Speaking about the use of the polygraph in the criminal process, it is natural to ask about the fundamental possibility, the admissibility of its use as a means / method of obtaining information relevant to the criminal case and, further, what is the role of the information received in the context of criminal proceedings.

Both supporters and opponents of the use of the polygraph rightly point out: if twenty years ago the proposals for the use of the polygraph met with hostility, now there is a reverse (in a sense) trend - polygraph examinations (often called examinations) are accepted with a bang, and polygraph examiners themselves often often go beyond their competence.

To a cautious, balanced attitude to the use of the polygraph is called not only by process scientists, but also by criminologists and forensic experts. So, prof. V.Yu. Shepitko justifiably points out that “the possibility of using special devices (lightdetectors, variographs, polygraphs, etc.) ... shows the dynamics of changes in blood pressure, heart rate, respiratory rate ... etc. Such indicators can help the investigator to orient himself when making assumptions about falsity or truthfulness of the information provided, however, the “diagnosis” under consideration does not exclude errors, as the occurrence of appropriate psychophysiological reactions in the interrogated person may be caused by the unusual situation of the interrogation, improper posing of questions by the investigator, neglect of the witness or accused, demonstration of the accusatory bias, etc. d. First of all, we note that contrary to the opinion disseminated and promoted by polygraph supporters, the use of a polygraph, alas, cannot be considered a strictly scientific and standardized procedure. The scientific validity of the results is justifiably questioned, and criticisms relate, in particular, to the fact that this is more an art, not a science, because too much depends on the qualifications, experience and intuition of a specialist polygraph examiner.

The list of questions for testing on a polygraph is not unified and is in no way fixed. To conduct the test, the polygraph examiner each time must re-select and formulate the questions in such a way as to cause the desired reaction for a particular subject.

This in itself is debatable, because a neutral test should not be aimed at obtaining the desired reaction. Further, it is necessary to interpret the whole variety of physiological manifestations, which in different subjects can be very diverse. Again, there is no single methodology, so the interpretation is clearly subjective - errors due to the human factor are inevitable.

Asking the question, is there currently a unified scientific and methodological approach to the practice of conducting psychophysiological studies and examinations using the polygraph, the professional training and specialization of polygraph examiners, the "father" of domestic polygraphology prof. Yu.I. Kholodny comes to the unambiguously negative answer <3>, without stinting on the negative characteristics of the specific expert methodology for the production of psychophysiological studies using a polygraph developed by a competing group of researchers from another department <4>.

The reliability of the results provided by numerous polygraph examiners <5> is a separate, sensitive issue. According to the All-Russian Research Institute of the Ministry of Internal Affairs of Russia <6>, the accuracy of modern polygraphs is up to 96%, which the proponents of their use consider quite comparable with the accuracy of the results of traditional types of forensic, as well as many other forensic examinations. Moreover, according to the same Yu.I. Kholodny, while experimentally checking the reliability of the results of the polygraph application, it was found that "the technology of polygraph checks has a degree of accuracy comparable and even superior to most of the types of evidence currently being presented, which appear in criminal and civil courts" <7>.

There is a clear and gross substitution of the thesis - the polygraph records the physiological changes that take place in the subject's body, and in this sense he is a completely reliable measuring device. The reliability of the registration itself is not in doubt (provided, of course, that the device is used correctly, regularly passes routine checks, etc.). But the reliability of the test results cannot be evaluated at all, because the physiological reactions recorded by the polygraph can be interpreted by the operator in different ways. In a famous example cited by Paul Ekman <8>, a suspect who discovered the naked corpse of his neighbor’s wife, during interrogation, denies his guilt and involvement, but the polygraph test allegedly exposes him. Subsequently, it turns out that he had previously had sexual fantasies on the basis of attraction to a neighbor, and when he saw her naked body, he felt an attraction, which he was very ashamed of. A sense of shame did not allow him to pass a polygraph test, but the conclusion of the polygraph examiner about the suspect's involvement in the murder was wrong.

Compare this example with another well-known example, already from domestic practice, cited by prof. V.M. Komissarov and Ya.V. Komissarova <9>. Trying to expose H. suspected of the murder, the investigator tested him on a polygraph and, at the same time, presented him with identification photos, among others, of the heater, the cable from which was used to strangle the victim, and the bed where it happened. As a result, significant psychophysiological reactions to these stimuli were obtained, which made it possible to draw the conclusion desired for the investigation. Comparison with the previous example shows that this conclusion could greatly depend on the interpretation of the observed reactions and be very far from reliable.

The desire to impart scientifically visible findings leads to
their presentation in numerical form, indicating the probability (degree
polygraph examiner's confidence in his answer). Very characteristic in this sense
example, wandering in different works of Yu.I. Cold: "... as a result
research ... a polygraph examiner can trace the memory of a particular person
to obtain a conclusion with a high degree of probability. In particular, when
the presence of three particular signs of the investigated event and when
expert appropriate reactions to these signs polygraph examiner
comes to the conclusion that the person under investigation is involved in the established
an event with a probability of P = 0.992 (i.e., the probability of an error of P = 0.008, or

Earnestly? For a person far from mathematics, it’s possible. But
where did these numbers come from? The author kept silent about this, but in an earlier work
<11> you can find an a priori assumption that each of these signs
gives a probability of error of 0.2. By the formula for multiplying probabilities then three

signs will give just 0.2 = 0.008, and four will give 0.2 = 0.0016; but
the multiplication formula is valid only for independent events! Can these
signs to consider independent? More than a dubious assumption -
rather, they in the real questionnaire, in contrast, are closely related. Meanwhile
the requirement for independence of attributes is not even mentioned in the cited
work, not in the already mentioned earlier.

