1. THE CONCEPT OF "MEDIA"
The concept of "mediation" comes from the Latin "mediare" - to mediate. Mediation is negotiations with the participation of a third, neutral party, which is only interested in having the parties resolve their dispute (conflict) as beneficial as possible for the conflicting parties.

Mediation methods rely mainly on negotiating in the context of cooperation. Mediation is especially effective when:
- in the future, the parties may have close business or personal relationships; the parties are not interested in a public hearing, since confidentiality is very important for them;
- a court decision in this case is likely to be appealed;
- the dispute is very complicated in actual or legal terms;
- the dispute touches on business-sensitive issues;
- the parties, for whatever reason, do not want their dispute to be considered by a court (the time for consideration of the case is excessively long, the costs of the proceedings can negate the victory in the process, the outcome of the proceedings is unpredictable), the trial of this case is futile for the parties.

However, there are certain limitations to mediation. Mediation cannot be used in criminal conflicts or in cases where either side suffers from a mental illness, cannot be held accountable for its actions, that is, is incapable. Mediation is effective only when both sides want to resolve the conflict.

In mediation, the decision to terminate a dispute under certain conditions is always made by the parties themselves, since the mediator is not empowered to make any decision binding on the parties to the dispute. The role of the mediator is to help the parties better understand each other, reach agreement, bring their positions closer; in some cases, to help find options for the conditions under which the dispute can be resolved.
The mediator does not examine the evidence and does not assess the legitimacy of the requirements of the parties, his main task is to ensure mutual understanding between the parties, to identify and help realize the possibility of solving the problem on conditions acceptable to all participants. In communicating with each other, the parties often show maximum restraint for fear that the other side will use the information received to gain a negotiated advantage. It is for this that a mediator is needed, which is not involved in the conflict. He possesses more complete information than each of the parties separately, and thus sees the whole picture of the dispute, which allows him to play the role of a navigator, guide the parties through the decision-making process and, ultimately, direct them to an agreement jointly adopted by them.

Mediation is a negotiation process in which the mediator-mediator is the organizer and manages the negotiations in such a way that the parties come to the most beneficial realistic and satisfying interests of both parties agreement, as a result of which the parties resolve the conflict between themselves.

The decision reached by the parties themselves in the course of mediation, as a rule, does not require enforcement, because the parties are satisfied with it and are interested in its implementation.

2. PRINCIPLES OF MEDIA:
- voluntariness;
- equal rights of the parties;
- neutrality, impartiality of the mediator;
- confidentiality.
Voluntaryism: unlike litigation, the entry of all disputing parties into the mediation process is voluntary, and the mediator is freely chosen. No one can force the parties to participate in mediation if they do not want this for any reason. This principle is manifested both in the fact that all decisions are made only by mutual agreement of the parties, and in the fact that each side can refuse mediation at any time and stop negotiations. Before starting mediation, the mediator necessarily discusses the issue of voluntariness and tries to achieve the latter from each of the parties.
Equal rights of the parties: neither party has procedural advantages. They are given the same right to express their opinions, determine the agenda of negotiations, evaluate the acceptability of proposals and terms of the agreement, etc.
Neutrality, impartiality of the mediator: the mediator maintains an independent, impartial relationship with each of the parties and provides them with an equal right to participate in negotiations. If the mediator feels that it is difficult for him to maintain neutrality and that he is not able to get rid of the emotional evaluations arising from him, he refuses to conduct the process.
Confidentiality: everything that is said or discussed in the mediation process remains within this process. A mediator cannot act as a witness if the case is nevertheless brought to court, and does not inform one side of the information that he received from the other in the course of an individual conversation, unless he received special permission or a request from the person who provided the information.
SPECIFICITY OF MEDIA:
- freedom of choice;
- reliance on justice;
- participation in the development and adoption of decisions;
- consent of the parties to the decision;
- the ability to exit the process;
- time and cost of consideration;
- confidentiality;
- flexibility of the process;
- lack of corruption component.
The entry of both disputing parties into the mediation process is voluntary, and the mediator is freely chosen (in this respect, mediation is similar to arbitration in the form of an arbitration court).
In mediation, the debaters themselves work out and make a decision. The mediator does not make any decisions about the debaters and the essence of the conflict.
In court, the disputing parties are obliged to submit to the court decision, even if (as is often the case) one, or even both parties are dissatisfied with this decision. In the process of mediation, all decisions are made only by mutual agreement of the parties, and both of them voluntarily assume the responsibility to implement the decisions taken jointly by them. It is clear that the parties do this if they are satisfied with the decision.
The court’s task is to determine which of the debaters is right and who is to blame (or to share the guilt between them). Mediation is initially aimed at seeking consent. In the course of it, the debaters stop looking for the right and the guilty, and with the help of a mediator they discuss different options for resolving the conflict and jointly choose from them the one that both parties consider the best. Mediation focuses more on what each side understands by justice than directly on legal laws, precedents, or rules.
The risks of mediation are minimal, since each side at any time can refuse to continue the process. Mediation is confidential. Everything remains between the parties to the conflict and the mediator, and the latter will keep all conversations and all information secret. In court, the party cannot stop negotiations at any time, and confidentiality is in principle impossible.
The mediation process is relatively short compared to the length of the trial. This is an important advantage of mediation, especially in our conditions, when the courts are overloaded and the consideration of cases lasts for months, and sometimes for years. In addition, mediation can be cheaper than traditional court procedures.

