Psychological Features of Investigative Actions - Part 1

This article will be useful to everyone who wants to be ready for any turns of life. Here are samples of manuals for investigators. Do not be confused by such words as “guilty”, “criminal” and the language of the article as a whole.

Mental states of the suspect and the accused, especially their behavior during the preliminary investigation
In an effort to evade responsibility and hide his participation in the crime, the perpetrator is trying to conceal from others and related experiences. Unlike the suspect, the accused most often has more information about the state of affairs, about the content of the available evidence from the investigation. However, at the preliminary investigation, the suspect and the accused have many similar psychological states, motives, motives, and hence behavioral features. Mental states, motives for actions, and personal qualities of the interrogated determine their behavior during the preliminary investigation and thereby determine the psychological approach to them, choosing the most effective, tactical and psychological techniques. During interrogation, the accused may experience a wide variety of feelings. The perpetrator is afraid of being exposed and, of course, punishment. This usually depresses the psyche, can significantly suppress the will of the interrogated, reduce the ability to correctly assess the circumstances, worsen self-control, lead the accused to a depressed, depressive state. Fear usually arises in the person who committed the crime, long before bringing him to criminal responsibility. Such psychological conditions make it difficult to establish psychological contact with the interrogated, reduce the effectiveness of tactical interrogation techniques. During interrogation, the accused may be in a state of mental shock, shame, fearing that relatives and friends, friends, colleagues, and neighbors will find out about the incident. The moral assessments and judgments of those around are not indifferent even to people with established antisocial views. Unwillingness to publicize is a very strong motive, which largely determines the behavior of the accused.

For some accused, the fear of losing their social, official, and material status is typical. Therefore, during interrogation, such an accused most often avoids giving truthful testimonies. Here, the investigator, in order to overcome the indicated psychological state of the accused, must convince him of the possibility of honest and conscientious work to restore social status, to become a full member of society.

A strong psychological state that forms the motives of the accused’s behavior is the fear of imprisonment, a habitual way of life, to be among the criminals. This feeling, especially inherent to persons who have committed a crime for the first time and who have been prosecuted, usually leads them to a state of deep depression. In such a situation, the accused believes that it is possible to avoid detention, arrest, detention, a sentence related to deprivation of liberty only by denying his guilt and giving false testimonies, he develops an appropriate psychological state, and a position is formed that the investigator needs to overcome. This requires convincing the accused that proving guilt does not depend much on his confession, and to a decisive extent on the totality of evidence. Here it is required to explain to the accused that sincere repentance, as well as active assistance in solving the crime, is a circumstance mitigating responsibility for the court. Practice shows that in crimes committed by a group, the accused treats accomplices differently. If he owes much to someone, he tries to hide his involvement in the crime of this person, hoping for his help and support. More often, the system of psychological relations in a criminal group is based on submission to strength, fear, other base motives and instincts. Therefore, in the investigation process, when members of a criminal group are isolated from each other, relations built on this basis break up. The accused is growing hostility towards the people who dragged him into a criminal group, through whose fault he was prosecuted. The investigator uses the similar psychological state of the accused, reveals to him the system of relations that existed in the criminal group, shows what the false sense of camaraderie among criminals is based on, uses this knowledge to select the most effective tactical methods of interrogation. The accused at the preliminary investigation is very characteristic of the psychological state of anxiety, uncertainty, the impossibility of correctly anticipating the current situation and managing it. Often the suspect does not know what evidence the investigator has, what preventive measure can be taken, what investigative actions, including those of a compulsory nature, will be carried out, etc. Such a psychological state is the basis for the development and application of tactical and psychological techniques. A person’s behavior is largely determined by the influence of a dominant on him - the currently dominant focus of excitation in the cerebral cortex, which is highly sensitive to irritation and is able to inhibit the functioning of other nerve centers. Often, the dominant affects the offender. Experiencing feelings of anxiety, regret, fear, remorse, etc., the offender mentally returns to the crime event, thinks about possible adverse consequences. This process leads to even greater intensification of experiences, to constant reinforcement of the focus of excitement - the dominant. It is noted that the more serious the crime, the brighter the changes in the behavior of the offender.

However, the dominant value is not limited to this. It has long been noticed that a person who has committed a serious crime is experiencing severe psychological stress. The desire to hide involvement in the crime, the need to disguise to look calm, lead to increased inhibition in the cells of the cerebral cortex. After this, the process of excitation begins to prevail. It becomes more stable, and then permanent. Of course, the offender has an acute desire to reduce tension, to relieve himself of the burden of the mystery of crime, to consult, what to do next, what line of behavior to choose, just speak out to at least an outsider. The identification of such conditions, the “maintenance” of these processes during interrogation, carried out in the strict framework of legal and ethical standards, helps to obtain true testimonies and speedy disclosure of crimes. In a difficult situation, the investigator needs to know all the main social roles that the interrogated played in life, and learn to direct the interrogated to take such a role position that would be most appropriate for the situation of this interrogation. Investigating the personality of the interrogated, the investigator should plan an appeal to its best sides, i.e., to the socially positive role positions of this person. For example, studying the identity of the accused, the investigator found that the young man is interested in radio technology. Being himself a passionate lover of radio technology, the investigator reached full psychological contact, talking to the interrogated on any topic.

