimuli ...

- What consequences can this have?

- The main problem is that such a special service will, in the end, be ineffective.
Still, when we talk about the special service, it should not only deal with repression, I will say cynically, in fact, the task of the special service is to collect information. And here they have no motivation for this.
This is a situation where special services collect information poorly and poorly predict what is happening, it lasts quite a while. She will exist this situation until a global crisis occurs. And then it may happen what happened in Ukraine. When the security services of Ukraine assured everyone that everything was under control, and then all of a sudden, an unexpected thing happened. FSB officers were also there, and the SBU generals told them that everything was fine. And suddenly, once and all were faced with such a surprise. In part, it seems to me that Putin’s nervous reaction to the Maidan was connected with this. Because he saw, there are special services, they work and say about the same words that his generals say to him, and then once this happens. Because no one can predict anything. This is the fear of 1991. Fear of surprise. I think this situation may continue for some time until there is a large-scale crisis.

- That is, the total control of the security services over everyone is an illusion ...

“Yes, an illusion, of course.” Because in order to exercise total control, we need people who have motivation inside the special services to collect this information well, process it, bring it to their bosses, and they should have a motive to report further. And there at many levels there are problems with the circulation of this information. There, too, there are internal conflicts. They are pragmatic. For example, the average level of officers is very dissatisfied with their generals - there is a problem of intergenerational conflict. Until now, the FSB is headed by people in many key positions, whom Vladimir Putin appointed during his first term, which is 15 years ago. It is clear that the people who are below, they have no opportunity to get new posts. They are angry. This leads to a lack of trust within the structure. So, as an information service has big problems.

- The Snowden case showed that everywhere, not only in countries with authoritarian regimes, they monitor their citizens - they listen to them, read ... What is the difference between the special services and their control methods in the West and here?

- The current Russian system was originally built as totalitarian. It was invented during the KGB, so that the KGB would use it. No one thought about any kind of control there. Everything was done as much as possible so that the system was effective. It was reduced to the level that a cable was laid between the operator, then still a telephone, and the special service. Then they tried to modify it, but honestly, it was a formal approach. A court order requirement was added, but it should not be shown to anyone. The operator does not see him and the interception is carried out by special services, and not by the operator. In the USA, in Europe, there are standards. This is called "law enforcement interception."
In Europe it is the ETSI standard, and in the USA it is CALEA. These two standards are slightly different, but in fact they have one thing in common: both there and there the interception is carried out by the operator, and not by the special services, which guarantees some kind of control.
You are right, Snowden’s revelations showed that the NSA really wanted to change this system. And there are two points. The first one. They wanted to change the system, but it was not originally built that way. Therefore, the program, for example, PRISM was secret. When she opened, Obama had to explain. In our country, everyone believes that this is normal. Second, do not forget that
The NSA is the intelligence structure and the task of the NSA to collect information not about US citizens.
Yes, of course, as a result, they got access to the data of American citizens, because a very large part of the international traffic passes through the United States. So the Internet is made. It is clear that this provided a certain advantage to the American intelligence services, and they wanted to intercept all this. But initially the idea was not to control American citizens, but to intercept foreign traffic. This was an initiative of intelligence services. And here we are talking about the fact that
our wiretapping system was made by the internal counterintelligence service and is not aimed at keeping an eye on the French and British, but on our own citizens.
Moreover, we know from books that intelligence - it violates the laws of other countries, but intelligence agencies operating within the country must comply with the law with respect to their own citizens. But our laws are structured in such a way that this implies the absence of any control. Therefore, in America there is a difference. If the FBI deals, then there is a guarantee of compliance with the law. If the NSA does this, then another story.
And the last moment, what is the difference. These are the victims. We heard a lot about Snowden's revelations recently, about all these programs, but tell me how many people have suffered from this?
Nevertheless, we see that we are talking about potential opportunities that can be used to monitor people and these materials can be used so that something bad happens to these people later. But by and large, we can’t provide a list of victims of the NSA’s illegal wiretapping, in the sense that these people were in prison or were killed or somehow injured. In a totalitarian state, the story is different. Technically, they can work much worse, but
we all know the list of victims. And wiretaps of Russian opposition, the same Boris Nemtsov, who laid out on the Internet during the protests. And people were imprisoned on the basis of wiretapping legal and illegal, when some pro-Kremlin TV channel takes some kind of filming, makes a film out of it and puts a person in jail. Here we know the list of victims.
- And if we talk about technical capabilities. You mentioned that our special services use Western technologies as well. And how ready is our country for import substitution in this?