1. ПОНЯТИЕ "МЕДИАЦИЯ"
Понятие "медиация" происходит от латинского "mediare" - посредничать. Медиация - это переговоры с участием третьей, нейтральной стороны, которая является заинтересованной только лишь в том, чтобы стороны разрешили свой спор (конфликт) максимально выгодно для конфликтующих сторон.

Методы медиации опираются, главным образом, на ведение переговоров в русле сотрудничества. Медиация особенно эффективна в тех случаях, когда:
- в будущем стороны могут иметь тесные деловые или личные отношения; стороны не заинтересованы в публичном разбирательстве, так как для них очень важна конфиденциальность;
- судебное решение по данному делу, скорее всего, будет обжаловано;
- спор очень сложен в фактическом или юридическом плане;
- спор затрагивает чувствительные для бизнеса вопросы;
- стороны по каким-либо причинам не желают, чтобы их спор рассматривал суд (сроки рассмотрения дела чрезмерно велики, затраты на разбирательство могут свести на нет победу в процессе, результат разбирательства непредсказуем), судебное разбирательство этого дела для сторон бесперспективно.

Вместе с тем для медиации существуют и определенные ограничения. Медиация не может быть применена в криминальных конфликтах или в тех случаях, когда какая-либо из сторон страдает душевной болезнью, не может отвечать за свои поступки, то есть недееспособна. Медиация эффективна только тогда, когда обе стороны хотят урегулировать конфликт.

В медиации решение о прекращении спора на тех или иных условиях всегда принимается самими сторонами, так как медиатор не наделен полномочиями выносить какое-либо решение, обязательное для сторон спора. Роль медиатора заключается в том, чтобы помочь сторонам лучше понять друг друга, достичь согласия, сблизить свои позиции; в некоторых случаях - помочь найти варианты условий, на которых может быть урегулирован спор.
Медиатор не исследует доказательства и не дает оценку правомерности требований сторон, его главная задача - обеспечить взаимопонимание между сторонами, выявить и помочь реализовать возможность решения проблемы на условиях, приемлемых для всех участников. В общении между собой стороны нередко проявляют максимальную сдержанность из опасения, что другая сторона воспользуется полученной информацией для приобретения переговорного преимущества. Именно для этого и нужен медиатор, который в конфликте не участвует. Он владеет более полной информацией, чем каждая из сторон в отдельности, и, таким образом, видит всю картину спора, что позволяет ему играть роль штурмана, вести стороны по процессу выработки решения и, в конце концов, направлять к совместно принимаемому ими соглашению.

Медиация - это процесс переговоров, в котором медиатор-посредник является организатором и управляет переговорами таким образом, чтобы стороны пришли к наиболее выгодному реалистичному и удовлетворяющему интересам обеих сторон соглашению, в результате выполнения которого стороны урегулируют конфликт между собой.

Решение, достигнутое самими сторонами в ходе медиации, как правило, не требует принудительного исполнения, потому что стороны удовлетворены им и заинтересованы в его исполнении.

2. ПРИНЦИПЫ МЕДИАЦИИ:
- добровольность;
- равноправие сторон;
- нейтральность, беспристрастность медиатора;
- конфиденциальность.
Добровольность: в отличие от судебной тяжбы, вступление всех спорящих сторон в процесс медиации является добровольным, а медиатор - свободно выбранным. Никто не может заставить стороны участвовать в медиации, если они не хотят этого по какой-либо причине. Этот принцип проявляется и в том, что все решения принимаются только по взаимному согласию сторон, и в том, что каждая сторона в любой момент может отказаться от медиации и прекратить переговоры. Прежде чем начинать медиацию, медиатор обязательно обсуждает вопрос добровольности и старается добиться последней от каждой из сторон.
Равноправие сторон: ни одна сторона не имеет процедурных преимуществ. Им предоставляется одинаковое право высказывать свои мнения, определять повестку переговоров, оценивать приемлемость предложений и условий соглашения и т.д.
Нейтральность, беспристрастность медиатора: медиатор сохраняет независимое, беспристрастное отношение с каждой из сторон и обеспечивает им равное право участия в переговорах. Если медиатор чувствует, что ему трудно сохранить нейтральность и что ему не удаётся избавиться от возникающих у него эмоциональных оценок, он отказывается от ведения процесса.
Конфиденциальность: все, о чем говорится или обсуждается в процессе медиации, остается внутри этого процесса. Медиатор не может выступать в качестве свидетеля, если дело все-таки будет передано в суд, и не сообщает одной стороне информацию, которую он получил от другой в процессе индивидуальной беседы, если не получил на это специального разрешения или просьбы от сообщившего информацию.
СПЕЦИФИКА МЕДИАЦИИ:
- свобода выбора;
- опора на справедливость;
- участие в выработке и принятии решения;
- согласие сторон с принятым решением;
- возможность выхода из процесса;
- время и стоимость рассмотрения;
- конфиденциальность;
- гибкость процесса;
- отсутствие коррупционной составляющей.
Вступление обеих спорящих сторон в процесс медиации является добровольным, а медиатор – свободно выбранным (в этом отношении медиация сходна с арбитражем в форме третейского суда).
В медиации спорщики сами вырабатывают и принимают решение. Медиатор никаких решений по поводу спорщиков и сути конфликта не принимает.
В суде спорящие стороны обязаны подчиниться судебному решению, даже если (как это нередко бывает) одна, а то и обе стороны этим решением недовольны. В процессе медиации все решения принимаются только по обоюдному согласию сторон, и обе они добровольно берут на себя обязанность выполнять принятое ими совместно решения. Понятно, что стороны делают это, если удовлетворены решением.
В задачу суда входит определить, кто из спорщиков прав и кто виноват (или разделить вину между ними). Медиация изначально нацелена на поиск согласия. В ходе нее спорщики перестают искать правого и виноватого, а с помощью посредника обсуждают разные варианты решения конфликта и совместно выбирают из них тот, который обе стороны сочтут наилучшим. Медиация ориентирована скорее на то, что каждая из сторон понимает под справедливостью, чем непосредственно на юридические законы, прецеденты или правила.
Риски при медиации минимальны, поскольку каждая сторона в любой момент может отказаться от продолжения процесса. Медиация проходит конфиденциально. Все остается между сторонами конфликта и медиатором, а последний будет держать в секрете все разговоры и всю информацию. В суде же сторона не может в любой момент прекратить переговоры, а конфиденциальность в принципе невозможна.
Процесс медиации относительно непродолжителен в сравнении с длительностью судебного разбирательства. Это немаловажное преимущество медиации, особенно в наших условиях, когда суды перегружены и рассмотрение дел тянется месяцами, а иногда и годами. К тому же, медиация может обойтись дешевле, чем традиционные судебные процедуры.