Psychological features of the search
The search is compulsory in relation to the searched person. A search carried out in the absence of the accused allows, during subsequent interrogations, to use his ignorance of the results of the search. A search carried out in the presence of the accused makes it possible to use observation of his behavior to increase the effectiveness of this investigative action. Consider the issues of psychological observation of the behavior of the searched person. There is every reason to believe that an accused who has criminal experience, possesses such strong-willed qualities as decisiveness, restraint, courage, often behaves more confidently during the search, is able to restrain excitement, demonstrate indifference even at the most “critical” stages of the search. Forensic and forensic psychological observations show that it is more difficult to hide the excitement of women and minors. Obviously, these circumstances, including an assessment of other psychological qualities and conditions, must be taken into account when deciding on whose presence the search will be conducted. Thus, during the search it is necessary to constantly monitor the accused and his family members. For the searched, the search is a strong irritant, leading them to a state of considerable emotional tension; hide this tension is very difficult. As you know, there are involuntary and arbitrary reactions of a person to stimuli. Involuntary reactions are largely not regulated and not controlled by volitional efforts and can be expressed in blanching or reddening of the skin, trembling hands, increased sweating, a change in the timbre of the voice, and impaired coordination of movements. Observation of these signs can to some extent orient toward the search of a searcher to a place of shelter. Arbitrary psychophysiological reactions also testify to the emotional tension of those searched and are expressed in facial expressions and gestures, talking about excitement, in the absence of sequence and logic of actions and words, frequent swallowing movements, etc. During the search, it is possible to strengthen the elements of the psychological tension of the accused, so that it is easier to notice "Critical points." Such a method in forensic science and practice is called "verbal intelligence." Its essence is that the investigator (or employee, body of inquiry) asks the person being searched about the location of the room, the purpose of certain items, the belonging of certain things, etc., and at the same time monitors his condition, psychophysiological reactions. At the same time, a new additional stimulus comes into play - a verbal stimulus, which further enhances the processes of emotional excitement of the searched person and complicates the ability to control their own behavior and reaction. In the forensic literature there are recommendations for repeated and even repeated searches of the same person, if the first has not yielded positive results. The effectiveness of repeated searches is psychologically understandable. Often the accused, who did not find anything during the first search, calms down, returns temporarily hidden values obtained by criminal means to his home. The phenomenon of getting used to danger arises in those cases when objects of criminal purpose or obtained as a result of an offense are with the accused for a more or less long time. Initially, the offender seeks to securely hide them, equips special hiding places, takes care of masking signs. However, after a certain time, especially if necessary, periodically use the covered to check its integrity, the offender gradually ceases to hide, hide, loses caution. In such cases, weapons, instruments of crime, values remain outside the cache, in plain sight.

Interrogation
Interrogation at the preliminary investigation is a set of cognitive and certification operations prescribed by law that are carried out by the investigator (the person conducting the inquiry, the prosecutor, the head of the investigative department) in the criminal case under investigation, in order to obtain and consolidate evidence about circumstances relevant to the case. The essence of the interrogation consists in the fact that during the execution of the inquiry operations, the investigator urges the person who may be aware of circumstances directly or indirectly related to the investigated event to testify about them, listens to the information provided and fixes it in the manner prescribed by law so that it could be used as evidence in a criminal case. The purpose of the interrogation is to obtain information on the basis of which the investigator:

1) establishes the presence or absence of circumstances to be proved in a criminal case;
2) establish the sources from which information relating to the event under investigation can be obtained;
3) verify the accuracy of the evidence in the case.

In preparation for the interrogation, the investigator must perform the following actions:

- thoroughly study the materials of the criminal case and, based on the information received, determine or clarify the procedural situation of the person;
- determine the subject of the testimony of the person called for interrogation;
- to study the socio - demographic data, psychological, psychophysiological qualities and the condition of the person called for interrogation.

Of course, it is difficult to foresee in advance what kind of personality qualities and states of knowledge will be required during interrogation, but in any case, it is advisable to have an idea of such personality traits of the person being interrogated as gender, age, education, profession, interests, level of culture and legal awareness, views, psychological qualities (character, temperament, will, emotional traits), possible psychological states at the time of interrogation, confusion, depression, fear, self-confidence, etc.).