After this pseudo-mathematical balancing act, the polygraph examiner should formulate a conclusion like "there is information in the memory of the expert that ... So, the allegations found in the literature that a polygraph is a technical tool acceptable for use in a criminal process, based on the laws recognized by science, processes and phenomena that guarantee a reliable result <13>, have to be recognized as an exaggeration and an attempt to pass off as wishful thinking.

Nevertheless, proponents of the use of the polygraph seek to present polygraph testing as a kind of forensic examination. So, one of the developers [DLMURL="https://login.consultant.ru/link/?req=doc;base=PRJ;n=82508;fld=134"] of the bill [/ DLMURL] "On the application of the polygraph" E .TO. The opportunity to call a polygraph examination as an expertise was supported by N.A. Selivanov: "Since the polygraph test requires the use of special knowledge and relevant research, there is every reason to say that in this case there are all the signs of a procedural action called expertise" <15>. This point of view also has other supporters of <16>.

However, the basic requirements for forensic examinations contained in [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=122884;fld=134;dst=100030"] art . 8 [/ DLMURL] of the Federal Law "On State Forensic Science Activities in the Russian Federation", provide for the scientific validity of the applied methods, the use of objective monitoring means, i.e. using only the methods described in the scientific literature, tested by real research practice and guaranteeing reliable results (or at least allowing to establish how reliable these or those results are).

As rightly notes N.N. Apostolova, "the process itself and the results of the examination should be scientifically sound, reasoned, and reliably established. The expert’s opinion should be evaluated on the basis of the following criteria: 1) the completeness and good quality of the materials that were available to the experts; 2) the expert’s conclusion has convincing arguments confirming its conclusion; 3) a sufficient level of development of this branch of scientific knowledge; 4) a sufficient scientific qualification of the experts themselves ... in the opinion of the expert polygraph examiner there can be no sound, reasoned or convincing arguments confirming the conclusion that the testimony of a person interviewed using A polygraph. All that an expert can ascertain is that when answering a particular question the respondent reacted in a certain way "<17>.

Yu.K. Orlov believes that the subject of the judicial examination is “facts, circumstances (factual data) established by means of examination” <18>. A polygraph study dealing with traces recorded in a person’s memory does not establish material facts, but only fixes, to one degree or another, the subjective attitude of a person to these facts, which is not the same at all, and, as polygraph examiners themselves point out, "it is important to take into account the influence of individual characteristics of the process of memorization (as a trace formation in memory), storage and reproduction of information, as well as the characteristics of physiological and mental processes that accompany this diagnostic study" <19>. At the same time, the mechanism of formation and subsequent change in ideal traces has been studied very little.

According to Yu.I. Kholodny, “the task of an expert polygraph examiner is to establish what information is contained in a person’s memory. And only this should he state in his conclusion: no further step” <22>. At the same time, A.B. Pelenitsyn, A.P. Soshnikov and O.V. Zhbankova correctly indicate that the processes of memory themselves are not directly connected with the mechanisms of functioning of the autonomic nervous system, the external manifestations of the activity of which are recorded by the polygraph, "which does not allow the information stored in the human memory to have a stable and unambiguous reflection in the external physiological manifestations, on the basis of which one could make reliable conclusions both about the fact of the availability of this information and about its content "<23>. In the light of this assertion that the polygraph examiner allegedly notes the presence or absence in the memory of traces of certain circumstances of the event, the mechanism of formation of traces in memory that has been studied very little has been studied to purely physiological processes <24>.

So, a polygraph examination cannot be considered a forensic examination. We agree with L.M. Isaeva: "... there is no doubt the prematureness of giving the status of an expert study to a polygraphic survey, if only because of the lack of methods to assess the reliability of the conclusions" <25>. The reliability of the results is very relative - this does not allow to recognize them as full-fledged procedural evidence.

The very use of the term "examination" (especially "forensic examination") in relation to polygraph examination is very doubtful.

Sometimes such questions are submitted for the resolution of such an “examination”, which it cannot resolve in principle. So, the Shatrovsky District Court of the Kurgan Region, considering the case of Kaygarodov, accused of committing an act under [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142949;fld=134 ; dst = 103371 "] hours 3 tbsp. 264 [/ DLMURL] of the Criminal Code of the Russian Federation, but refused to plead guilty and refused to testify in court (based on [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n= 2875; fld = 134; dst = 100196 "] Art. 51 [/ DLMURL] of the Constitution of the Russian Federation), ruled that the conclusion of a psychophysiological examination conducted against witness Serebrov established that at the time of the accident the accused’s car was on overtaking a KamAZ car at a speed of more than 100 km / h, which was the cause of the road accident, which resulted in the death of four victims <26>. At the same time, it is obvious that no polygraph test can confirm that the speed of the car was over 100 km / h <27> - in the best case, it can only be confirmed that witness Serebrov himself is sure of this; but this is nothing more than his guesses. In fact, such a study could have some sense unless in clarifying the question whether the witness himself is lying and whether he should be brought to justice under [DLMURL="https://login.consultant.ru/link/?req=doc ; base = ROS; n = 142949; fld = 134; dst = 103103 "] Art. 307 [/ DLMURL] of the Criminal Code; to solve the question of speed, this whole study does not give anything new, apart from the testimony of the witness itself. It is worth recalling that the testimony based on assumptions and guesses [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=100683"] Art. 75 [/ DLMURL] Code of Criminal Procedure of the Russian Federation estimates very low.

And what about acceptability? Already a cursory glance allows us to conclude that in this respect the results of a study using a polygraph can by no means be considered flawless.

We note immediately that the forensic investigation provides for an expert’s warning of criminal liability for giving a knowingly false expert opinion on [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142949;fld = 134; dst = 103,103 "] Art. 307 [/ DLMURL] of the Criminal Code. Is this possible in the context of psychophysiological polygraph examination! Not at all, this can only be possible if the readings of the device are known to be incorrectly recorded, because an “interpretation error” cannot be recognized as known without a unified methodology, and the questionnaire cannot be deliberately incorrect, since there are no unified requirements for it. This creates such experts favorable conditions for mass abuse.

