The Middle Ages is a harsh time, which seems to many of us barbaric and gloomy. But it was precisely at this time that the development of the state, and consequently of law, passed a very important stage, which it was impossible to jump over, going over to feudalism. Feudalism was a significant step forward in comparison with the slave system, and in its development laid the foundations for the emergence of developed commodity-money relations and the capitalist economy. Already under feudalism, trade and craftsmanship developed most actively, cities were built and expanded, becoming centers of financial life. Where there is finance, there is a complex relationship between dealers and their associations, and therefore their debts to each other. We are going to tell you about how the law of medieval countries in the field of granting loans and collecting debts evolved in this article.

In the Muslim countries of the Middle Ages, the main source of law on most issues was the Koran and the Sunnah, and after its execution in the VII-XII centuries - the Sharia.

According to the Qur'an, not to pay the debt is Haram, that is, the most shameful act for a Muslim, along with adultery, eating pork and killing an innocent person.

To lend, on the contrary, was considered an act of God-pleasing. Giving money or other material assets to someone for a while with the condition of return without increasing the amount according to Sharia is called karz (debt). One reliable hadith says: “Whoever lends to his brother, a Muslim, will increase his wealth, the angels will send him his mercy. If someone treats his debtor politely, on Judgment Day he will pass through a sirat (a bridge thrown over hell) instantly and without any interrogations. If someone refuses to lend to his brother, a Muslim, then access to paradise is forbidden. ”

If the deadline for repayment of the amount of money is determined, the debtor is obliged to return it on time, but the borrower should not demand this before the expiration of the term. To delay the repayment of debt without reason, Sharia considers it a sinful act, but if the debtor, except for the house in which he lives and the necessary household supplies, has nothing else to do, the creditor cannot demand the return of the debt and must patiently wait for its return. If the debtor is not able to repay his debt, but has the ability to work, he is obliged by his own work to repay the debt to the creditor.

If the debtor lost his creditor, cannot find him, Sharia does not allow the debtor to appropriate the debt, but orders to distribute it to the poor. If the debtor has borrowed a certain amount of gold or silver, and after that the prices have increased or decreased, the amount of repayment is agreed between the debtor and the creditor.

Islam categorically prohibits receiving a percentage premium for the borrowed amount - and this is one of its properties, thanks to which it became possible the existence of Muslim banks, carrying out loans in a different way. If the creditor during the summer cottage sets the condition that the debtor is obliged to return more than he took when returning, then this is considered a percentage premium and will be prohibited. But it is possible that the debtor in one form or another will thank the creditor. For example, it is allowed to invite the creditor to visit, to give him a gift. Such actions are considered Sharia-approved. The hadith says: “To lend to a Muslim two times is tantamount to giving money once for good.”

As for applying to slavery for failure to fulfill one’s obligations, it was strictly forbidden, however, as mentioned above, it was possible to work out the debt with your own labor.

In Western Europe, in particular among the German barbarian tribes, Salic truth was one of the main sources of law. According to her, during the collection of debts by the count, if he took the debt in excess of the due, he could be brought to justice - up to the death penalty. This code of laws also established that the borrower must repay the debt within 40 days from the date of repayment of the debt. If during this time the debt is not repaid, then a fixed penalty was charged. With malicious defaulters fought already with the help of the courts and the prince. After the debtor was found guilty of non-payment of debt and interest thereon, the creditor turned to the ruler with a request to force the borrower to be held accountable. Only after this the ruler and his retinue went to the debtor's house.

In the event that the borrower's property was not enough to pay off the debt to the creditor with interest and penalties, he was sent to forced labor - in bondage. At the same time, the count, intervening in the matter, acted as a kind of collector, for which he received a reward: a third of the amount of debt with interest. Naturally, such a significant percentage for the provision of "collection services" encouraged the princes and counts to actively intervene in the affairs of debtors, and to resolve such cases in the shortest possible time.