If several defendants (suspects) are to be interrogated in the case, then it is first necessary to study the system of relationships that have developed in the group of persons who committed the crime in order to determine the sequence of their interrogations, taking into account the nature of their relationship. To obtain complete and reliable testimonies, the main tactical methods during interrogation are methods of establishing psychological contact with the interrogated, neutralizing his negative position and exerting psychological influence on him in order to obtain complete and reliable testimonies. A study of the personality of the interrogated helps to determine the features that the process of forming testimony acquires from him, to suggest what his line of behavior during the interrogation will be, and to develop the necessary interrogation tactics using certain psychological techniques. From a tactical point of view, interrogation can be divided into the following stages: preparatory (introductory), free story of the interrogated and his answers to the investigator's questions. At the preparatory (introductory) stage, the investigator identifies the person who came to the interrogation and his personal data, explains to the interrogated his rights and obligations, decides on the participation of an interpreter. The main objective of this stage of interrogation is to create optimal conditions for obtaining testimony from the interrogated and ensuring the reliability of the testimony. For this, it is necessary to establish psychological contact with the interrogated. By psychological contact with the interrogated, they understand the creation of such an atmosphere of interrogation, in which the interrogated is imbued with respect for the investigator, understanding of his tasks and duties, excludes all personal motives in his actions, realizes the need to help establish the truth with his testimonies. Deception of the interrogated person, attempts to trap him undermine his confidence in the investigator, and contribute to the emergence of a conflicting atmosphere of interrogation. Such contact can be achieved by the use of a fairly widespread and in many cases justifying tactical device, the essence of which is the conduct by the investigator of an “intelligence” conversation with the interrogated.

Talking on abstract topics, the investigator finds out which of them are closest to the interrogated, and focuses on their discussion. Moreover, without necessity, he does not focus on the previous convictions of the interrogated person and the data characterizing him on the negative side. A calm conversation with the interrogated removes his inner tension, reduces his excitement. During such a conversation, the investigator receives additional information about the mental, speech and other psychological properties of the interrogated, which are important for determining the tactics of interrogation in its next stage. In order for the conversation to be effective, the investigator develops the ability to mentally take the position of the interlocutor and, most importantly, to show sincere interest. At the stage of a free story, the interrogated, at the suggestion of the investigator, provides information about the circumstances about which he was called for interrogation. A free presentation gives the interrogated person the opportunity to concentrate and recall certain circumstances that, in his opinion, are of importance to the investigator. If the interrogated person does not provide all the information of interest to the investigator, or if the information provided contradicts the materials of the criminal case, the interrogation proceeds to the stage of answering the questions. At this stage of the interrogation, various tactics may be used to encourage the interrogated to testify. These techniques are based on the investigator posing questions aimed at obtaining additional information from the interrogated about certain facts, circumstances (complementary questions), or to clarify the testimony and eliminate inaccuracies and contradictions in the testimony (clarifying questions). Formulating a clarifying question, the investigator compares the inconsistencies and contradictions in the testimony and invites the interrogated to explain in which part of his testimony should be considered reliable. In cases where the interrogated cannot recall any facts (circumstances), the investigator formulates questions aimed at revitalizing associative relations in order to restore the facts perceived by the interrogated (reminiscent of questions). If there is reason to believe that the interrogated person for one reason or another provided incorrect information, the investigator checks the assumption by posing questions aimed at clarifying the conditions of perception of the event or fact about which the interrogated gives evidence, as well as establishing other sources of the information provided (control questions) . At the same time, it is unacceptable to ask questions in the wording of which the expected, desirable answer (leading questions) is contained. It is unacceptable to use such tactics that: are based on deception; associated with threat and blackmail; associated with physical and mental violence, humiliation of the honor and dignity of the interrogated; connected with forcing the interrogated to give false testimony, a slander and self-incrimination; based on the use of base motives (self-interest, revenge, etc.), religious feelings, ignorance and prejudices of the interrogated.

At the time of interrogation, the suspect is either confused due to the unexpected detention and is ready to testify, or, on the contrary, is excited, aggressive and determined to deny involvement in the commission of the crime. If the suspect refuses to testify, the investigator finds out the motives for the refusal and explains to the suspect that thereby he deprives himself of the opportunity to defend himself against the suspicion that has arisen. If there is evidence the reliability of which is not in doubt, the investigator may present it in whole or in part and invite the suspect to express everything he thinks about this matter. In any case, the investigator tries to involve the suspect in a dialogue, during which he thoroughly and patiently explains to him all the adverse consequences of his position. Sometimes in such a situation it is useful to conduct a dialogue in such a way as to provoke objections from the suspect, encourage him to take an active defensive, defensive position, in connection with which he will have to give evidence. Given the evidence and the identity of the interrogated, the investigator applies the following methods:

1) notes in a calm tone that the testimony is inconsistent with the case materials and advises telling the truth;

2) explains the significance of sincere repentance and clarifies the significance of circumstances mitigating responsibility for the crime committed (Article 61 of the Criminal Code of the Russian Federation);

3) ask the interrogated person complementary and clarifying questions about the circumstances regarding which there is the greatest amount of reliable data;