We also note that [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=101463"] Art. 195 [/ DLMURL] The Code of Criminal Procedure of the Russian Federation, when regulating the conduct of an examination, does not at all require the consent of the suspect / accused to undergo such. [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=1141"] Part 4 of this article [/ DLMURL] only says consent of the victim (or witness), but there is a reservation that in case of doubt about his ability to adequately perceive what is happening and give evidence, consent is still not required ([DLMURL="https://login.consultant.ru/link/?req = doc; base = ROS; n = 142954; fld = 134; dst = 101477 "] clause 4 of article 196 [/ DLMURL] CPC). Thus, since polygraph testing is a kind of forensic examination, this leads to the unambiguous conclusion that such testing of the accused or suspect can be carried out and forced, against his will. By the way, this is also possible in relation to the victim - he can always be told that testing is carried out precisely in connection with a doubt in his veracity caused by the assumption of his inadequate perception of what was happening. But the frankly absurd idea of compulsory polygraph testing is in flagrant violation of the principles of criminal procedure legislation, especially [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=2875;fld=134; dst = 100,196 "] Art. 51 [/ DLMURL] of the Constitution of the Russian Federation.

It is curious that adherents of polygraphology do not consider this a drawback at all, on the contrary, the already mentioned O.V. Belyushina frankly admits the advantage of such a situation: "The features of the judicial examination of living persons are not regulated by the current criminal procedure legislation. Moreover, [DLMURL =" https://login.consultant.ru/link/?req=doc;base= ROS; n = 142954; fld = 134; dst = 100426 "] v. 47 [/ DLMURL] and [DLMURL =" https://login.consultant.ru/link/?req=doc;base=ROS;n= 142954; fld = 134; dst = 101463 "] Article 195 [/ DLMURL] of the Code of Criminal Procedure of the Russian Federation does not contain provisions giving the accused the right to refuse to participate in a forensic examination conducted against him" <28>. Thus, the rights of the accused can be ignored, and the voluntary nature of the examination is replaced by a forced one. Another noteworthy passage by the same author is noteworthy: "According to the general norm [DLMURL =" https://login.consultant.ru/link/?req=doc;base=ROS;n=122884;fld=134;dst= 100168 "] Article 28 [/ DLMURL] of the Federal Law on State Forensic Expertise Psychophysiological examination in a state forensic institution without the consent of the test subject is unacceptable. It should be agreed with T.Yu. Nichiporenko, who believes that "every case of the use of a polygraph in evidence in a criminal case is an attempt to attach probative value to the fact that evidence cannot be." She sees the reason for this in that the assessment of the reliability of this or that information is the exclusive competence of the judge, jury, prosecutor, investigator and inquiry officer, and not a polygraph examiner, whose conclusion must be regarded as an invasion of the exclusive competence of the preliminary investigation bodies and the court <30>. By the way, Yu.K. Orlov and Yu.I. Kholodny: "... an expert polygraph examiner goes beyond his competence and intrudes into the sphere of authority of the investigator and the court. And here the critics are absolutely right" <31>.

According to prof. L.A. Voskobitova, a polygraph examiner records the person’s reaction to the questions posed, however, from the point of view of a legal assessment, the truthfulness or falsehood of a person’s testimony does not matter, since it does not contain factual information about what actually happened in the past. In the existing judicial practice, as a rule, factual information is not revealed from the conclusions of the polygraph examiner. A polygraph only produces certain curves, but it is a person who gives them actual and meaningful meanings. When a judge ceases to understand the difference between factual information and formal documents of a criminal case, he ceases to be judge <32>.

The question of the admissibility of the results of a polygraph examination as procedural evidence is inextricably linked with the right of a person not to testify against himself, proclaimed [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=2875 ; fld = 134; dst = 100196 "] Art. 51 [/ DLMURL] of the Constitution of the Russian Federation. Strictly speaking, even the authentically established falsity of the accused’s testimonies, confirmed by a polygraph examination, does not entail any legal consequences, since the accused is not obliged to testify against himself, he does not bear the burden of proving his innocence, and the procedural requirements of a warning about responsibility for giving knowingly false testimonies to him do not apply.

The consent of the suspect, the accused to go through the polygraphological procedure of the case does not change, because, giving such consent, he cannot foresee his reaction to the questions asked and consciously control it. If during the interrogation, having heard the question of the investigator and seeing that he is being forced to testify against himself, the interrogated has the right to simply refuse to answer (and even refuse to testify at all), then the situation is fundamentally different. The question was raised, the response to it was already recorded by the device and can be interpreted by the operator, regardless of whether the subject answered or refused to answer. Moreover, even the period of time during which the subject thinks whether to answer him or to refuse, can be subjected to a certain interpretation. Thus, a person subjected to polygraph testing can actually be forced to testify against himself against his will.

A common objection of adherents of polygraphology is that a blood sample taken from the accused, subjected to DNA analysis, can also ultimately “testify” against his master, and against his will. However, firstly, the law does not provide for the consent of the accused to provide such a sample - it can still be taken by force. Secondly, the “evidence” of a blood sample is objective and, in principle, cannot and should not depend on the will of its owner.

N.N. Kitaev points out that “the use by individual judges when sentencing a polygraph as a criminal procedure evidence is unlawful, and the trend of the multiplication of such cases by judicial practice requires immediate official clarification from the Supreme Court of the Russian Federation” <33>.