- In fact, it turned out that the Russian services are to some extent victims of this inertia and adherence to traditions. They love what they do. They have their own procedures and standards, so in fact it cannot be said that they are ready to use the latest advances in surveillance. Comes to funny. We have a company in Russia, a direct heir to the sharashka in which Solzhenitsyn worked. This company is a world leader in technologies for identifying speakers - people who talk on the phone. And they managed to sell their system to Mexico, where it operates nationwide. She stands all over Mexico. When I asked the employees: “Does it stand with us?” They said no. How so? They put it there, but somehow it doesn’t work out here.

In general, it turned out, I’ll say carefully, according to information six months ago, that of all countries in the former Soviet Union, excluding the Baltic States, Uzbekistan turned out to be the most interesting state in terms of using modern surveillance technologies. An amazing country. On the one hand, they use the Russian experience, on the other hand, they buy technology for analyzing social networks in Israel, the leader in the production of these technologies. And on the third hand, they send their employees to train in America. But Russia, thank God, did not go so far behind Uzbekistan.

- Is the Chinese version of the Internet in Russia possible?

- Not. For one simple reason. The Chinese Internet was originally built with the idea of censorship and blocking. For example, on the Chinese Internet it has always been like this: a new product appears, for example, Twitter, it is instantly banned in China in order to create an analogue of the Chinese, which will have a server in China.
Nevertheless, in Russia the Internet was created and developed freely for 20 years, that is, the state did not technologically climb, and no one dealt with content until 2012. It is clear that you can make some kind of slap for censorship, but it is unlikely to be effective.

Что такое ФСБ России? Существует ли в нашей стране массовая слежка, есть ли безопасные способы общения в интернете или любую вашу переписку могут прочитать сотрудники спецслужб? Об этом и не только – интервью с Андреем Солдатовым, журналистом, главным редактором сайта Agentura.ru

«Это не телефонный разговор» - как часто вы произносите эту фразу? А как часто слышите ее? Почему российские граждане воспринимают мысль о том, что их прослушивают, как само собой разумеющееся? Почему многие готовы к тому, что их почту читают? Действительно ли спецслужбы тотально следят за гражданами своей страны или это страхи из прошлого?

Изучением новейшей истории ФСБ журналист Андрей Солдатов вместе с коллегой Ириной Бороган занимается уже много лет. Вместе они выпустили несколько книг. Одна из них «Новое дворянство: Очерки истории ФСБ» считается пока чуть ли не единственным и всесторонним исследованием деятельности ФСБ в России.

Что такое ФСБ сегодня, какие методы в работе они используют, что осталось в этой структуре от КГБ, а что изменилось – об этом с Андреем Солдатовым поговорила Мелани Бачина.

– Андрей, скажите, вот эти фобии, что нас всех слушают, за нами следят, наши сообщения читают – сколько в них оснований, а сколько паранойи?