4) demonstrates an object without focusing on the attention of the interrogated person (for example, as if by chance removing a newspaper or other cover from a piece of evidence lying on the table, taken from the scene);

5) asking questions, he tries to put them in such a way that the interrogated person reports information that could only become known to him if he was at the scene of the incident, if there is evidence that he was not at this place or was, but at another time. However, it is unacceptable to raise the so-called "catching questions", that is, consisting of two parts, formulated in such a way that the affirmative answer to the first part can in any case be construed as the affirmative answer to the second part;

6) explain to the suspect other means, besides his testimony, of establishing circumstances that indicate his involvement in the commission of the crime, demonstrate the relevant search devices, explain the possibility of an examination to establish circumstances relevant to the case, etc .;

7) creates an exaggerated representation of the interrogated person about the degree of awareness regarding his participation in the commission of the crime: expresses awareness in an indefinite form; uses during interrogation little-known facts from the life of the interrogated person, gives the impression that he is not aware of only some secondary circumstances, etc.

One of the tactics used to expose a suspect is the presentation of evidence. Only reliable evidence should be presented, since the use of false evidence strengthens the suspect’s determination to remain in the position of denying involvement in the commission of the crime.

Evidence may be presented in a different order. Usually they are presented as their evidentiary value grows: at first less significant, indirectly confirming the guilt of the suspect, and then more and more weighty. This method has the greatest effect when presenting evidence to a suspect who denies his involvement in a crime or gives knowingly false evidence about the extent and role of his participation in the commission of a crime. Sometimes, in order to induce an interrogated person to give truthful testimonies, the most impressive evidence is first presented, even if it plays a secondary role in the evidence system. In this case, the interrogated gives the impression that the investigator is fully aware of the circumstances of the crime. A tactical device is also close to this, the essence of which is that the investigator, using his awareness of some secondary circumstance, raises the question about him as if this is the only thing that interests him. The interrogated gives the impression that the rest is already known to the investigator. The same impression is made upon the interrogated when the investigator, after hearing evidence that contradicts the case file, describes the mechanism of the incident, using incomplete data for this and creating the impression that they are unknown to him. The sudden presentation of this kind of evidence often leads the suspect into confusion and, having no time to ponder the answer that would sound plausible, begins to give inconclusive and contradictory evidence. If the investigator knows the materials of the criminal case well, carefully listens to the testimony of the suspect and monitors his reaction at the time of presentation of the evidence, then using the confusion of the suspect and the contradictions in his testimony, he can convince him of the futility of his chosen line of behavior. If there is insufficient evidence to expose the suspect, the investigator tries to get them from the interrogated, using for this purpose contradictions in his testimony and the information that the suspect reported through negligence.

Психические состояния подозреваемого и обвиняемого, особенности их поведения на предварительном следствии
Стремясь уклониться от ответственности и скрыть свое участие в преступлении, виновный старается утаить от окружающих и связанные с этим переживания. Он оберегает свои воспоминания от внешнего проявления и тем самым постоянно оживляет их, а, подавляя переживания, еще более их обостряет. В конце концов, тенденция скрыть свои чувства и мысли вносит сильнейшую дезорганизацию в его психические процессы. В частности, у подозреваемого происходит частая смена состояний, сопровождаемая то появлением уверенности в себе, стремлением к активному противодействию, недооценкой возможностей следствия, самоуверенностью, то, напротив, возникновением подавленного, депрессивного состояния, растерянности, безволия. В отличие от подозреваемого обвиняемый чаще всего имеет больше сведений о положении дел, о содержании имеющихся доказательств у следствия. Однако на предварительном следствии, у подозреваемого и обвиняемого наблюдаются многие сходные психологические состояния, мотивы, побуждения, а отсюда и особенности поведения. Психические состояния, мотивы действий, личностные качества допрашиваемых определяют их поведение на предварительном следствии и тем самым обуславливают психологический подход к ним, избрание наиболее эффективных, тактических и психологических приемов. На допросе обвиняемый может испытывать самые разнообразные чувства. Совершивший преступление боится изобличения и, конечно же, наказания. Это обычно действует на психику угнетающе, может в значительной степени подавить волю допрашиваемого, снизить возможности правильной оценки сложившихся обстоятельств, ухудшить самоконтроль, привести обвиняемого в угнетенное, депрессивное состояние. Страх обычно возникает у лица, совершившего преступление, задолго до привлечения его к уголовной ответственности. Такие психологические состояния затрудняют установление с допрашиваемым психологического контакта, снижают эффективность тактических приемов допроса. На допросе обвиняемый может быть в состоянии душевного потрясения, стыда, опасаясь, что о случившемся узнают родные и близкие, друзья, сослуживцы, соседи. Моральные оценки и суждения окружающих небезразличны даже для людей с устоявшимися антиобщественными взглядами. Нежелание огласки является весьма сильным мотивом, во многом определяющим поведение обвиняемого.