It should be noted that the judicial practice, although not always, but still gives examples of a balanced attitude to polygraphological research. A similar position is still supported by the Supreme Court of the Russian Federation. In the light of all the foregoing, N.N. Apostolova: conducting an examination using a polygraph is unlawful, and the conclusion of a polygraph examiner regarding the truthfulness or false testimony of a person interviewed using a polygraph cannot be considered admissible and reliable evidence in a criminal case <35>. At the same time, there is no need to deny the polygraph’s ability to obtain orientation information, even if it is not evidence, but it can be useful in planning an investigation, nominating and checking investigative versions, etc. This was also emphasized by the Chairman of the Committee of the Council of the Federation on Constitutional Legislation prof. A.I. Aleksandrov, highly appreciating the possibilities of using the polygraph in operational-search activities to build versions, but not as a means of obtaining evidence <37>.

In literature, one can also find a proposal to use a polygraph in criminal proceedings as a technical means of fixing the psychophysiological state of a person who gives testimony, similar to the way an audio or video recording is used. Indeed, [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=1128"] h. 6 tbsp. 164 [/ DLMURL] of the Code of Criminal Procedure of the Russian Federation allows the use of technical means of fixation in the course of investigative actions, so considering the polygraph as such a means and the polygraph operator as a specialist involved in facilitating the interrogation, this idea can be considered interesting.

Interrogation using a polygraph, according to L.V. Vinitsky and N.E. Shinkevich, "can be considered an investigative action with the participation of a specialist operator" <38>, and the use of a polygraph will increase the efficiency of the assessment of the information obtained with this.

However, we recall that the use of technical means of fixation does not require the consent of the interrogated person; therefore, it again becomes possible to force the interrogated to be interrogated by a polygraph. In addition, we note that the use of technical means of fixation does not imply an interpretation of the results, but only using them directly, and there is little use for the curves themselves written by the recorder.

But the idea of using a polygraph on the initiative of the accused (suspect), who seeks to prove his innocence or innocence in this way, seems interesting. Of course, the conclusions of a specialist polygraph examiner, in this case, do not have evidential value, however, however, as orienting information (albeit not indisputably reliable), they can raise doubts about the guilt of the accused (suspect). As soon as these doubts cannot be eliminated, the presumption of innocence ([DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=100120"] h . 3 Art. 14 [/ DLMURL] Code of Criminal Procedure) will be on his side. It seems that the question of using a polygraph precisely for this purpose deserves serious study.

ИЛИ ЕЩЕ РАЗ О РОЛИ ПОЛИГРАФА В УГОЛОВНОМ СУДОПРОИЗВОДСТВЕ <1>

Говоря об использовании полиграфа в уголовном процессе, естественно задаться вопросом о принципиальной возможности, допустимости его использования в качестве средства/метода получения значимой для уголовного дела информации и, далее, о том, какова роль полученной информация в контексте уголовного судопроизводства.

Как сторонники, так и противники применения полиграфа справедливо отмечают: если двадцать лет назад предложения использования полиграфа встречались буквально в штыки, то теперь налицо обратная (в некотором смысле) тенденция - полиграфологические исследования (зачастую именуемые экспертизами) принимаются на ура, причем сами полиграфологи нередко явно выходят за пределы своей компетенции.

К осторожному, взвешенному отношению к использованию полиграфа призывают не только ученые-процессуалисты, но и криминалисты и судебные эксперты. Так, проф. В.Ю. Шепитько обоснованно указывает, что "возможность использования специальных приборов (лайдетекторов, вариографов, полиграфов и др.)... показывает динамику изменений кровяного давления, частоты пульса, уровня дыхания... и др. Такие показатели могут способствовать ориентации следователя при выдвижении предположений о ложности либо правдивости сообщаемой информации. Однако рассматриваемая "диагностика" не исключает ошибок, т.к. возникновение соответствующих психофизиологических реакций у допрашиваемого может быть вызвано необычностью обстановки допроса, неправильной постановкой следователем вопросов, пренебрежительным отношением к свидетелю или обвиняемому, демонстрацией обвинительного уклона и т.д." <2>.

Отметим прежде всего, что вопреки распространяемому и пропагандируемому сторонниками полиграфа мнению, использование полиграфа, увы, никак не может считаться строго научной и стандартизированной процедурой. Научная достоверность получаемых результатов подвергается обоснованному сомнению, а критические замечания касаются, в частности, того, что это, скорее, искусство, а не наука, ибо слишком многое зависит от квалификации, опыта и интуиции специалиста-полиграфолога.

Перечень вопросов для тестирования на полиграфе не унифицирован и ни в коей мере не является фиксированным. Для проведения испытания полиграфолог каждый раз должен заново подобрать и сформулировать вопросы так, чтобы вызвать нужную реакцию у конкретного испытуемого.

Уже это само по себе спорно, ибо нейтральный тест не должен быть нацелен на получение нужной реакции. Далее надлежит проинтерпретировать все многообразие физиологических проявлений, которые у различных субъектов могут быть весьма разнообразны. Единой методики опять же нет, так что интерпретация явно субъективна - неизбежны ошибки, обусловленные человеческим фактором.

Задаваясь вопросом, существует ли в настоящее время единый научно-методический подход к практике проведения психофизиологических исследований и экспертиз с применением полиграфа, профессиональной подготовке и специализации полиграфологов, "отец" отечественной полиграфологии проф. Ю.И. Холодный приходит к однозначно отрицательному ответу <3>, не скупясь на отрицательные характеристики видовой экспертной методики производства психофизиологических исследований с использованием полиграфа, разработанной конкурирующей группой исследователей из другого ведомства <4>.

Достоверность результатов, выдаваемых на-гора многочисленными полиграфологами <5>, - отдельный, наболевший вопрос. По данным ВНИИ МВД России <6>, точность показателей современных полиграфов доходит до 96%, что сторонники их применения считают вполне сопоставимым с точностью результатов традиционных видов криминалистических, а также многих других судебных экспертиз. Более того, по утверждениям того же Ю.И. Холодного, при экспериментальной проверке на достоверность результатов применения полиграфа установлено, что "технология проверок на полиграфе обладает степенью точности, сопоставимой и даже превосходящей большинство представляемых в настоящее время видов доказательств, которые фигурируют в судах по уголовным и гражданским делам" <7>.