MEDIA PROCEDURES
Mediation procedures establish the basic rules for regulating commercial mediation, which will guide mediators at the request of the relevant Parties in accordance with their agreement on mediation activities (Mediation Agreement). The rules of the mediation procedure presuppose, as a preliminary condition, that the Parties choose a mediator for the mediation procedure and that the Mediation Agreement contains the necessary information regarding the Dispute arising between the parties. The rules of the mediation procedure become part of the Mediation Agreement by entering into it mediation procedures.
1. PURPOSE, TIME AND PLACE OF MEDIA
1.1 The purpose of the Mediation is to provide the Parties with the help of a mediator the opportunity to study all real methods of resolving the Dispute in order to determine by negotiation a solution acceptable to each of the Parties.
1.2 Mediation will take place at the place and at the time that the Parties determine in the Mediation Agreement.
2. PARTICIPANTS
2.1 Each of the parties shall indicate in the Mediation Agreement: (a) persons who will act as the main negotiators on behalf of the Party (Main Negotiators) and (b) other persons, such as an external consultant or employee, who will also be present and / or participate in mediation on behalf of a Party.
2.2 Each Party should be responsible for ensuring the full implementation of the rules on confidentiality and other rules of this Mediation Procedure by representatives, any other persons attending the Mediation at its request, as well as the employees of the Party, its agents, etc.
3. BASIC RULES OF MEDIA PROCEDURE
3.1 The mediator directs the course of the Mediation Procedure and should have all the necessary powers to determine the procedure for such a procedure.
3.2 Unless otherwise decided by the mediator or by agreement of the Parties, mediation will consist of the following stages: (a) the first meeting with the Parties to consider issues and main mediation activities; (b) a study stage, which may consist of personal meetings of the mediator on each side; (c) the stage of negotiations at which the mediator and the Parties will consider various options for decisions; and (d) the final stage at which the parties will try to determine the final conditions for resolving the dispute.
3.3 Any information transmitted to the mediator by the Parties during personal meetings of the mediator with each of the Parties is considered to be strictly confidential. If a Party wishes that part of the information was communicated to the other Party, the mediator should agree with her on the content and amount of such information.
3.4 Recording and shorthanding, as well as the presence of unauthorized persons during mediation, are prohibited.
3.5 If there is any question regarding the conduct of mediation, and the Parties cannot resolve it within a reasonable time, the Party may request from the League of Mediators (League) a recommendation on resolving this issue that is not binding.
4. EXCHANGE OF INFORMATION BEFORE THE MEDIA BEGINS
4.1 Parties should consult with the mediator in advance to receive mediator recommendations regarding the materials that must be provided to him before mediation begins. The mediator should give such recommendations, based on his own experience, in order to successfully conduct mediation.
4.2 In the Mediation Agreement, the Parties are obliged to agree with the mediator a list of materials to be provided. Such materials will consist of: (a) a summary of the parties' opinions on the Dispute (a statement of the circumstances of the case, restrictions on the scope of which are set in the Mediation Agreement) and (b) the necessary documents that are referred to in the Statement of the circumstances of the case and which may be required to mediation time (Required Documents).
4.3 The parties may also determine in the Mediation Agreement the circumstances and issues on which the parties agree, such as an agreed statement of facts, statement of contentious issues, the content of the general list of documents.
4.4 In addition to the Required Documents, the Party may send to the mediator and / or bring for mediation other documentation that the Party wants to confidentially provide to the mediator, but not to the other Party. In this case, the Party must clearly indicate in writing that this documentation is transmitted to the mediator in confidence.
5. MEDIATOR
5.1 In his activity, the Mediator should make every effort to, in accordance with the principles of mediation, help the parties to resolve the Dispute, in consultation with the Parties, as necessary.
5.2 The mediator may make individual meetings with the parties to clarify information, clarify circumstances and prepare for negotiations.
6. PRIVACY
6.1 Each person participating in the Mediation Procedure is obliged to keep secret and not use for personal and any other purposes information: (a) that mediation has occurred or will occur (unless it is necessary to inform the court on conducting the Mediation Procedure); (b) any information arising from or related to mediation (written, oral or otherwise expressed), including information on the existence of any dispute settlement agreements or the terms of such agreements. (Detailed clarification of the information may be recorded).
6.2 Any information (written, oral, or expressed in any other form) arising or related to mediation is confidential and cannot be disclosed or serve as evidence in any court or other proceedings, existing or future. This provision does not apply to information that would in any case become admissible evidence or would be disclosed in such proceedings.
6.3 Paragraphs 6.1 and 6.2 do not apply insofar as disclosure of such information is necessary to enforce the dispute settlement agreement.
6.4 None of the parties may involve a mediator in any court or other proceedings as a witness, consultant, arbitrator or expert. In addition, the mediator cannot act in this capacity without the written consent of all Parties.
7. DISPUTE RESOLUTION AGREEMENT
7.1 None of the dispute settlement agreements reached during mediation can be legally binding until it is drawn up in writing and signed by the Parties.
7.2 If, during mediation, the Parties fail to make a decision on reconciliation during negotiations, and if all Parties request it, and the mediator agrees, the mediator will make a non-binding reconciliation decision for the Parties. In this case, the recommendation of the mediator from his professional point of view is a fair and proper resolution of the dispute and should be based on all available facts and circumstances.
7.3 Mediation is considered completed after the conclusion of a written agreement on the settlement of the dispute, or if the Parties otherwise agree to complete the mediation.
8. POSSIBLE PREMATURE TERMINATION OF MEDIA
8.1 Any Party may withdraw from mediation at any time. In this case, the Party is obliged to immediately notify the mediator and all other representatives in writing. Mediation is terminated if: (a) the party withdraws from mediation, (b) the mediator decides that the continuation of negotiations is unlikely to end with an agreement to resolve the dispute, (c) the mediator decides that he should refuse further execution duties for any reason that does not allow observing at least one of the basic principles of mediation: neutrality, confidentiality, voluntariness, equal participation of the parties in negotiations.
9. RESPONSIBILITY NOT TO REPRESENT INTERESTS OF ANY PARTY
9.1 The Mediator (or any other League employee) will not single-handedly carry out any actions relating to the Dispute that is the subject of mediation related to the representation of the interests of any of the Parties during the mediation by the mediator or after its completion, without the written consent of all Of the parties. The Parties agree that in relation to the Dispute, the mediator does not act as an agent of any of the Parties and does not carry out any actions on her behalf or on her behalf.
10. AGREEMENT REGARDING THE CURRENT OR FOLLOWING JUDICIAL PROCEEDINGS
10.1. The Parties are free to decide on the commencement or continuation of any legal proceedings in relation to the Dispute between the Parties, unless the Parties have agreed otherwise in the Mediation Agreement, or the court otherwise requires.
11. PAYMENT FOR SERVICES AND REMUNERATION OF MEDIA COSTS
11.1. Payment of services and reimbursement of the costs of the mediator / s shall be made by the parties in equal shares in the amount specified in the Mediation Agreement.
11.2 Each Party shall bear its own costs of participating in mediation (such as payment for legal services, experts, etc.).
11.3 If the mediation is completed before the conclusion of the reconciliation agreement, the mediator has the right to remuneration for the services rendered to him.
12. EXCLUSION OF RESPONSIBILITY
The mediator shall not be liable to the Parties for any actions or omissions related to the provision of mediation services, unless such actions or omissions resulted from gross negligence.