– Эти фобии выросли из советского прошлого, когда все считали, что их могут прослушивать, что КГБ стоит за каждым углом. Было тогда в ходу выражение «это не телефонный разговор». Понятно, что технически это было невозможно тогда и, в общем, невозможно сейчас. Если помните, год назад Эдвард Сноуден задал вопрос Владимиру Путину на пресс-конференции:
«Существует ли массовая слежка в России?» и Путин тогда сказал, что по закону это невозможно и что технических возможностей у нас нет. Конечно, это была полуправда.
Технических возможностей, действительно, нет, а с точки зрения законодательства, на самом деле, у нас все разрешено, и российские спецслужбы могли бы вести массовую слежку, но у них не хватает возможностей. Грубо говоря, у них нет таких возможностей, как у АНБ (Агентство Национальной Безопасности США) собирать данные и складировать их в каком-то месте. Кроме того, у российских спецслужб есть технические проблемы по созданию своих систем обработки баз данных. В основном, до сих пор российские спецслужбы и другие государственные структуры зависят от американских технологий. Самые лучшие базы данных создаются в Соединенных Штатах. Российские системы существуют, но они небольшие, максимум на отдел. Так что они, может, и хотели бы организовать массовую слежку, но технически пока это не очень получается.

Система, которая есть в России - не массовая. Она, скорее, способна следить за теми людьми, которые уже идентифицированы, как активисты или как люди, которые могут составлять проблемы для властей.
Нельзя сказать, что российские системы идут от содержания, скажем, переписки. Есть технологии в мире, когда можно вычислить по ключевым словам, что люди говорят и потом узнать, кто собственно это говорил и начать за ним следить. Российские спецслужбы, в основном, действуют наоборот. Они сначала вычисляют, определяют для себя – кто является проблемой, например, Навальный и его друзья, и потом уже за ними следят. Другое дело, что периодически, сознательно, материалы такой прослушки и слежки сливаются в интернет и используются против активистов. Вы знаете, эти фильмы, типа «Анатомия протеста». Это посылает очень сильный сигнал для всех и люди психологически понимают, что лучше вести себя осторожно, потому что если они попадут в эти списки (людей, за которыми нужно следить, прим. ТВ-2), то их переговоры могут оказаться не только у спецслужб, но и как угодно и где угодно могут быть представлены.



– Но у вас есть сейчас представление о возможностях спецслужб, о том, какие на это тратятся ресурсы, деньги, с чем это сопоставимо…

– Это сложный вопрос, потому что бюджеты спецслужб закрыты. Там настолько сложная система выделения денег, что до конца мало кто знает, сколько же средств идет на содержание спецслужб, потому что существует большое количество статей, по которым они получают финансирование. Например, есть статьи, по которым они прямо получают деньги, а есть программы, по которым выделяются деньги и потом оказывается, что они идут на финансирование спецслужб. Все это абсолютно закрыто. В России же нет парламентского контроля. Это было признано официально. Бывший глава комитета по безопасности Госдумы Владимир Васильев говорил в интервью Ирине Бороган, что у нас нет парламентского контроля, потому что случайные люди могут попасть в парламент, как же им доверить секреты. Этот ответ выглядит несколько шизофренически. То есть, с одной стороны, мы должны доверять этим законодателям, а с другой стороны они сами себе не доверяют, потому что мало ли кто туда попадает.

В общем, сейчас нельзя сказать какие деньги на это тратятся. Хотя еще осенью можно было хотя бы примерно понять, какие средства тратятся на оборудование слежки - по сайту госзакупок. Например, с помощью этого сайта
мы выяснили, что сейчас свою систему прослушки строит не только ФСБ, но и такие организации, как федеральная служба исполнения наказаний.
Раньше, по указу еще Бориса Ельцина, у нас было восемь спецслужб, которые имели право заниматься оперативно-розыскной деятельностью. Но технически за систему, ее создание и за то, чтобы ею пользоваться отвечала ФСБ.

Было так. Например, в городе Тверь местное ФСБ приходит к провайдерам, указывает какое оборудование им ставить, и прокладывает от них кабели к себе. Если другим ведомствам, которые имеют право вести оперативно-розыскную деятельность, нужно будет кого-то поставить на прослушку, они приходили в ФСБ и те ставили кого надо на прослушку и потом отдавали этому ведомству материалы. Эта система стала меняться в середине 2000-х годов, когда другие структуры стали строить свои параллельные системы и тоже стали приходить к провайдерам и мы знаем это, благодаря сайту госзакупки. Все это, понятно, повышает коррупционные риски. К сожалению, потом был принят закон, согласно которому теперь подобные контракты не могут публиковаться на сайте госзакупок открыто, чтобы об этом знали граждане.