Налицо явная и грубая подмена тезиса - полиграф регистрирует физиологические изменения, имеющие место в организме испытуемого, и в этом смысле он вполне надежный измерительный прибор. Достоверность самой регистрации сомнению не подлежит (при том условии, разумеется, что прибор правильно эксплуатируется, регулярно проходит регламентные поверки и т.п.). Но достоверность результатов тестирования вообще не может быть оценена, ибо физиологические реакции, фиксируемые полиграфом, могут быть интерпретированы оператором по-разному. В известном примере, приводимом Полом Экманом <8>, подозреваемый, обнаруживший обнаженный труп жены соседа, на допросе отрицает свою виновность и причастность, однако тест на полиграфе якобы изобличает его. Впоследствии выясняется, что у него ранее бывали сексуальные фантазии на почве влечения к соседке, а при виде ее обнаженного тела он ощутил влечение, чего очень стыдился. Чувство стыда не позволяло ему пройти тест на полиграфе, но вывод полиграфолога о причастности подозреваемого к убийству был ошибочен.

Сравним этот пример с другим известным примером, уже из отечественной практики, приводимым проф. В.М. Комиссаровым и Я.В. Комиссаровой <9>. Пытаясь изобличить Х., подозреваемого в убийстве, следователь подверг его тестированию на полиграфе и при этом предъявил ему для опознания в числе других фотографии обогревателя, кабель от которого использовался для удушения жертвы, и кровати, где это произошло. В результате были получены значимые психофизиологические реакции на указанные раздражители, что позволило сделать желаемый для следствия вывод. Сравнение с предыдущим примером показывает, что вывод этот мог сильно зависеть от интерпретации наблюдаемых реакций и быть весьма далек от достоверного.

Стремление придать выводам наукообразную видимость приводит к
представлению их в числовой форме, с указанием вероятности (степени
уверенности полиграфолога в своем ответе). Весьма характерен в этом смысле
пример, кочующий по разным работам Ю.И. Холодного: "...в результате
исследования... следов памяти конкретного человека полиграфолог может
получить вывод, обладающий высокой степенью вероятности. В частности, при
наличии трех частных признаков расследуемого события и при появлении у
подэкспертного соответствующих реакций на эти признаки полиграфолог
приходит к выводу о причастности исследуемого человека к устанавливаемому
событию с вероятностью Р = 0,992 (т.е. вероятность ошибки Р = 0,008, или
ош
0,8%). При наличии четырех признаков полиграфолог устанавливает такую
причастность с вероятностью Р = 0,9984 (т.е. Р = 0,0016, или
ош
0,16%)" <10>.

Убедительно? Для человека, далекого от математики, - возможно. Но
откуда взялись такие цифры? Автор об этом умолчал, но в более ранней работе
<11> можно обнаружить априорное предположение, что каждый из этих признаков
дает вероятность ошибки 0,2. По формуле умножения вероятностей тогда три
3 4
признака дадут как раз 0,2 = 0,008, а четыре дадут 0,2 = 0,0016; но ведь
формула умножения справедлива только для независимых событий! Можно ли эти
признаки считать независимыми? Более чем сомнительное предположение -
скорее, они в реальном вопроснике, напротив, тесно связаны. Между тем
требование независимости признаков даже не упомянуто ни в процитированной
работе, ни в уже упомянутой более ранней.

После этой псевдоматематической эквилибристики рекомендации полиграфологу формулировать вывод типа "в памяти подэкспертного имеется информация о том, что... (например, потерпевшему был нанесен удар ножом в спину). Данный факт установлен экспертом с вероятностью 0,95 (95%)" <12> ничего, кроме недоумения, уже не вызывают.

Итак, встречающиеся в литературе утверждения о том, что полиграф - допустимое для применения в уголовном процессе техническое средство, основанное на познанных наукой закономерностях, процессах и явлениях, гарантирующих получение достоверного результата <13>, приходится признать явным преувеличением и попыткой выдать желаемое за действительное.

Тем не менее сторонники использования полиграфа стремятся представить полиграфологическое тестирование как некий вид судебной экспертизы. Так, одна из разработчиков [DLMURL="https://login.consultant.ru/link/?req=doc;base=PRJ;n=82508;fld=134"]законопроекта[/DLMURL] "О применении полиграфа" Е.К. Волчинская, выступая на заседании Экспертно-консультативного совета при Комитете Совета Федерации по конституционному законодательству, прямо утверждала, что "в настоящий момент опрос с использованием полиграфа обычно проводится в рамках психофизиологической экспертизы, допускаемой законодательством" <14>, что не помешало ей далее процитировать Кассационное определение ВС РФ от 04.06.2008, в котором "суд обоснованно признал недопустимыми доказательствами три заключения так называемой (выделено мной. - А.Б.) психофизиологической экспертизы, так как они... не являются доказательствами по уголовному делу. Использование достижений специалистов-полиграфологов в процессе доказывания по уголовному делу законом не предусмотрено. Выводы такой экспертизы не носят научно обоснованного характера".

Возможность назвать полиграфологическое исследование экспертизой поддерживал Н.А. Селиванов: "Поскольку проверка на полиграфе требует применения специальных знаний и проведения соответствующих исследований, имеются все основания говорить о том, что в данном случае налицо все признаки процессуального действия, именуемого экспертизой" <15>. Есть у этой точки зрения и другие сторонники <16>.

Однако основные требования, предъявляемые к судебным экспертизам, содержащиеся в [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=122884;fld=134;dst=100030"]ст. 8[/DLMURL] Федерального закона "О государственной судебно-экспертной деятельности в Российской Федерации", предусматривают научную обоснованность применяемых методик, применение средств объективного контроля, т.е. использование только описанных в научной литературе методов, апробированных реальной исследовательской практикой и гарантирующих достоверные результаты (или по меньшей мере позволяющих установить, насколько те или иные результаты достоверны).