Mediation Approaches
* Problem-solving or settlement-directed approach
The main feature of this approach is the focus on the interests of people, and not on positions: position is the outcome of the conflict, which the party declares as the most preferable; interests - the goal that must be satisfied or achieved. In the framework of this approach, the mediator first offers the parties to state their positions, and only then helps them to recognize that the parties have common interests and needs.
* Transformative mediation (transformative approach)
This approach allows participants to determine the course of mediation, while the mediator follows them (and not vice versa, when participants follow the instructions of the mediator). In this case, the focus is on the communication of the parties, giving them the opportunity to take a fresh look at what is happening and understand this with the heart, and not just the mind. Here, the key components are hearing and listening: this is what helps the parties to the conflict to survive a certain “transformation” and come to an understanding, which, in turn, helps them to recognize each other's needs and to be more sensitive to such needs.
* Narrative mediation (narrative approach)
The narrative approach is based on the belief that mediators and participants in the conflict have a lasting influence on each other during the dialogue, that is, the process itself looks like a process in which participants present their views on what is happening.
* Ecosystem or family-focused approach
This approach to mediation is well suited for resolving family conflicts because the main task in resolving such conflicts is to help families overcome future changes and maintain normal relations with children. This approach is also applicable to intercultural conflicts and disputes between people of different generations.
* Mediation based on understanding (understanding-based approach)
The main goal of this approach is to resolve the dispute through understanding, since a deeper understanding by the parties of their own prospects, priorities and interests, as well as prospects, priorities and interests of all other parties, makes them capable of joint efforts to overcome the conflict that has arisen between them. Within the framework of this approach, the responsibility of the parties for the decisions that they make is of key importance. This approach assumes that it is the participants themselves, and not the professionals, who are most fully aware of the essence of the dispute and have the best opportunity to find a solution.
* Evaluation mediation (evaluative approach)
The mediator influences the mediation process, evaluating what is happening, and in certain circumstances, influences the outcome of the dialogue, if necessary, offering its own options for resolving the conflict