– А есть сейчас безопасные способы общения в интернете? Возможно ли это сегодня?

– Стопроцентной гарантии сейчас уже никто не дает. Но можно попробовать снизить риски. Во-первых, надо следить за тем, как выполняется закон о переносе серверов, который начал действовать в сентябре 2015 года. Можно посмотреть, что компания Viber сообщила, что она перенесла свои серверы в Россию. Соответственно, этот мессенджер лучше исключить из числа тех, которым вы доверяете. Можно посмотреть, что компания Microsoft, владелец Skype, тоже делала заявления, что они сотрудничают с российским властями. Тоже, наверное, это знак.
Вообще, лучше пользоваться теми приложениями, которые физически находятся вне России.
Потому что существует одна большая техническая проблема для российских спецслужб, которую они пока не знают, как решить. Коротко скажу, не вдаваясь в технические подробности, интернет сейчас работает на двух протоколах HTTP и HTTPS, буква S означает Secure. Если сайт работает по HTTPS, это значит, что трафик между вами и сайтом, на который вы заходите, зашифрован. Спецслужбы неоднократно на узких совещаниях признавали, что они не умеют перехватывать этот трафик HTTPS. Что это значит в практическом смысле? Это значит, что они не знают, что делать с Фейсбуком, что делать со сервисами Google, потому что все такие компании живут на протоколе HTTPS.

Единственный способ, как можно обойти это шифрование – это влезть на сервер до момента, когда начинается шифрование сообщения. Вот для этого, собственно, российские власти и просят переносить сервера в нашу страну, чтобы была возможность воткнуться и перехватить трафик. Поэтому критически важно для них, где находится сервер.
– Ну, вот Павел Дуров (программист, один из создателей сети "ВКонтакте", прим. ТВ-2) позиционирует свой Telegram, как безопасный. Есть еще подобные ему?

– Да, есть Signal, его даже Сноуден рекомендовал. Можно даже пока пользоваться обычным мессенджером Фейсбука. Не очень понятна ситуация с Apple, точнее с тем мессенжером, который стоит у вас на IPhone, потому что были сообщения, что Apple вроде как согласился перенести сервера. Но это не очень понятная история, потому что это заявляли российские чиновники, но Apple это не подтверждал. Вот мы висим в этой серой зоне и не знаем, правда это или нет. Надо просто следить за новостями.



– В 1991 году была возможность изменения системы. Как Вам кажется, чего принципиально важного тогда не было сделано и будь возможность сейчас что-то изменить, реконструировать, то, что в первую очередь нужно сделать?

– Много чего. От СМИ до того, что не было проведено никакой люстрации. В принципе, Ельцин хотел реформировать спецслужбы, но он выбрал самый примитивный вариант. Он просто взял и разделил КГБ на части. Внятной идеи, как это реформировать, у него не было. То, что нужен парламентский контроль, общественный контроль, нужно изменить весь документооборот, что нужно создать современное, построенное на других принципах ведомство – это в голову не приходило. Мысль была только одна: вот посмотрите, у нас один монстр – КГБ, а в Америке больше дюжины спецслужб и поэтому у них лучше. Давайте мы тоже возьмем и поделим на части КГБ и они будут эффективнее работать. Этот подход ничего не решил. Причем это стало понятно очень быстро. Мы, когда писали книжку «Новое дворянство» сами удивились.
У нас в стране у многих есть представление, что Путин воссоздал КГБ. Но нет. Ничего подобного. Вы знаете, что основные вещи изменились в обратную сторону еще в 1995 году?
Вот этот период, когда можно было что-то сделать со спецслужбами, он длился всего четыре года - с 1991 по 1995. Потом, когда переименовали ФСК в ФСБ, а слово безопасность подразумевает более широкое понятие, чем контрразведка, тут и понеслось. Им вернули тюрьмы, право вести расследования, создали подразделение политического сыска. Это все происходило до Путина. Он пришел фактически на систему, которая уже очень сильно напоминала советскую. Здесь время очень важно. Вот упустили время, и мгновенно система начинает сама восстанавливаться. То есть, конечно, нужно представление, что нужно сделать.