Как справедливо отмечает Н.Н. Апостолова, "сам процесс и результаты проведенной экспертизы должны быть научно обоснованными, аргументированными и достоверно установленными. Оцениваться заключение эксперта должно исходя из следующих критериев: 1) полноты и доброкачественности материалов, бывших в распоряжении экспертов; 2) наличия в заключении эксперта убедительных доводов, подтверждающих его вывод; 3) достаточный уровень развития данной отрасли научного знания; 4) достаточная научная квалификация самих экспертов... в заключении эксперта-полиграфолога не может быть обоснованных, аргументированных и убедительных доводов, подтверждающих вывод о ложности или правдивости показаний лица, опрошенного с применением полиграфа. Все, что может констатировать эксперт, - это то, что при ответе на тот или иной вопрос опрашиваемый среагировал определенным образом" <17>.

Ю.К. Орлов полагает, что предметом судебной экспертизы выступают "факты, обстоятельства (фактические данные), устанавливаемые посредством экспертизы" <18>. Полиграфологическое исследование, имеющее дело со следами, зафиксированными в памяти человека, материальных фактов не устанавливает, но лишь фиксирует в той или иной мере субъективное отношение человека к этим фактам, что вовсе не одно и то же, при этом, как указывают сами же полиграфологи, "важно учитывать влияние индивидуальных особенностей процесса запоминания (как следообразования в памяти), хранения и воспроизведения информации, а также особенностей физиологических и психических процессов, сопровождающих данное диагностическое исследование" <19>. В то же время механизм образования и последующего изменения идеальных следов практически изучен весьма мало.

В частности, странный тезис о том, что идеальные следы, в отличие от материальных, подвержены "исключительно естественному разрушению (т.е. забыванию)", но недоступны для умышленного разрушения, т.к. "человек неспособен намеренно забыть, "вытравить" из памяти нежелательные для него события прошлого или отдельные их обстоятельства", Ю.И. Холодный отстаивает в целом ряде своих публикаций <20>, хотя из психологии известно, что существует и преднамеренное, и т.н. мотивированное забывание <21>.

По мысли Ю.И. Холодного, "задача эксперта-полиграфолога - установить, какая информация содержится в памяти человека. И только это он должен констатировать в своем выводе: дальше - ни шагу" <22>. В то же время А.Б. Пеленицын, А.П. Сошников и О.В. Жбанкова верно указывают, что собственно процессы памяти не имеют непосредственной связи с механизмами функционирования вегетативной нервной системы, внешние проявления активности которых регистрируются полиграфом, "что не позволяет информации, хранящейся в памяти человека, иметь устойчивое и однозначное отражение во внешних физиологических проявлениях, на основании которых можно было бы делать достоверные выводы как о самом факте наличия этой информации, так и о ее содержании" <23>. В свете этого утверждения о том, что полиграфолог якобы констатирует наличие или отсутствие в памяти следов тех или иных обстоятельств события, сводят весьма мало изученный механизм формирования следов в памяти к сугубо физиологическим процессам <24>.

Итак, полиграфологическое исследование не может считаться судебной экспертизой. Согласимся с Л.М. Исаевой: "...не вызывает сомнений преждевременность придания статуса экспертного исследования полиграфному опросу хотя бы из-за отсутствия методик, позволяющих оценить достоверность выводов" <25>. Достоверность результатов весьма относительна - уже это не позволяет признать их полноценными процессуальными доказательствами.

Само употребление термина "экспертиза" (тем паче "судебная экспертиза") по отношению к полиграфологическому исследованию весьма сомнительно.

На разрешение такой "экспертизы" порой выносятся и вопросы, которые она в принципе разрешить не может. Так, Шатровский районный суд Курганской области, рассматривая дело Кайгародова, обвиняемого в совершении деяния, предусмотренного [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142949;fld=134;dst=103371"]ч. 3 ст. 264[/DLMURL] УК РФ, но вину свою не признавшего и от дачи показаний в суде отказавшегося (на основании [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=2875;fld=134;dst=100196"]ст. 51[/DLMURL] Конституции Российской Федерации), постановил обвинительный приговор, указав, что заключением психофизиологической экспертизы, проведенной в отношении свидетеля Сереброва, установлено, что в момент ДТП автомобиль обвиняемого шел на обгон автомобиля КамАЗ со скоростью более 100 км/час, что и послужило причиной дорожного происшествия, повлекшего смерть четырех потерпевших <26>. В то же время очевидно, что никакое исследование с помощью полиграфа не в состоянии подтвердить, что скорость автомобиля была свыше 100 км/час <27>, - в лучшем случае подтвердить возможно лишь то, что сам свидетель Серебров в этом уверен; но это не более чем его догадки. Фактически какой-то смысл подобное исследование могло бы иметь разве что при выяснении вопроса, не лжет ли сам свидетель и не следует ли привлечь его к ответственности по [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142949;fld=134;dst=103103"]ст. 307[/DLMURL] УК; для решения же вопроса о скорости все это исследование ничего нового, помимо самих показаний свидетеля, не дает. Нелишне напомнить, что показания, основанные на предположениях и догадках, [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=100683"]ст. 75[/DLMURL] УПК РФ оценивает весьма невысоко.

А как обстоит дело с допустимостью? Уже беглый взгляд позволяет сделать вывод, что и в этом отношении результаты исследования при помощи полиграфа отнюдь не могут считаться безупречными.