Для отдельных обвиняемых типична боязнь утраты достигнутого им социального, служебного и материального положения. Поэтому на допросе такой обвиняемый чаще всего уклоняется от дачи правдивых показаний. Здесь следователь, чтобы преодолеть указанное психологическое состояние обвиняемого, должен убедить его в возможности честным и добросовестным трудом восстановить социальное положение, стать полноправным членом общества.

Сильным психологическим состоянием, формирующим мотивы поведения обвиняемого, является страх лишения свободы, привычного образа жизни, оказаться среди преступников. Такое чувство, особенно присущее лицам, впервые совершившим преступление и привлеченным к уголовной ответственности, обычно приводит их в состояние глубокой депрессии. В такой ситуации обвиняемый полагает, что избежать задержания, ареста, содержания под стражей, приговора, связанного с лишением свободы, можно, только отрицая свою вину, давая ложные показания, у него возникает соответствующее психологическое состояние, формируется позиция, которую следователю необходимо преодолеть. Для этого требуется убедить обвиняемого, что доказывание вины мало зависит от его признания, а в решающей мере — от всей совокупности доказательств. Здесь требуется разъяснить обвиняемому, что чистосердечное раскаяние, а также активное способствование раскрытию преступления является для суда обстоятельством, смягчающим ответственность. Практика показывает, что в преступлениях, совершаемых группой, обвиняемый по — разному относится к соучастникам. Если кому‑то он многим обязан, то старается скрыть причастность к преступлению этого человека, надеясь на его помощь и поддержку. Гораздо чаще система психологических отношений в преступной группе построена на подчинении силе, страхе, иных низменных побуждениях и инстинктах. Поэтому в процессе расследования, когда участники преступной группы изолированы друг от друга, построенные на такой основе отношения распадаются. У обвиняемого крепнет неприязнь к лицам, втянувшим его в преступную группу, по чьей вине он оказался привлеченным к уголовной ответственности. Следователь использует подобное психологическое состояние обвиняемого, раскрывает перед ним систему отношений, существовавших в преступной группе, показывает, на чем построено ложное чувство товарищества среди преступников, использует эти знания для выбора наиболее эффективных тактических приемов допроса. Для обвиняемого на предварительном следствии очень характерно психологическое состояние тревоги, неопределенности, невозможности правильного предвидения сложившейся ситуации и управления ею. Часто подозреваемому неизвестно, какими доказательствами располагает следователь, какая мера пресечения может быть избрана, какие следственные действия, в том числе и носящие принудительный характер, будут проведены и т. д. Такое психологическое состояние является основой для разработки и применения тактических и психологических приемов. Поведение человека в значительной степени определяется воздействием на него доминанты — господствующего в данный момент очага возбуждения в коре больших полушарий головного мозга, который обладает повышенной чувствительностью к раздражению и способен оказывать тормозящее влияние на работу других нервных центров. Зачастую доминанта воздействует и на преступника. Испытывая чувства тревоги, сожаления, страха, раскаяния и т. д., правонарушитель мысленно многократно возвращается к событию преступления, обдумывает возможные неблагоприятные последствия. Этот процесс приводит к еще большему усилению переживаний, к постоянному подкреплению очага возбуждения — доминанты. Замечено, что чем тяжелее преступление, тем ярче изменения в поведении преступника.

Однако этим значение доминанты не исчерпывается. Давно замечено, что человек, совершивший тяжкое преступление, испытывает сильное психологическое напряжение. Стремление скрыть причастность к преступлению, необходимость маскироваться, чтобы выглядеть спокойным, приводят к усилению торможения в клетках коры головного мозга. После этого начинает преобладать процесс возбуждения. Оно становится все более устойчивым, а потом и постоянным. Безусловно, преступник испытывает острое желание снизить напряженность, снять с себя бремя тайны преступления, посоветоваться, как быть дальше, какую линию поведения избрать, просто выговориться хотя бы и постороннему человеку. Выявление таких состояний, «поддержание» указанных процессов на допросе, проведенном в строгих рамках правовых и этических норм, способствуют получению правдивых показаний, скорейшему раскрытию преступлений. В сложной ситуации следователю нужно знать все основные социальные роли, которые исполнял допрашиваемый в жизни, и научиться направлять допрашиваемого к занятию такой ролевой позиции, которая бы наиболее соответствовала ситуации данного допроса. Исследуя личность допрашиваемого, следователь должен планировать обращение к ее лучшим сторонам, т. е. к социально положительным ролевым позициям данной личности. Например, изучая личность обвиняемого, следователь установил, что юноша увлекается радиотехникой. Будучи сам страстным любителем радиотехники, следователь достиг полного психологического контакта, заговорив с допрашиваемым на любую тему.