A later source of German law: the Saxon Mirror, compiled by Judge Eike von Repgow in 1221-1225, says the following about debts and their payment:

"Who accepts the inheritance, he must by law pay debts to the extent of the value of movable property. Debt arising from theft, robbery or gambling, he is not obliged to cover, in the same way, any other debt in which he received no counter-gain or was not a guarantor; such a debt must be covered by the heir, if it is proved by law on the part of 72 persons who are all free of the Sheffen estate or legitimate litas. " - Thus, already in this document the first steps of the legislator to protect the rights of the debtor were outlined.

Medieval Russia.

The first set of laws in Russia - "Russian Truth" - was adopted in 1016 - 1054. And it already contained the rules governing the repayment of debt obligations.

Article 48 of the Russian Pravda established that interest on a loan may not exceed half of the amount owed. If the merchant took two-thirds of the amount, he could lose not only interest but also all debt. The maximum percentage for a loan of money was set at 20%. In terms of responsibility for non-repayment of the debt, Russkaya Pravda assumed the transformation of the non-payer into a “purchase”, i.e. in a personally non-free employee who is required to work out a debt. Subsequently, the purchase under certain conditions could become a slave: for example, if you tried to get away from the creditor without paying.

Proof of the debt obligation was either a receipt - a promissory note, or witnesses who were supposed to confirm the fact of obtaining a loan in court.

It is also worth noting that later sources of Russian law already highlighted the influence on the debtor of circumstances beyond his control, and adjusted his responsibility in connection with them. The lawsuit of Ivan III (1497) allowed the merchant, who fell into bankruptcy as a result of an accident, to pay the lender the principal amount of the debt, without interest. The same law doomed the negligent merchant to slavery if he “drank his debt or otherwise destroyed his goods”.

In the case when a person, due to circumstances beyond his control, could not pay the debt, he was given a delay (up to three years), subject to the provision of bail.

A point appeared in later lawyers, which allowed the borrower to send in bondage to the lender any serf, serf, so that the latter could fulfill his debt. However, such a mechanism, of course, existed before, only it was not prescribed by law.

The main difference between Russian debt standards and European ones was that it was possible to redeem oneself from bondage only after paying the amount assigned by the master himself. This made the release very difficult.

Byzantium became the successor to many of the rules of Roman law, which differed from many other countries where the legal rules regarding debts had to be developed from scratch or based on customs. One of the main sources of law in Byzantium was the Arch of Justinian (Corpus Juris Civilis), which entered into force in 534. Later, Byzantine debt obligations were regulated by the Code of Laws "Basilica" (Basilica), compiled around 890 under the guidance of a prominent lawyer Symbiosis "Basilica ”Included 60 books, divided into titles and fragments. One of these books was entirely devoted to the regulation of debt law and guarantee. In Byzantium, conversion to slavery for debts was also quite common, but it is worth noting that over time, the position of slaves improved: responsibility for the murder of a slave was introduced, and their release was encouraged.

India

A competent subject in medieval India was the head of the family - a man. It was he who represented the family, and also lent and accepted debts.

The most important source of Hindu law was the Laws of Manu, which during the period of feudalism in numerous written comments were changed and rethought.

In Hindu law, the concept of "sacred obligation" existed. And the main sacred obligation was the obligation of the ruler and co-heirs to pay their debts and the debts of the ancestors in the male line. But descendants could avoid responsibility for those debts that were "vicious", "dirty", for example, debts arising from the maintenance of a mistress, the purchase of alcoholic beverages.

One of the features of a loan agreement in India, the interest on which can not exceed double the amount of debt. As it was written above, similar norms were adopted in Russian Pravda, with the only difference being that it was about half the amount of debt.

Hindu law had one more peculiarity: it did not know the time limits for collecting a debt. This is what prompted lawmakers to impose a limit on the percentage of the loan.