Отметим сразу, что производство судебной экспертизы предусматривает предупреждение эксперта об уголовной ответственности за дачу заведомо ложного экспертного заключения по [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142949;fld=134;dst=103103"]ст. 307[/DLMURL] УК РФ. Возможно ли такое в контексте психофизиологической полиграфологической экспертизы! Отнюдь нет, подобное возможно разве что при заведомо неверной фиксации показаний прибора, ибо "ошибка интерпретации" не может быть признана заведомой при отсутствии единой методики, да и вопросник не может быть заведомо неправильным, раз единых требований к нему нет. Это создает таким экспертам благоприятные условия для массового злоупотребления.

Отметим также и то, что [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=101463"]ст. 195[/DLMURL] УПК РФ, регламентируя производство экспертизы, вовсе не требует согласия подозреваемого/обвиняемого подвергнуться таковой. [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=1141"]Часть 4 данной статьи[/DLMURL] говорит лишь о согласии потерпевшего (или свидетеля), но и тут есть оговорка, что в случае сомнения в его способности адекватно воспринимать происходящее и давать показания, согласия все равно не требуется ([DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=101477"]п. 4 ст. 196[/DLMURL] УПК). Таким образом, коль скоро полиграфологическое тестирование - это некая разновидность судебной экспертизы, отсюда вытекает однозначный вывод, что такое тестирование обвиняемого или подозреваемого может быть произведено и принудительно, против его желания. Кстати, это возможно и по отношению к потерпевшему - ему всегда можно указать, что тестирование проводится именно в связи с сомнением в его правдивости, вызванным предположением о неадекватном его восприятии происходившего. Но откровенно абсурдная идея принудительного полиграфологического тестирования грубо нарушает принципы уголовно-процессуального законодательства, прежде всего [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=2875;fld=134;dst=100196"]ст. 51[/DLMURL] Конституции Российской Федерации.

Любопытно, что адепты полиграфологии это вовсе не считают недостатком, напротив, уже упомянутая О.В. Белюшина откровенно признает выигрышность такой ситуации: "Особенности производства судебной экспертизы в отношении живых лиц действующим уголовно-процессуальным законодательством не урегулированы. Более того, [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=100426"]ст. 47[/DLMURL] и [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=101463"]ст. 195[/DLMURL] УПК РФ не содержат положений, дающих обвиняемому право отказаться от участия в судебной экспертизе, проводимой в отношении его" <28>. Таким образом, с правами обвиняемого можно не считаться, а добровольный характер обследования заменяется принудительным. Заслуживает внимания и еще один примечательный пассаж того же автора: "По общей норме [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=122884;fld=134;dst=100168"]ст. 28[/DLMURL] Федерального закона о государственной судебно-экспертной деятельности проведение психофизиологической экспертизы в государственном судебно-экспертном учреждении без согласия испытуемого недопустимо. В то же время в силу [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=122884;fld=134;dst=100227"]ст. 41[/DLMURL] указанного Закона на экспертов, не являющихся государственными судебными экспертами, приведенная норма не распространяется. Таким образом, возникает процессуальная возможность проведения негосударственными экспертами экспертизы принудительно" <29>. Комментарии излишни.

Следует согласиться с Т.Ю. Ничипоренко, считающей, что "каждый случай применения полиграфа в доказывании по уголовному делу является попыткой придать доказательственное значение тому, что доказательством являться не может". Причину этого она видит в том, что оценка достоверности тех или иных сведений есть исключительная компетенция судьи, присяжных заседателей, прокурора, следователя и дознавателя, а не полиграфолога, заключение которого приходится расценить как вторжение в исключительную компетенцию органов предварительного расследования и суда <30>. Кстати, с этим вполне согласны и Ю.К. Орлов и Ю.И. Холодный: "...эксперт-полиграфолог выходит за пределы своей компетенции и вторгается в сферу полномочий следователя и суда. И тут критики совершенно правы" <31>.

По мнению проф. Л.А. Воскобитовой, полиграфолог фиксирует реакцию человека на заданные вопросы, однако с точки зрения юридической оценки правдивость или ложность показаний человека не имеет значения, поскольку не несет фактической информации о том, что на самом деле происходило в прошлом. В имеющейся судебной практике, как правило, из заключений полиграфолога фактическая информация не выявляется. Полиграф лишь выдает определенные кривые, но именно человек придает им фактические и содержательные смыслы. Когда судья перестает понимать разницу между фактической информацией и формальными документами уголовного дела, он перестает быть судьей <32>.

Вопрос о допустимости результатов полиграфологического исследования как процессуальных доказательств неразрывно связан с правом лица не давать показаний против самого себя, провозглашенным [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=2875;fld=134;dst=100196"]ст. 51[/DLMURL] Конституции Российской Федерации. Строго говоря, даже достоверно установленная ложность показаний обвиняемого, подтвержденная полиграфологическим исследованием, не влечет никаких юридических последствий, поскольку обвиняемый не обязан свидетельствовать против себя, на нем не лежит бремя доказывания своей невиновности, а процессуальные требования предупреждения об ответственности за дачу заведомо ложных показаний к нему не относятся.

Согласие подозреваемого, обвиняемого пройти полиграфологическую процедуру дела не меняет, ибо он, давая такое согласие, не может предвидеть своей реакции на задаваемые вопросы и сознательно контролировать ее. Если в ходе допроса, услышав вопрос следователя и видя, что его понуждают свидетельствовать против себя, допрашиваемый вправе просто отказаться отвечать (и даже отказаться давать показания вообще), то здесь ситуация принципиально иная. Вопрос прозвучал, реакция на него прибором уже зафиксирована и может быть интерпретирована оператором вне зависимости от того, ответил ли испытуемый или отказался отвечать. Более того, даже промежуток времени, в течение которого испытуемый размышляет, отвечать ему или отказаться, может быть подвергнут определенной интерпретации. Таким образом, лицо, подвергаемое полиграфологическому тестированию, может быть фактически принуждено против своей воли свидетельствовать против самого себя.