Психологические особенности проведения обыска
Обыск носит по отношению к обыскиваемому принудительный характер. Обыск, проводимый в отсутствие обвиняемого, позволяет при последующих допросах, использовать незнание им результатов обыска. Обыск, осуществляемый в присутствии обвиняемого, дает возможность использовать наблюдение за его поведением для повышения эффективности этого следственного действия. Рассмотрим вопросы психологического наблюдения за поведением обыскиваемого. Есть все основания полагать, что обвиняемый, имеющий преступный опыт, обладающий такими волевыми качествами, как решительность, выдержка, смелость, часто более уверено ведет себя во время обыска, способен сдерживать волнение, демонстрировать безразличие даже на самых «критических» этапах обыска. Криминалистические и судебно — психологические наблюдения показывают, что труднее скрывать волнение женщинам и несовершеннолетним. Очевидно, эти обстоятельства, включая оценку других психологических качеств и состояний, нужно учитывать, решая вопрос о том, в чьем присутствии будет проводиться обыск. Таким образом, в процессе обыска необходимо постоянно наблюдать за обвиняемым и членами его семьи. Для обыскиваемых обыск является сильнейшим раздражителем, приводящим их в состояние значительной эмоциональной напряженности; скрыть эту напряженность очень трудно. Как известно, существуют непроизвольные и произвольные реакции человека на раздражители. Непроизвольные реакции в значительной степени не регулируются и не управляются волевыми усилиями и могут выражаться в побледнении или покраснении кожных покровов, дрожании рук, усиленной потливости, изменении тембра голоса, нарушении координации движений. Наблюдение указанных признаков может в известной степени ориентировать на приближение обыскивающего к месту укрытия. Произвольные психофизиологические реакции также свидетельствуют об эмоциональной напряженности обыскиваемых и выражаются в мимике и жестикуляции, говорящих о волнении, в отсутствии последовательности и логики действий и слов, частых глотательных движениях т. д. В процессе обыска есть возможность усиливать элементы психологической напряженности обвиняемого, чтобы легче заметить «критические точки». Такой метод в криминалистической науке и практике получил название «словесная разведка». Суть его в том, что следователь (или работник, органа дознания) спрашивает обыскиваемого о расположении помещении, назначении тех или иных предметов, принадлежности определенных вещей и т. д. и при этом наблюдает за его состоянием, психофизиологическими реакциями. При этом в действие вступает новый дополнительный раздражитель — словесный, который еще более усиливает процессы эмоционального возбуждения обыскиваемого усложняет возможности контроля за собственным поведением и реакцией. В криминалистической литературе имеются рекомендации относительно проведения повторного и даже неоднократного обыска у одного и того же лица, если первый не дал положительных результатов. Эффективность повторных обысков психологически вполне объяснима. Нередко обвиняемый, у которого в ходе первого обыска ничего не обнаружили, успокаивается, возвращает временно перепрятанные ценности, добытые преступным путем к себе домой. Феномен привыкания к опасности возникает в тех случаях, когда предметы преступного назначения или же добытые в результате правонарушения находятся у обвиняемого более или менее длительное время. Вначале преступник стремится надежно спрятать их, оборудует специальные тайники, заботится о маскирующих признаках. Однако по истечении определенного времени, особенно при необходимости периодически использовать укрытое, для проверки его неприкосновенности, преступник постепенно перестает укрывать, прятать, утрачивает осторожность. В таких случаях оружие, орудия преступления, ценности остаются вне тайников, на виду.

Допрос
Допрос на предварительном следствии — это комплекс предусмотренных законом познавательных и удостоверительных операций, выполняемых следователем (лицом, производящим дознание, прокурором, начальником следственного отдела) по находящемуся в его производстве уголовному делу, с целью получения и закрепления показаний об обстоятельствах, имеющих значение для дела. Сущность допроса состоит в том, что в ходе выполнения дознавательных операций следователь побуждает лицо, которому могут быть известны обстоятельства, прямо или косвенно связанные с расследуемым событием, дать о них показания, выслушивает сообщаемую информацию и фиксирует ее в установленном законом порядке для того, чтобы она могла быть использована в качестве доказательства по уголовному делу. Целью допроса является получение информации, на основании которой следователь:

1) устанавливает наличие или отсутствие обстоятельств, подлежащих доказыванию по уголовному делу;
2) устанавливает источники, из которых могут быть получены сведения, относящиеся к расследуемому событию;
3) проверяет достоверность имеющихся в деле доказательств.

В ходе подготовки к допросу следователь обязан выполнить следующие действия:

— тщательно изучить материалы уголовного дела и на основе полученной информации определить или уточнить процессуальное положение лица;
— определить предмет показаний лица, вызываемого на допрос;
— изучить социально — демографические данные, психологические, психофизиологические качества и состояние вызываемого на допрос лица.

Разумеется, заранее трудно предусмотреть, знание каких именно качеств и состояний личности потребуется при допросе, однако в любом случае, желательно иметь представление о таких особенностях личности допрашиваемого, как пол, возраст, образование, профессия, интересы, уровень культуры и правосознания, взгляды, психологические качества (характер, темперамент, воля, эмоциональные черты), возможные психологические состояния в момент допроса растерянность, подавленность, страх, самоуверенность и т. д.).