– Вы говорили, что нынешняя ФСБ многое унаследовала от КГБ. Но времена сейчас изменились и, наверное, отличия все же есть. Что все-таки изменилось, чем отличается ФСБ от КГБ?

– Что часто забывается о КГБ? То, что даже тогда, когда эта спецслужба воспринималась, как всемогущая, которая за всеми шпионила, КГБ оставался передовым отрядом партии. И это не было словами. Существовала система партийного контроля, и это было написано во всех регулирующих документах КГБ. Партийные органы были обязаны докладывать обо всех проблемах внутри КГБ. Внутри каждого отдела КГБ была своя партийная ячейка. И что получалось?
Была система внешнего контроля за тем, что происходит внутри КГБ.
Более того, из-за того, что в политбюро очень боялись чисток сталинских и не хотели их повторения, КГБ, в отличие от ЦРУ запрещалось готовить аналитические материалы. Идея была такая: пусть КГБ собирает информацию, а мы в политбюро сами напишем аналитику и будем докладывать первому лицу. То есть они максимально старались держать под контролем КГБ. То же самое было с ГРУ. В ЦК был специальный отдел, который контролировал все назначения внутри КГБ, с уровня чуть ли не майора. Если человека отправляли резидентом ГРУ куда-то, его приглашали как раз в этот отдел. Собирали информацию как раз через партийные органы. Была система, которая пыталась хоть как-то, но контролировать спецслужбы. Что происходит в 91-ом году? Парламентского контроля, как я сказал, не создали, а партийное разрушили. Я не говорю, что зря партийный контроль разрушили, проблема в том, что образовалась пустота.
Спецслужбы оказались сами по себе. С одной стороны, не создали вменяемого современного контроля, демократического контроля, с другой, разрушили старый.


Их оставили с идеей конкуренции. Ельцин с этим как-то жил некоторое время, но Путин эту систему разрушил, сделав ФСБ самой главной спецслужбой. И к чему пришло? Есть одна большая спецслужба, которая важнее других, нет конкурирующих систем сбора информации о том, что происходит в стране, а они у себя в ФСБ сами себя контролируют. Более того, была создана смешная система, когда все-таки появилась у кого-то здравая мысль, а что же будет, если сотрудник ФСБ совершит преступление? Что делать? Они создали у себя внутри управление собственной безопасности. То есть ФСБ само себя контролирует, у них внутри есть управление собственной безопасности. Когда такие управления были созданы в других организациях, например, в МВД, то там они частично хотя бы контролировались ФСБ. Была идея внешнего контроля. А в ФСБ как? Нет же другой спецслужбы.
Не случайно сотрудников собственной безопасности ФСБ часто подозревали в коррупции. Почему? Потому что над ними вообще никого нет. Они, как Боги. Так что главное отличие ФСБ от КГБ, как это ни смешно звучит, полное отсутствие внешнего контроля. ФСБ – это вещь в себе.
Это приводит иногда к парадоксальным результатам. Например, к тому, что
они не очень подконтрольны не только обществу, но и Кремлю.
Подумайте сами, сидит Путин в Кремле и ему нужно узнать, что происходит внутри ФСБ. А как? Если у тебя маленькая спецслужба, типа британской контрразведки МИ-5, где работает меньше четырех тысяч человек, еще можно понять, как они работают. А если у тебя огромная страна и в каждом регионе свое управление? Как понять, что происходит во Владивостоке? Механизм где? Были такие инициативы, в середине 2000-х Путин собирал у себя регулярно генералов. И что? Вот собрал ты пять генералов, но как ты поймешь, что происходит в более чем 80-ти регионах России. Этой системе давали все больше привилегий и она все сильнее закупоривалась. И она плохо реагирует на внешние раздражители…

– Какие у этого могут быть последствия?