ПРОЦЕДУРЫ МЕДИАЦИИ
Процедуры медиации устанавливают основные правила регулирования коммерческой медиации, которыми будут руководствоваться медиаторы по запросу соответствующих Сторон в соответствии с их договором о проведении медиационной деятельности (Договор о Медиации). Правила процедуры медиации предполагают в качестве предварительного условия выбор Сторонами медиатора для проведения процедуры медиации и наличие в Договоре о Медиации необходимой информации относительно Спора, возникшего между сторонами. Правила процедуры медиации становятся частью Договора о Медиации путем внесения в него ссылки на Процедуры медиации.
1. ЦЕЛЬ, ВРЕМЯ И МЕСТО МЕДИАЦИИ
1.1 Целью Медиации является предоставление Сторонам при помощи медиатора возможности изучить все реальные способы разрешения Спора с целью определения путем переговоров решения, приемлемого для каждой из Сторон.
1.2 Медиации будут происходить в том месте и в то время, которые определят Стороны в Договоре о Медиации.
2. УЧАСТНИКИ
2.1 Каждая из сторон должна указать в Договоре о Медиации: (а) лиц, которые будут выступать в качестве главных переговорщиков от имени Стороны (Главные Переговорщики) и (б) других лиц, таких как внешний консультант или сотрудник, которые тоже будет присутствовать и/или участвовать в медиации от имени Стороны.
2.2 Каждая Сторона должна нести ответственность по обеспечению полного выполнения правил о конфиденциальности и других правил данной Процедуры медиации со стороны представителей, любых других лиц, посещающих Посредничество по ее запросу, а также работников Стороны, ее агентов и др.
3. ОСНОВНЫЕ ПРАВИЛА ПРОЦЕДУРЫ МЕДИАЦИИ
3.1 Медиатор руководит ходом Процедуры медиации и должен обладать всеми необходимыми полномочиями по определению порядка проведения такой процедуры.
3.2 Если решение об ином не было принято медиатором или соглашением Сторон, медиация будет состоять из следующих стадий: (а) первая встреча со Сторонами для рассмотрения вопросов и основных мероприятий медиации; (б) стадия изучения, которая может состоять из личных встреч медиатора с каждой из сторон; (в) стадия переговоров, на которой медиатор и Стороны будут рассматривать различные варианты решений и (г) заключительная стадия, на которой стороны попытаются определить окончательные условия разрешения спора.
3.3 Любая информация, переданная медиатору Сторонами во время проведения личных встреч медиатора с каждой из Сторон, рассматривается в качестве строго конфиденциальной. Если Сторона пожелает, чтобы часть информации была сообщена другой Стороне, медиатор должен согласовать с ней содержание и объем такой информации.
3.4 Запись и стенографирование, а также присутствие посторонних лиц во время медиации запрещены.
3.5 Если появится какой-либо вопрос касательно проведения медиации, и Стороны не смогут в течение разумного времени его разрешить, Сторона может запросить от "Лиги Медиаторов" (Лига) рекомендацию о решении данного вопроса, не носящую обязательный характер.
4. ОБМЕН ИНФОРМАЦИЕЙ ДО НАЧАЛА МЕДИАЦИИ
4.1 Стороны должны заблаговременно проконсультироваться с медиатором для получения рекомендаций медиатора касательно материалов, которые должны быть ему предоставлены до начала медиации. Медиатор должен давать подобные рекомендации, исходя из собственного опыта, с целью успешного проведения медиации.
4.2 В Договоре о медиации Стороны обязаны согласовать с медиатором список подлежащих предоставлению материалов. Такие материалы будут состоять из: (а) краткого изложения мнений сторон о Споре (изложение обстоятельств дела, ограничения по объему которого устанавливаются в Договоре о медиации) и (б) необходимых документов, на которые имеются ссылки в Изложении обстоятельств дела и которые могут потребоваться во время проведения медиация (Необходимые Документы).
4.3 Стороны могут также определить в Договоре о медиации обстоятельства и вопросы, по которым стороны пришли к согласию, такие как согласованное изложение фактов, констатация спорных вопросов, содержание общего списка документов.
4.4 В дополнение к Необходимым Документам Сторона может прислать медиатору и/или принести на медиацию другую документацию, которую Сторона захочет конфиденциально предоставить медиатору, но не другой Стороне. В таком случае Сторона должна в письменной форме точно указать, что данная документация передана медиатору конфиденциально.
5. МЕДИАТОР
5.1 В своей деятельности Медиатор должен прилагать все усилия для того, чтобы в соответствии с принципами медиации, помочь сторонам решить Спор, консультируясь со Сторонами по мере необходимости.
5.2 Медиатор может назначать индивидуальные встречи сторонам для уточнения информации, прояснения обстоятельств и подготовки к переговорам.
6. КОНФИДЕНЦИАЛЬНОСТЬ
6.1 Каждое лицо, участвующее в Процедуре медиации, обязано хранить в тайне и не использовать в корыстных и каких бы то ни было других целях информацию: (а) о том, что медиация имела место или будет происходить (за исключением случаев, когда требуется проинформировать суд о проведении Процедуры медиации); (б) любую информацию, возникающую в результате проведения медиации или связанную с ним (письменную, устную или выраженную в иной форме), включая информацию о наличии каких-либо соглашений об урегулировании спора или условиях таких соглашений. (Детальное уточнение информации может зафиксировано).
6.2 Любая информация (письменная, устная, или выраженная в иной форме), возникающая или связанная с медиацией, является конфиденциальной и не может быть разглашена или служить в качестве доказательства в каких-либо судебных и других разбирательствах, уже существующих или будущих. Данное положение не применяется в отношение информации, которая в любом случае стала бы допустимым доказательством или была бы раскрыта в подобных разбирательствах.
6.3 Параграфы 6.1 и 6.2 не применяются постольку, поскольку разглашение такой информации является необходимым для обеспечения исполнения соглашения об урегулировании спора.
6.4 Ни одна из сторон не может привлекать медиатора к какому-либо судебному или иному разбирательству в качестве свидетеля, консультанта, арбитра или эксперта. Помимо этого, медиатор не может выступать в таком качестве без наличия письменного согласия всех Сторон.
7. СОГЛАШЕНИЕ ОБ УРЕГУЛИРОВАНИИ СПОРА
7.1 Ни одно соглашение об урегулировании спора, достигнутое в ходе медиации, не может иметь юридически обязательную силу до его составления в письменной форме и подписания Сторонами.
7.2 Если во время медиации Стороны не смогут принять решение о примирении в ходе переговоров, и если все Стороны об этом запросят, и медиатор согласится - медиатор примет для Сторон рекомендательное решение о примирении, не носящее обязательный характер. В таком случае, рекомендация медиатора с его профессиональной точки зрения является справедливым и надлежащим разрешением спора и должна быть основана на всех имеющихся фактах и обстоятельствах.
7.3 Медиация считается завершенной после заключения письменного соглашения об урегулировании спора, либо в случае, если Стороны иным образом договорись о завершении медиации.
8. ВОЗМОЖНОЕ ДОСРОЧНОЕ ПРЕКРАЩЕНИЕ МЕДИАЦИИ
8.1 Любая из Сторон может в любой момент выйти из медиации. В этом случае Сторона обязана незамедлительно известить медиатора и всех других представителей в письменной форме. Медиация прекращается, если: (а) Сторона выходит из медиации, (б) медиатор принимает решение о том, что продолжение переговоров вряд ли завершится заключением соглашения об урегулировании спора, (с) медиатор принимает решение о том, что он должен отказаться от дальнейшего исполнения обязанностей по любой из причин, не позволяющих соблюдать хотя бы один из основных принципов медиации: нейтральность, конфиденциальность, добровольность, равноправное участие сторон в переговорах.
9. ОБЯЗАННОСТЬ НЕ ПРЕДСТАВЛЯТЬ ИНТЕРЕСЫ КАКОЙ-ЛИБО ИЗ СТОРОН
9.1 Медиатор (или какой-либо другой работник Лиги) не будет единолично осуществлять какие-либо действия, относящиеся к Спору, являющемуся предметом медиации, связанные с представлением интересов любой из Сторон, во время осуществления медиатором медиации или после ее окончания, без письменного согласия всех Сторон. Стороны согласны с тем, что в отношении Спора медиатор не выступает в качестве агента любой из Сторон и не осуществляет какие-либо действия от ее имени или по ее поручению.
10. СОГЛАШЕНИЕ КАСАТЕЛЬНО ТЕКУЩИХ ИЛИ ПОСЛЕДУЮЩИХ СУДЕБНЫХ РАЗБИРАТЕЛЬСТВ
10.1 Стороны свободны в принятии решения о начале или продолжении какого-либо судебного разбирательства в отношении Спора между Сторонами, если Стороны не договорились об ином в Договоре о медиации, либо иное требует суд.
11. ОПЛАТА УСЛУГ И ВОЗМЕЩЕНИЕ РАСХОДОВ МЕДИАТОРА
11.1 Оплата услуг и возмещение расходов медиатора/-ров осуществляется сторонами в равных долях в сумме, определенной в Договоре о медиации.
11.2 Каждая Сторона сама несет свои расходы по участию в медиации (такие как оплата юридических услуг, экспертов и т.п.).
11.3 В случае, если медиация завершилась до заключения соглашения о примирении, у медиатора возникает право на вознаграждение за оказанные им услуги.
12. ИСКЛЮЧЕНИЕ ОТВЕТСТВЕННОСТИ
Медиатор не несет ответственность перед Сторонами за любые действия или бездействие, связанные с оказанием услуг по медиации, за исключением случаев, когда подобные действия или бездействие явились результатом грубой небрежности.