Если по делу предстоит допросить несколько обвиняемых (подозреваемых), то предварительно необходимо изучить систему взаимоотношений, сложившихся в группе лиц, совершивших преступление, с тем, чтобы определить последовательность их допросов с учетом характера их взаимоотношений. Для получения полных и достоверных показаний основными тактическими приемами при производстве допросов являются методы установления психологического контакта с допрашиваемым, нейтрализации его негативной позиции и оказания на него психического воздействия с целью получения полных и достоверных показаний. Изучение личности допрашиваемого помогает определить особенности, которые приобретает у него процесс формирования показаний, предположить, какова будет его линия поведения на допросе и выработать нужную тактику допроса с использованием тех или иных психологических приемов. С тактической точки зрения допрос может быть разделен на следующие стадии: подготовительную (вступительную), свободный рассказ допрашиваемого и его ответы на вопросы следователя. На подготовительной (вступительной) стадии следователь устанавливает личность явившегося на допрос и его анкетные данные, разъясняет допрашиваемому его права и обязанности, решает вопрос об участии переводчика. Основной задачей этой стадии допроса является создание оптимальных условий для получения показаний от допрашиваемого и обеспечение достоверности показаний. Для этого необходимо установить психологический контакт с допрашиваемым. Под психологическим контактом с допрашиваемым понимают создание такой атмосферы допроса, при которой допрашиваемый проникается уважением к следователю, пониманием его задач и обязанностей, исключает всякие личные мотивы в его действиях, осознает необходимость способствовать своими показаниями установлению истины. Обман допрашиваемого, попытки поймать его в ловушку подрывают его доверие к следователю, способствуют возникновению конфликтной атмосферы допроса. Такой контакт может быть достигнут применением достаточно распространенного и во многих случаях оправдывающего себя тактического приема, суть которого заключается в проведении следователем «разведывательной» беседы с допрашиваемым.

Беседуя на отвлеченные темы, следователь выясняет, какие из них наиболее близки допрашиваемому, и сосредотачивается на их обсуждении. При этом без необходимости он не акцентирует внимание на прежних судимостях допрашиваемого и данных, характеризующих его с отрицательной стороны. Спокойная беседа с допрашиваемым снимает его внутреннее напряжение, уменьшает его волнение. В ходе такой беседы следователь получает дополнительную информацию о мыслительных, речевых и других психологических свойствах допрашиваемого, которые имеют значение для определения тактики производства допроса в следующей его стадии. Для того чтобы беседа была результативной, следователь вырабатывает в себе умение мысленно становиться на позиции собеседника и, самое главное, проявлять искреннюю заинтересованность. На стадии свободного рассказа допрашиваемый, по предложению следователя, сообщает сведения об обстоятельствах, по поводу которых он вызван на допрос. Свободное изложение дает допрашиваемому возможность сосредоточиться, вспомнить отдельные обстоятельства, имеющие, по его мнению, значение для следователя. Если допрашиваемый сообщает не все сведения, представляющие интерес для следователя, либо сообщаемые сведения противоречат материалам уголовного дела, допрос переходит в стадию ответов на вопросы. На этой стадии допроса могут применяться различные тактические приемы, побуждающие допрашиваемого к даче показаний. Эти приемы основаны на постановке следователем вопросов, направленных на получение от допрашиваемого дополнительных сведений о тех или иных фактах, обстоятельствах (дополняющие вопросы) либо на уточнение показаний и устранение неточностей и противоречий в показаниях (уточняющие вопросы). Формулируя уточняющий вопрос, следователь сопоставляет имеющиеся в показаниях несоответствия, противоречия и предлагает допрашиваемому объяснить, в какой части его показания следует считать достоверными. В тех случаях, когда допрашиваемый не может вспомнить какие‑либо факты (обстоятельства), следователь формулирует вопросы, направленные на оживление ассоциативных связей, с целью восстановления в памяти воспринятых допрашиваемым фактов (напоминающие вопросы). Если есть основания полагать, что допрашиваемый по тем или иным причинам сообщил неправильные сведения, следователь проверяет возникшее предположение путем постановки вопросов, направленных на выяснение условий восприятия события или факта, о которых допрашиваемый дает показания, а также установление иных источников сообщаемых сведений (контрольные вопросы). При этом недопустимо задавать вопросы, в формулировке которых содержится ожидаемый, желательный ответ (наводящие вопросы). Недопустимо применение таких тактических приемов, которые: основаны на обмане; связаны с угрозой и шантажом; сопряжены с физическим и психическим насилием, унижением чести и достоинства допрашиваемого; связаны с понуждением допрашиваемого к даче ложных показаний, оговору и самооговору; основаны на использовании низменных побуждений (корысти, мести и др.), религиозных чувств, невежества и предрассудков допрашиваемых.