– Главная проблема в том, что такая спецслужба будет, в итоге, малоэффективна.
Все-таки когда мы говорим о спецслужбе, она должна не только репрессиями заниматься, скажу я цинично, вообще-то задача спецслужбы информацию собирать. А здесь у них мотивации для этого нет.
Это ситуация, когда спецслужбы плохо собирают информацию и плохо предсказывают, что происходит, она длится довольно долго. Она будет существовать эта ситуация, пока не произойдет глобальный кризис. И дальше может случиться так, как случилось на Украине. Когда сотрудники служб безопасности Украины всех уверяли, что все под контролем, а потом вдруг раз и неожиданность случилась. Там тоже были сотрудники ФСБ, а им генералы СБУ говорили, что все отлично. И вдруг раз и все оказались перед лицом такого сюрприза. Отчасти, мне кажется, нервная реакция Путина на Майдан была связана с этим. Потому что он увидел, вот есть спецслужбы, они работают и говорят примерно те же слова, которые ему его генералы говорят, а потом раз и это происходит. Потому что никто не может ничего предсказать. Это страх 1991 года. Страх неожиданности. Думаю, эта ситуация может еще какое-то время длится, пока не будет масштабного кризиса.

– То есть тотальный контроль спецслужб за всеми – это иллюзия…

– Да, иллюзия, конечно. Потому что чтобы тотальный контроль осуществлять, нужны люди, у которых внутри спецслужбы будет мотивация собирать эту информацию хорошо, перерабатывать, своим начальникам ее доводить, и они должны иметь мотив докладывать дальше. А там на многих уровнях есть проблемы с циркулированием этой информации. Там ведь тоже есть внутренние конфликты. Они носят прагматический характер. Например, средний уровень офицеров очень недовольны своими генералами - есть проблема конфликта между поколениями. До сих пор во главе ФСБ на многих ключевых позициях находятся люди, которых Владимир Путин назначил еще во время своего первого срока, соответственно это 15 лет назад. Понятно, что люди, которые находятся снизу, у них нет возможности получить новые должности. Они злятся. Это приводит к отсутствию доверия внутри структуры. Так что, как информационная служба имеет большие проблемы.

– Дело Сноудена показало, что везде, не только в странах с авторитарными режимами следят за своими гражданами – прослушивают их, читают... В чем тогда разница между спецслужбами и их методами контроля на Западе и у нас?