China .. Chinese law allowed the collection of interest on a loan agreement, but interest should not exceed the cost of borrowed money - a kind of "middle ground" between the Russian Truth and the Laws of Manu. A secured loan was formalized by a contract in writing and with the obligatory participation of the guarantor. The interest loan was taken both in money and in things, both for the monthly and annual interest. As in India, the head of the family possessed the greatest legal capacity, and its younger members could borrow only with the consent of the elders. The borrower was responsible to the lender with his property. But the latter did not have the right, even if there was a pledge, to autocratically take away his land, livestock and even property from the debtor. He was obliged to turn to the authorities and do this only after the authorities passed an appropriate decision. Thus, China was very different from a number of other countries where the debtor for non-payment could be completely extradited to the creditor or even sold into slavery.

If the debtor could not pay the property, then himself or one of the men of his family went to work out the debt. If the debtor did not want to pay and fled, then a surety had to pay for it. If the debtor died, the duty passed on to his heirs, sons.

In Japan, the Taiho Hero Code is the most important source of early medieval law. This code basically defined the socio-political system and lifestyle of the Japanese for a period of more than 500 years.

Under the loan agreement, both the state (its institutions) and private individuals acted as a creditor, and only a private person could be a debtor. The law recognized interest, but the total amount of interest, as in China, could not exceed the amount of debt. So, the law says that if the subject of the loan agreement was grain, then the amount of interest could not be more than 100% for a private lender and 50% for the treasury for a period from spring to autumn.

Interest could be charged after 60 days after the return of the debt; carried out every 60 days in the amount of 1/8 of the debt (12.5%), and after 480 days when the interest reached the debt, their collection was stopped.

Thus, we see that already in the early Middle Ages the state realized the obvious need to regulate debt and credit-financial relations, and moreover, it actively intervened in these relations - such an intervention often seemed very profitable. Lynching gave way to conflict resolution through rulers. Legal norms of debt law were complicated, supplemented by judicial precedents and began to ensure not only the rights of the creditor, but also to protect the rights of the debtor. And in this regard, the lawmaking of Asian countries is in no way inferior to European, despite the fact that in the development of the state, these two parts of the world went in different ways.

Средневековье — суровое время, кажущееся многим из нас варварским и мрачным. Но именно в это время развитие государства, а следовательно, и права, прошло очень важный этап, перепрыгнуть через который было невозможно, перейдя к феодализму. Феодализм был существенным шагом вперед по сравниванию с рабовладельческим строем, и в своем развитии заложил основы для появления развитых товарно-денежных отношений и капиталистической экономики. Уже при феодализме активнейшим образом развивалась торговля и ремесленничество, строились и разрастались города, становясь центрами финансовой жизни. Где финансы, там и сложные взаимоотношения дельцов и их объединений, а следовательно — их задолженности друг перед другом. О том, как развивалось право средневековых стран в сфере выдачи ссуд и взыскания долгов, мы и собираемся рассказать Вам в этой статье.

В мусульманских странах средневековья, основным источником права по большинству вопросов являлись Коран и Сунна, а после своего оформления в VII-XII веках — Шариат.

Согласно Корану, не выплачивать долг это Харам, то есть самый позорный для мусульманина поступок, наравне с прелюбодеянием, поеданием свинины и убийством невинного человека.

Дать же в долг, наоборот, считалось поступком богоугодным. Предоставление денег или других материальных ценностей кому-либо на время с условием возврата без увеличения суммы по Шариату называется карз (долг). В одном из достоверных хадисов говориться: «Кто даст в долг своему брату – мусульманину, увеличит свое богатство, ангелы пошлют ему свою милость. Если кто – либо обходиться вежливо со своим должником, в Судный день пройдет через сират (мост, перекинутый через ад) мгновенно и без всяких допросов. Если же кто – то откажется дать в долг своему брату – мусульманину, тому доступ в рай запрещен».