Подходы в медиации
* Медиация, ориентированная на решение проблем (problem-solving or settlement-directed approach)
Основной особенностью этого подхода является сосредоточенность на интересах людей, а не на позициях: позиция — это исход конфликта, который сторона заявляет как наиболее предпочтительный; интересы — цель, которая должна быть удовлетворена или достигнута. В рамках данного подхода медиатор вначале предлагает сторонам изложить свои позиции, а уже потом помогает им признать, что у сторон существуют общие интересы и потребности.
* Трансформативная медиация (transformative approach)
Данный подход позволяет участникам определить ход медиации, в то время как медиатор следует за ними (а не наоборот, когда участники следуют указаниям медиатора). В данном случае, в центре внимания — общение сторон, предоставление им возможности по-новому взглянуть на происходящее и понять это сердцем, а не только разумом. Здесь ключевыми компонентами являются слышание и слушание: именно это помогает участникам конфликта пережить некую «трансформацию» и прийти к взаимопониманию, что, в свою очередь, способствует признанию ими потребностей друг друга и более чуткому отношению к таким потребностям.
* Нарративная медиация (narrative approach)
Нарративный подход основан на убеждении в том, что медиаторы и участники конфликта оказывают продолжительное влияние друг на друга в ходе диалога, то есть сам процесс выглядит как процесс, в ходе которого участники излагают свой взгляд на происходящее.
* Экосистемная или семейно-ориентированная медиация (ecosystemic or family-focused approach)
Данный подход к медиации хорошо подходит для урегулирования семейных конфликтов потому, что основной задачей в ходе разрешения подобных конфликтов является помощь семьям в преодолении грядущих перемен и сохранении нормальных отношений с детьми. Этот подход также применим к межкультурным конфликтам и спорам между людьми разных поколений.
* Медиация, основанная на понимании (understanding-based approach)
Главная цель этого подхода заключается в разрешении спора посредством понимания, так как более глубокое понимание сторонами их собственных перспектив, приоритетов и интересов, как и перспектив, приоритетов и интересов всех других сторон, делает их способными совместными усилиями преодолеть возникший между ними конфликт. В рамках данного подхода ключевое значение имеет ответственность сторон за те решения, которые они принимают. Такой подход предполагает, что именно сами участники, а не профессионалы, наиболее полно представляют себе суть спора и имеют наилучшие возможности найти решение.
* Оценочная медиация (evaluative approach)
Медиатор влияет на процесс медиации, оценивая происходящее, а при определенных обстоятельствах и оказывает влияние на результат диалога, при необходимости предлагая свои варианты разрешения конфликта