Обычным возражением адептов полиграфологии является то, что и взятый у обвиняемого образец крови, подвергнутый ДНК-анализу тоже может в итоге "свидетельствовать" против своего хозяина, причем против его воли. Однако, во-первых, закон не предусматривает согласия обвиняемого на предоставление подобного образца - он таки может быть взят и принудительно. Во-вторых, "свидетельство" образца крови объективно и в принципе не может и не должно зависеть от волеизъявления его хозяина.

Н.Н. Китаев указывает, что "использование отдельными судьями при вынесении приговора результатов опроса на полиграфе в качестве уголовно-процессуального доказательства является противозаконным, а тенденция умножения таких случаев судебной практикой требует немедленного официального разъяснения со стороны Верховного Суда РФ" <33>.

Надо заметить, что судебная практика хоть и не всегда, но все же дает примеры взвешенного отношения к полиграфологическим исследованиям. Так, в ноябре 2011 г. Военная коллегия ВС РФ в Кассационном определении по делу N 203-011-4 отменила приговор суда I инстанции, отметив, что, "делая вывод о причастности осужденных Х. и Ф. к убийству К. и признавая достоверными показания свидетеля Кр. о том, что он знает о совершенном убийстве со слов Х. и Ф., суд сослался на заключения "психофизиологических экспертиз", в ходе которых правдивость сообщаемых Кр. и Ф. сведений проверялась с помощью технического средства - полиграфа. Однако экспертом не представлено и судом не установлено научно обоснованное подтверждение надежности и достоверности результатов подобных исследований, которые позволяли бы признать их доказательством по уголовному делу в соответствии с требованиями [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=100674"]ст. 74[/DLMURL] и [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=103273"]80[/DLMURL] УПК РФ" <34>.

Подобная позиция по-прежнему поддерживается Верховным Судом Российской Федерации. Так, в своем Кассационном [DLMURL="https://login.consultant.ru/link/?req=doc;base=ARB;n=304703;fld=134"]определении[/DLMURL] от 4 октября 2012 г. N 34-О12-12 Судебная коллегия по уголовным делам вновь подтвердила, что согласно уголовно-процессуальному закону психофизиологические исследования не являются доказательствами, и изменила приговор Мурманского областного суда от 23 июля 2012 г. в отношении Б. и Ш., исключив ссылку на использование заключений по результатам проведенных в ходе предварительного следствия психофизиологических экспертиз, при которых исследовались показания Б. и Ш., в качестве доказательств, подчеркнув, что такие заключения не соответствуют требованиям, предъявляемым уголовно-процессуальным законом к заключениям экспертов, а такого рода исследования, имеющие своей целью выработку и проверку следственных версий, не относятся к доказательствам согласно [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=100674"]ст. 74[/DLMURL] УПК РФ.

Вполне логичным в свете всего вышеизложенного выглядит вывод Н.Н. Апостоловой: проведение экспертизы с применением полиграфа неправомерно, а заключение полиграфолога по поводу правдивости или ложности показаний лица, опрошенного с применением полиграфа, не может считаться допустимым и достоверным доказательством по уголовному делу <35>. К такому же выводу пришел и Экспертно-консультативный совет при Комитете Совета Федерации по конституционному законодательству, признавший использование полиграфа в качестве средства получения доказательств в уголовном судопроизводстве недопустимым и противоречащим [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=2875;fld=134;dst=100188"]ст. 49[/DLMURL], [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=2875;fld=134;dst=100192"]50[/DLMURL], [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=2875;fld=134;dst=100196"]51[/DLMURL] Конституции России <36>.

В то же время нет нужды отрицать возможности полиграфа в деле получения ориентирующей информации, пусть и не являющейся доказательством, однако способной принести пользу при планировании расследования, выдвижении и проверке следственных версий и т.п. Это подчеркнул и Председатель Комитета Совета Федерации по конституционному законодательству проф. А.И. Александров, высоко оценив возможности использования полиграфа в оперативно-розыскной деятельности для построения версий, но не в качестве средства получения доказательств <37>.

В литературе можно встретить и предложение использовать полиграф в уголовном судопроизводстве в качестве технического средства фиксации психофизиологического состояния лица, дающего показания, подобно тому, как используется аудио- или видеозапись. Действительно, [DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=1128"]ч. 6 ст. 164[/DLMURL] УПК РФ допускает применение технических средств фиксации при производстве следственных действий, так что, считая полиграф таким средством, а оператора полиграфа - специалистом, привлеченным для содействия производству допроса, подобную идею можно счесть интересной.

Допрос с использованием полиграфа, по мнению Л.В. Виницкого и Н.Е. Шинкевича, "можно считать следственным действием с участием специалиста-оператора" <38>, а использование полиграфа будет способствовать повышению эффективности оценки получаемых при этом сведений.

Однако напомним, что использование технических средств фиксации не требует согласия допрашиваемого лица, стало быть, вновь оказывается возможным принуждение допрашиваемого к допросу на полиграфе. Кроме того, отметим, что применение технических средств фиксации не подразумевает интерпретацию полученных результатов, но лишь использование их непосредственно, а от самих кривых, выписанных самописцем, проку мало.

Зато интересной представляется идея использования полиграфа по инициативе самого обвиняемого (подозреваемого), стремящегося таким путем удостоверить свою невиновность или непричастность. Разумеется, доказательственного значения, строго говоря, выводы специалиста-полиграфолога и в этом случае не имеют, однако в качестве ориентирующей информации (пусть и не бесспорно достоверной) они могут породить сомнения в виновности обвиняемого (подозреваемого). Коль скоро эти сомнения устранить не удастся, презумпция невиновности ([DLMURL="https://login.consultant.ru/link/?req=doc;base=ROS;n=142954;fld=134;dst=100120"]ч. 3 ст. 14[/DLMURL] УПК РФ) будет на его стороне. Думается, что вопрос применения полиграфа именно с этой целью заслуживает серьезной проработки.