Если срок возврата денежной суммы определен, должник обязан вернуть ее в срок, но дающий в долг не должен требовать этого раньше истечения срока. Задерживать без причины отдачу долга Шариат считает греховным поступком, однако если должник, кроме дома, в котором живет, и необходимых домашних принадлежностей не имеет ничего другого, кредитор не может требовать возвращения долга, и обязан терпеливо ждать его возврата. Если должник не в состоянии вернуть свой долг, но имеет возможность трудиться, он обязан своим трудом вернуть долг кредитору.

Если должник потерял своего кредитора, не может его найти, Шариат не допускает присвоения должником долга, но предписывает раздать его бедным. Если же должник занял определенную сумму золотом или серебром, а после этого повысились или понизились цены, суммы возврата согласуется между должником и кредитором.

Ислам категорически запрещает получать процентную надбавку за одолженную сумму – и это одно из его свойств, благодаря которым стало возможно существование мусульманских банков, осуществляющих ссуду по иной схеме. Если кредитор во время дачи ставит условие, что при возврате должник обязан вернуть больше, чем он брал, то это считается процентной надбавкой и полежит запрещению. Но не исключена возможность, что должник в той или иной форме отблагодарит кредитора. Например, допускается пригласить кредитора в гости, сделать ему подарок. Такие действия считаются одобряемым Шариатом. В хадисе сказано: «Одолжить мусульманину два раза - равносильно отдать деньги один раз насовсем».

Что касается обращения в рабство за неисполнение своих обязательств, то оно строжайше запрещалось, однако, как уже было сказано выше, можно было отработать долг своим трудом.

В Западной Европе, в частности, у германских варварских племен, одним из основных источников права была Салическая правда. Согласно ей, при взыскании долгов графом, если он взял долга сверх положенного, его можно было привлечь к ответственности — вплоть до смертной казни. Этим сводом законов устанавливалось также, что вернуть долг заемщик должен в течение 40 дней с момента наступления даты погашения долга. Если и за это время долг не будет возвращен, то начислялась фиксированная пеня. Со злостными неплательщиками боролись уже при помощи судов и князя. После признания должника виновным в неуплате долга и процентов по нему, кредитор обращался к правителю с просьбой силой привлечь заемщика к ответственности. Только после этого правитель и его свита отправлялись в дом должника.

В случае, когда имущества заемщика не хватало, чтобы погасить долг кредитору с процентами и пеней, его отправляли на принудительные работы - в кабалу. В то же время граф, вмешавшись в дело, выступал в роли своеобразного коллектора, за что получал вознаграждение: треть от суммы долга с процентами. Естественно, такой весомый процент за оказание "коллекторских услуг" стимулировал князей и графов активно вмешиваться в дела должников, и разрешать подобные дела в самые кратчайшие сроки.

Более поздний источник права Германии: Саксонское зерцало, со ставленый судьей Эйке фон Репговом в 1221-1225 годах, говорит о долгах и их уплате следующее:

"Кто принимает наследство, тот должен по закону платить долги в пределах стоимости движимого имущества. Долг, вытекающий из кражи, грабежа или по игре, он не обязан покрывать, равным образом и какой-либо иной долг, в котором он не получил встречной выгоды или не был поручителем; такой долг должен наследник покрыть, если будет доказано по праву со стороны 72 лиц, которые все являются свободными шеффенского сословия или законнорожденными литами." - таким образом уже в этом документе наметились первые шаги законодателя по защите прав должника.

Средневековая Россия.

Первый свод законов на Руси - «Русская правда» - был принят в 1016 - 1054 гг. И в нем уже содержались нормы, регулирующие погашение долговых обязательств.

Статьей 48 «Русской правды» было установлено, что проценты по займу не могут превышать половины от суммы долга. В случае если купец брал две трети от суммы, он мог лишиться не только процентов, но и всего долга. Максимальный процент за услугу займа денег устанавливался на уровне 20%. В части же ответственности за невозврат долга «Русская правда» предполагала превращение неплательщика в "закупа", т.е. в лично несвободного работника, обязанного отрабатывать долг. В последующем закуп при определенных условиях мог стать холопом: например, если пытался уйти от кредитора, не расплатившись.