The State Duma of the Russian Federation today adopted in third reading the law on alternative dispute resolution - on the mediation procedure, the correspondent of Pravo.Ru Elena Sharpaeva reports.

A package of bills was submitted to the State Duma by the President of the Russian Federation. Its goal is to offer a convenient and quick way to resolve disputes, which should be flexible and guarantee the feasibility of the decision made during the mediation process.

In addition, the issue of ship unloading has long been ripened in Russia, which has been repeatedly discussed in the professional community. So, in December 2009, the chairman of the Moscow arbitration, Oleg Sviridenko, noted that the load on his court doubled in 2009, and conveyor production could not but humiliate professionals.

At a conference in ASGM on the topic of ship unloading, held in June 2010, Oleg Sviridenko called on the Duma members to begin work on developing a set of laws that would reduce the load on the courts. In his opinion, the law on mediation is an insufficient step in this direction. Note that the conference was attended by the head of the Duma committee on constitutional law and state construction Vladimir Pligin.

Federal Law projects regulate disputes arising in connection with entrepreneurial or other economic activities, as well as disputes arising from labor relations. In this case, the mediation procedure can be applied after the emergence of disputes considered in the framework of civil and arbitration proceedings.

The mediation procedure can be applied only at the will of the two parties and cannot be applied if "the disputes affect or may affect the interests of third parties not participating in the mediation procedure or public interests". The mediation procedure is divided into out-of-court, pre-trial and judicial, bills to a greater extent regulate the last two. At the same time, all information is kept confidential.

It is determined that if the parties have concluded an agreement on the application of the mediation procedure before referring the case to a court or an arbitration court, then he supports this decision until the parties resolve their issues. In this case, the disputants have the right to use the mediation procedure at any time when considering the case by the court or the arbitration court.

The procedure for mediation is established by the parties, however, the draft laws specify that "the mediator and the parties should take all possible measures to ensure that the procedure is completed in no more than 60 days."

In addition, separate amendments to the agro-industrial complex of the Russian Federation and the Civil Code of the Russian Federation, as well as to the law "On Arbitration Courts", stipulate that mediation is one of the conciliation procedures, the procedure for conducting the mediation procedure at any stage of the dispute is prescribed.

Also, the amendment to Article 203 of the Civil Code of the Russian Federation introduces the addition that “the limitation period is interrupted if the parties to the dispute decide to use the mediation procedure”.