В момент допроса подозреваемый либо растерян в связи с неожиданным задержанием и готов дать показания, либо, наоборот, возбужден, агрессивен и настроен отрицать причастность к совершению преступления. Если подозреваемый отказывается давать показания, следователь выясняет мотивы отказа и разъясняет подозреваемому, что тем самым он лишает себя возможности защищаться от возникшего подозрения. При наличии доказательств, достоверность которых не вызывает сомнения, следователь может предъявить их полностью или частично и предложить подозреваемому высказать все, что он думает по данному поводу. В любом случае, следователь старается вовлечь подозреваемого в диалог, в ходе которого подробно и терпеливо разъясняет ему все неблагоприятные последствия занятой позиции. Иногда в такой ситуации полезно вести диалог так, чтобы вызвать у подозреваемого возражения, побудить его занять активную оборонительную, защитную позицию, в связи с чем ему придется дать показания. С учетом имеющихся доказательств и личности допрашиваемого следователь применяет следующие приемы:

1) спокойным тоном отмечает несоответствие показаний материалам дела и советует рассказать правду;

2) объясняет значение чистосердечного раскаяния и разъясняет значение обстоятельств, смягчающих ответственность за совершённое преступление (ст. 61 УК РФ);

3) задает допрашиваемому дополняющие и уточняющие вопросы об обстоятельствах, относительно которых имеется наибольшее количество достоверных данных;

4) демонстрирует какой‑либо объект, не акцентируя на нем внимания допрашиваемого (например, как бы невзначай снимает газету или иное покрытие с лежащего на столе вещественного доказательства, изъятого с места происшествия);

5) задавая вопросы, пытается поставить их таким образом, чтобы допрашиваемый сообщил сведения, которые могли стать известными ему только в том случае, если он находился на месте происшествия, при наличии данных о том, что он не был на этом месте или был, но в другое время. Однако при этом недопустимо ставить так называемые «улавливающие вопросы», т. е. состоящие из двух частей, сформулированных таким образом, что утвердительный ответ на первую часть в любом случае может быть истолкован как утвердительный ответ и на вторую часть;

6) разъясняет подозреваемому иные, помимо его показаний, средства установления обстоятельств, свидетельствующих о его причастности к совершению преступления, демонстрирует соответствующие поисковые приборы, разъясняет возможность экспертизы по установлению обстоятельств, имеющих отношение к делу и т. п.;

7) создает у допрашиваемого преувеличенное представление о степени осведомленности относительно его участия в совершении преступления: выражает осведомленность в неопределенной форме; использует в ходе допроса малоизвестные факты из жизни допрашиваемого, создает впечатление о том, что ему неизвестны лишь некоторые второстепенные обстоятельства и т. п.

Одним из тактических приемов, применяемых для изобличения подозреваемого, является предъявление доказательств. Предъявлять следует только достоверные доказательства, так как использование недостоверных доказательств укрепляет в подозреваемом решимость оставаться на позиции отрицания причастности к совершению преступления.

Доказательства могут предъявляться в различной последовательности. Обычно они предъявляются по мере возрастания их доказательственного значения: вначале менее значительные, косвенно подтверждающие вину подозреваемого, а затем все более и более веские. Наибольший эффект этот способ дает при предъявлении доказательств подозреваемому, отрицающему свою причастность к совершенному преступлению или дающему заведомо ложные показания о степени и роли своего участия в совершении преступления. Иногда для склонения допрашиваемого к даче правдивых показаний в первую очередь предъявляется наиболее впечатляющее доказательство, даже если в системе доказательств оно играет второстепенную роль. В этом случае у допрашиваемого создается впечатление о полной осведомленности следователя об обстоятельствах совершенного преступления. К этому близок также тактический прием, суть которого состоит в том, что следователь, используя свою осведомленность о каком‑то второстепенном обстоятельстве, ставит вопрос о нем так, как будто это — единственное, что его интересует. У допрашиваемого создается впечатление, что остальное следователю уже известно. Такое же впечатление у допрашиваемого создается, когда следователь, выслушав показания, противоречащие материалам дела, описывает механизм происшедшего события, используя для этого неполные данные и создавая впечатление о несущественности тех, которые ему еще неизвестны. Внезапное предъявление такого рода доказательств нередко приводит подозреваемого в замешательство и он, не имея времени для обдумывания ответа, который бы звучал правдоподобно, начинает давать неубедительные и противоречивые показания. Если следователь хорошо знает материалы уголовного дела, внимательно слушает показания подозреваемого и наблюдает за его реакцией в момент предъявления доказательства, то, используя замешательство подозреваемого и противоречия в его показаниях, может убедить его в бесперспективности избранной им линии поведения. При недостаточности доказательств для изобличения подозреваемого следователь пытается получить их от допрашиваемого, используя для этого противоречия в его показаниях и те сведения, которые подозреваемый сообщил по неосмотрительности.