– Нынешняя российская система изначально была построена, как тоталитарная. Она была придумана во времена КГБ, для того, чтобы КГБ пользовался ею. Ни у кого и мысли не возникало о каком-то там контроле. Было сделано максимально все для того, чтобы система была эффективной. Она была сведена до того уровня, что вот проложен кабель между оператором, тогда еще телефонным, и спецслужбой. Потом ее пытались видоизменить, но честно говоря, это был формальный подход. Добавили требование судебного ордера, но его показывать никому нельзя. Оператор его не видит и перехват производится сотрудниками спецслужбы, а не сотрудниками оператора. В США, в Европе существуют свои стандарты. Это называется «правоохранительный перехват».
В Европе это стандарт ETSI, а в США – это CALEA. Два эти стандарта чуть-чуть разные, но по сути у них есть одна общая вещь: и там, и там перехват производится оператором, а не сотрудниками спецслужбы, что гарантирует какой-то контроль.
Вы правы, разоблачения Сноудена показали, что АНБ очень хотело эту систему изменить. И здесь есть два момента. Первое. Они хотели систему изменить, но она не была изначально так построена. Поэтому программа, например, PRISM была секретной. Когда она вскрылась, пришлось Обаме объясняться. В нашей стране все считают, что это нормально. Второе, не надо забывать, что
АНБ – это разведывательная структура и задача АНБ собирать информацию не о гражданах США.
Да, конечно, они в результате получали доступ к данным и американских граждан, потому что очень большая часть трафика международного проходит через Соединенные Штаты. Так сделан интернет. Понятно, что это предоставляло определенное преимущество американским спецслужбам, и они хотели все это перехватывать. Но изначально идея была не в том, чтобы контролировать американских граждан, а в том, чтобы перехватывать трафик зарубежный. Это была инициатива разведывательных служб. А у нас мы говорим о том, что
наша система прослушки сделана внутренней службой контрразведки и направлена не на то, чтобы следить за французами и англичанами, а за собственными гражданами.
При этом мы знаем из книжек, что разведка - она нарушает законы других стран, но спецслужбы, действующие внутри страны, в отношении собственных граждан должны соблюдать закон. Но у нас законы построены таким образом, что это предполагает отсутствие всякого контроля. Поэтому в той же Америке существует разница. Если делом занимается ФБР, то есть гарантии соблюдения закона. Если этим занимается АНБ, то другая история.
И последний момент, в чем разница. Это жертвы. Мы очень много слышали о разоблачениях Сноудена в последнее время, обо всех этих программах, но назовите мне какое количество людей от этого пострадало?
Все-таки мы видим, что речь идет о потенциальных возможностях, которые могут использоваться, чтобы следить за людьми и эти материалы могут использоваться, чтобы с этими людьми что-то плохое потом произошло. Но по большому счету мы не можем предоставить список жертв незаконной прослушки АНБ, в том смысле, что эти люди оказались в тюрьме или были убиты или как-то пострадали. В тоталитарном государстве история другая. Технически они могут работать намного хуже, но
список жертв мы все знаем. И прослушки российских оппозиционеров, того же Бориса Немцова, которые выкладывались в интернет во время протестов. И люди были посажены в тюрьму на основании прослушки легальной и нелегальной, когда какой-нибудь прокремлевский телеканал берет какую-то съемку, делает из этого фильм и человека сажают в тюрьму. Тут-то список жертв нам известен.
– А если о технических возможностях говорить. Вы упоминали, что наши спецслужбы пользуются западными технологиями в том числе. А насколько наша страна готова к импортозамещению в этом?

– На самом деле выяснилось, что российские службы в какой-то степени жертвы этой своей инерции и приверженности традициям. Они любят то, что сами делают. Свои процедуры и стандарты, поэтому на самом деле нельзя сказать, что они готовы пользоваться последними достижениями в области слежки. Доходит до смешного. У нас есть компания в России, прямой наследник той шарашки, в которой работал Солженицын. Эта компания – мировой лидер в технологиях идентификации спикеров - людей, которые говорят по телефону. И им удалось продать свою систему в Мексику, где она действует в национальном масштабе. Она стоит по всей Мексике. Когда я спросил у сотрудников: «А у нас-то она стоит?», они сказали – нет. Как же так? Там поставили, а здесь как-то не получается.

Вообще выяснилось, я скажу осторожно, по информации полугодовалой давности, что из всех стран на территории бывшего Советского Союза, исключая Прибалтику, самым интересным государством, в плане использования современных технологий слежки, оказался Узбекистан. Поразительная страна. С одной стороны, они пользуются российским опытом, с другой стороны они покупают технологии по анализу социальных сетей в Израиле - лидере в области производства этих технологий. А с третьей стороны, своих сотрудников они посылают на подготовку в Америку. Но Россия, слава Богу, так далеко за Узбекистаном не пошла.

– А китайский вариант интернета в России возможен?

– Нет. По одной простой причине. Китайский интернет изначально строился с мыслью о цензуре и блокировках. Например, в китайском интернете всегда было так: появляется новый продукт, например, Твиттер, он мгновенно запрещается в Китае, для того, чтобы создать аналог китайский, который будет иметь сервера на территории Китая.
В России все-таки интернет создавался и развивался 20 лет свободно, то есть технологически государство не лезло, и контентом никто не занимался до 2012 года. Понятно, что можно какую-то пришлепку для цензуры сделать, но она вряд ли будет эффективна.