Amendments to Article 56 of the Arbitration Procedure Code of the Russian Federation and 69 of the Civil Code of the Russian Federation establish that mediators are independent persons and cannot be questioned as witnesses about the circumstances that they became aware of in the performance of their duties.

In the basic Federal Law, legislators establish the basic requirements for a mediator who can carry out activities both on a professional and non-professional basis. Persons over 18 years of age who are legally capable can work on an unprofessional basis. On a professional basis, people who have reached the age of 25 years, have higher professional education, and have completed a training course in the program for training mediators can be mediators. The program will be determined by the Government of the Russian Federation.

The mediator is not entitled to hold public office, is not entitled to be a representative of any of the parties, to render any side of legal advice, to make statements on the merits of the dispute without the consent of the parties, to participate as a mediator in the dispute where he is an interested party, including with someone in family relationships.

Today, deputies of various factions supported the adoption of the law, the exception was the Communist Party. Communist Party deputy Nikolai Kolomeytsev noted that the faction will not vote for the law. In his opinion, this law will not be sufficiently effective, but will provide an opportunity to delay the trial, since mediation can be agreed upon within the framework of the trial.

Госдума РФ сегодня приняла в третьем чтении закон об альтернативном урегулировании споров — о процедуре медиации, сообщает корреспондент "Право.Ru" Елена Шарпаева.

Пакет законопроектов был внесен в Госдуму Президентом РФ. Его цель — предложить удобный и быстрый способ разрешения споров, который должен отличаться гибкостью и гарантировать исполняемость решения, принятого в ходе процедуры медиации.

Кроме того, в России давно назрел вопрос о разгрузке судов, о чем неоднократно говорили в профессиональном сообществе. Так, в декабре 2009 года председатель московского арбитража Олег Свириденко отмечал, что нагрузка на его суд в 2009 году увеличилась в два раза, а конвейерное производство не может не унижать профессионалов.

На конференции в АСГМ по теме разгрузки судов, состоявшейся в июне 2010 года, Олег Свириденко призвал думцев начать работу по разработке комплекса законов, которые бы снизили нагрузку на суды. По его мнению, закон о медиации является недостаточным шагом в этом направлении. Отметим, что на этой конференции участвовал глава думского комитета по конституционному законодательству и госстроительству Владимир Плигин.

Проекты ФЗ регулируют споры, возникающие в связи с осуществлением предпринимательской или иной экономической деятельности, а также споры, возникающих из трудовых отношений. При этом процедура медиации может применяться после возникновения споров, рассматриваемых в рамках гражданского и арбитражного судопроизводства.

Процедура медиации может применяться только при волеизъявлении двух сторон и не может применяться, если "споры затрагивают или могут затронуть интересы третьих лиц, не участвующих в процедуре медиации, или публичные интересы". Процедура медиации делится на внесудебную, досудебную и судебную, законопроекты в большей степени регулируют две последние. При этом сохраняется конфиденциальность всей информации.

Определяется, что если стороны заключили соглашение о применении процедуры медиации до передачи дела в суд или третейский суд, то он поддерживает такое решение до тех пор, пока стороны не решат свои вопросы. При этом спорящие имеют право использовать процедуру медиации в любой момент при рассмотрении дела судом или третейским судом.

Порядок проведения медиации устанавливается сторонами, однако в законопроектах уточняется, что "медиатор и стороны должны принимать все возможные меры к тому, чтобы процедура была завершена в срок не более 60 дней".

Кроме того, отдельными поправками в АПК РФ и ГК РФ, а также в закон "О третейских судах" закрепляется, что медиация является одной из примирительных процедур, прописывается порядок проведения процедуры медиации на любой стадии спора.

Также поправкой в статью 203 ГК РФ вводится дополнение, что "течение срока исковой давности прерывается, если сторонами спора принято решение об использовании процедуры медиации".

Поправками в статью 56 АПК РФ и 69 ГК РФ устанавливается, что медиаторы являются независимыми лицами, и не могут быть допрошены в качестве свидетелей о тех обстоятельствах, которые им стали известны при исполнении своих обязанностей.

В базовом ФЗ законодатели устанавливают основные требования к медиатору, который может осуществлять деятельность как на профессиональной, так и не на профессиональной основе. Работать на непрофессиональной основе могут лица, достигшие 18 лет, которые являются дееспособными. На профессиональной основе могут быть медиаторами лица, достигшие 25-летнего возраста, имеющие высшее профессиональное образование, прошедшие курс обучения по программе подготовки медиаторов. Программу будет определять Правительство РФ.

Медиатор не вправе занимать государственные должности, не вправе быть представителем какой-либо из сторон, оказывать какой-либо стороне юрконсультации, делать без согласия сторон заявления по существу спора, участвовать в качестве медиатора в споре, где он является заинтересованной стороной, в том числе состоит с кем-либо в родственных связях.

Сегодня депутаты различных фракций поддержали принятие закона, исключение составила партия КПРФ. Депутат от КПРФ Николай Коломейцев отметил, что фракция не будет голосовать за закон. По его мнению, этот закон не будет достаточно эффективным, а даст возможность затягивать судебное разбирательство, так как медиация может быть согласована и в рамках судебного процесса.