Доказательством взятого на себя долгового обязательства были либо расписка - простой вексель, либо свидетели, которые должны были подтвердить факт получения кредита в суде.

Стоит также отметить, что более поздние источники права Руси уже выделяли влияние на должника обстоятельств, ему неподвластных, и корректировали его ответственность в связи с ними. Судебник Ивана III (1497 г.) позволял купцу, впавшему в несостоятельность в результате несчастного случая, платить займодавцу основную сумму долга, без процентов. Тот же закон обрекал нерадивого торговца на холопство, если он долг свой «пропиет или иным какым безумием погубит товар свой».

В случае, когда человек, по не зависевшим от него обстоятельствам, не мог выплатить долга, ему давалась отсрочка (до трех лет), с условием предоставления поруки.

В более поздних судебниках появился пункт, который позволял заемщику отправлять в кабалу к кредитору любого холопа, крепостного, чтобы последний отработал его долг. Однако такой механизм, безусловно, существовал и раньше, только не был прописан законодательно.

Основным отличием российских долговых норм от европейских было то, что выкупить себя из кабалы можно было только лишь после уплаты суммы, назначенной самим барином. Это делало освобождение очень трудным.

Византия стала преемницей множества норм римского права, чем отличалась от многих других стран, где правовые нормы, касающиеся долгов, приходилось разрабатывать с нуля или на основе обычаев. Одним из основных источников права в Византии был свод Юстиниана (Corpus Juris Civilis), вступивший в силу в 534 г.. Дееспособным субъектом в средневековой Индии был глава семьи — мужчина. Именно он представлял семью, а также давал в долг и принимал долги.

Важнейшим источником индусского права являлись Законы Ману, которые в период феодализма в многочисленных письменных комментариях изменялись и переосмысливались.

В индусском праве существовало понятие "священного обязательства". И основным священным обязательством было обязательство управителя и сонаследников выплачивать свои долги и долги предков по мужской линии. Но потомки могли избежать ответственности за те долги, которые были "порочными", "грязными", например, долги, возникшие в результате содержания любовницы, покупки алкогольных напитков.

Китай.. Китайское право разрешало взимание процентов по договору займа, но проценты не должны были превышать стоимости взятого в долг — своеобразная "золотая середина" между Русской Правдой и Законами Ману. Заем под залог оформлялся договором в письменной форме и при обязательном участии поручителя. Заем под проценты брался как деньгами, так и вещами, как под месячный, так и под годовой процент. Как и в Индии, наибольшей дееспособностью обладал глава семьи, а младшие ее члены могли брать взаем только с согласия старших. Заемщик отвечал перед кредитором своим имуществом. Но последний не имел права даже при наличии залога самовластно забрать у должника его землю, скот и даже имущество. Он обязан был обратиться к властям и делать это только после вынесения властями соответствующего решения. Таким образом Китай сильно отличался от ряда других стран, где должника за неуплату могли полностью выдать кредитору или даже продать в рабство.

Если же должник не мог расплатиться имуществом, то сам или кто-то из мужчин его семьи отправлялся на отработку долга. Если должник не желал платить и бежал, то за него должен был расплачиваться поручитель. Если должник умирал, долг переходил на его наследников, сыновей.

В Японии важнейшим источником раннесредневекового права является кодекс "Тайхо Еро ре". Этот кодекс в основных чертах определял социально-политический строй и жизненный уклад японцев на период более чем 500 лет.

По договору займа в качестве кредитора выступали и государство (его учреждения) и частные лица, а должником могло быть только частное лицо. Закон признавал проценты, но общая сумма процента, как и в Китае, не могла превышать сумму долга. Самосуд уступал место решению конфликтов через правителей. Правовые нормы долгового права усложнялись, дополнялись судебными прецедентами и начинали обеспечивать не только права кредитора, но и защищать права должника. И в этом плане правотворчество стран Азии ничем не уступает европейскому, не смотря на то, что в развитии государства эти две части света шли различными путями.
