Документ предлагает разделить законодательное регулирование детективной и охранной деятельности, а также расширить возможности для оказания детективных услуг не только в России, но и за рубежом «в соответствии с нормами ВТО и законодательством государства оказания охранных услуг». В дополнение к уже имеющимся в законодательстве детективным услугам в проект нового закона будут включены новые параметры работы частного детектива. Правом запрашивать информацию о частных лицах могут наделить детективов. Новый закон о детективной деятельности позволит частному сыску пользоваться данными судебных приставов при поиске должников, получать характеристики у работодателей, данные от мобильных операторов и записи с уличных камер. Как рассказал «МК» депутат Госдумы Анатолий Выборный, законопроект обсуждают с профессиональным сообществом и могут внести на рассмотрение уже в декабре.

Президент Международной ассоциации детективов Андрей Матушкин отметил, что в эту профессию в основном приходят бывшие сотрудники силовых структур. По его словам, именно поэтому на Западе спецслужбы и правоохранительные органы находятся в постоянном взаимодействии с частными детективами. В России силовики не приходят за помощью к коллегам Шерлока Холмса и не делятся с ними информацией:

— Не все готовы идти с нами на контакт. Бывают случаи, когда в отношении преподавателя есть подозрения в педофилии. Как мы можем проверить информацию, пока ничего не случилось? Если бывший работодатель будет обязан оперативно ответить на запрос, а МВД предоставить сведения о судимости — это выгодно всем.

Частные специалисты считают, что расширение их полномочий позволит наладить сотрудничество между правоохранителями и лицензированными детективами, которых всего около 900 человек в стране. Они получат преимущество перед теми, кто занимается сыскной деятельностью и добывает сведения нелегально.

Детективная деятельность – один из видов современного бизнеса, который пока с трудом прокладывает себе дорогу в нашей стране.
На фоне огромной армии индивидуальных предпринимателей, занимающихся продажами, перевозками, строительством, ремонтом и другими услугами населению, частный сыск выглядит бледно. Цифры говорят сами за себя – на сегодня в России выдано менее 900 лицензий детективам, сообщает канал РБК/Бизнес-вектор.

Если взять конкретно Волгоградскую область, то, по данным регионального Управления Росгвардии, в настоящее время официально зарегистрировано всего 4 частных детектива.

И это при том, что, в принципе, работы для них должно хватать. Особенно в городах с развитой экономикой и растущим количеством коммерческих компаний, заботящихся о своей безопасности.

Такую статистику подтверждает и руководитель волгоградского частного детективного агентства «Щит» Александр Симоненко. Он добавил, что обращающихся за услугами бизнесменов нередко интересует проверка благонадежности партнеров при заключении договоров, проверка сотрудников при приеме на работу.

В общем, в плане обеспечения экономической безопасности предприятий и организаций ограничений нет. А вот заниматься личными делами граждан, по закону, детективы не имеют права. Бывают лишь иногда специфические контракты.

-Вот, к примеру, на днях был звонок – родители хотят установить наблюдение за несовершеннолетним ребенком, для того чтобы узнать его круг общения, чем занимается вне школы, курит ли, пьет, наркотики и так далее. Мы также занимаемся розыском людей, без вести пропавших, утративших связь, поиском должников, поэтому даже приставы могут обращаться к нам за помощью. Законом это не запрещено. Вопрос только в финансировании всех этих мероприятий, – рассказал изданию «НовостиВолгограда.ру» Александр Симоненко, частный детектив из Волгограда.

Сбор информации о человеке может занимать разный промежуток времени, в среднем до двух недель. Услуга не из дешевых. По столичным прайсам, от 20 тысяч рублей в день. В регионах может быть и дешевле, но все равно понадобится приличная сумма.

- Качественная работа дешевой не бывает. Когда люди хотят за копейки, скажем, за три тысячи рублей получить розыск человека, то это невозможно. У нас в городе в среднем розыск стоит от 35 тысяч рублей. Если в целом по области – то в районе 50 тысяч. И, разумеется, больше стоит работа, если человек скрывается в других регионах России и реально прячется, – разъяснил Симоненко.

По словам другого частного детектива Алексея Миронова, за последний год расходы сильно выросли: подорожал бензин и доступ к базам данных. А ведь это составляет большую часть себестоимости расследования, не считая премиальных.

Пришло время предусмотреть законодательно детективную тайну. Потому что когда человек или юридическое лицо обращается за той или иной услугой в рамках компетенции детектива, то заказчик должен понимать, что информацию, которую он будет предоставлять частному детективу, будет сохранена.

По федеральному закону «О частной детективной и охранной деятельности в Российской Федерации», частный сыщик – это индивидуальный предприниматель. Но стать им непросто.

Гражданин, претендующий на получение лицензии на осуществление частной детективной деятельности, должен быть старше 21 года, не иметь судимости, медицинских противопоказаний, психического заболевания, алкоголизма или наркомании. Предоставить документы о наличии среднего профессионального или высшего юридического образования либо о прохождении курсов подготовки детективов. Вместо этого может быть учтен трехлетний стаж работы в оперативных или следственных подразделениях, сообщили изданию в пресс-службе Управления Росгвардии по Волгоградской области.

Частными расследованиями запрещено заниматься тем, кого уволили с госслужбы по компрометирующим основаниям; в течение года после увольнения бывшим правоохранителям, контролировавшим частную детективную и охранную деятельность.

Вместе с лицензией, которая выдается на пять лет и действительна на всей территории России, индивидуальный предприниматель получает и удостоверение частного детектива. Все – кажется, можно теперь спокойно заниматься сыском. Но у большинства деятельность сворачивается через несколько месяцев.

- Выходя на пенсию, тот же оперативник думает о том, что вот сейчас открою детективное агентство – и ко мне повалят клиенты. Скажу, эта работа больше, скажем, для души, чем для зарабатывания каких-то больших денег. Да, бывают богатые клиенты. Да, получается иногда заработать нормальные деньги. Но в целом, когда всю жизнь этим занимался, то теперь не представляешь, что еще мог бы делать. Ну, не торговать же женскими колготками. Но люди открывают детективное агентство, месяца два-три вкладывают какие-то средства в аренду офиса, в рекламу. А через четыре месяца они сдуваются. Потому что клиентов нет, а если есть, то мелкие, заработок небольшой, и люди уходят из этого бизнеса, – объяснил причину малого количества официальных частных сыщиков в регионе Александр Симоненко, руководитель волгоградского детективного агентства «Щит».

В оперативных подразделениях органов внутренних дел Симоненко проработал 20 лет. Говорит, без обширных связей среди бывших и действующих сотрудников, которые сложились за это время, было бы очень трудно получать нужную информацию. По его мнению, назрела необходимость в совершенствовании российского закона о частных детективах, которые нередко помогают полиции раскрывать преступления и находить преступников.

- Если сравнивать с американскими детективами, то у них полномочия очень широкие. Там, конечно, они тоже обязаны пройти обучение и получить лицензию. Но у них имеется определенный доступ к базам данных. И при заключении договора на работу по какому-то делу они имеют возможность зайти в базу полиции, указав там свой пароль. У нас же такого нет. Можно, конечно, сделать запрос официальный. Возможно, ответят на него, а возможно, и нет, – посетовал волгоградский детектив.

Он также добавил, что для данной работы недостаточно быть опытным оперативником, так как детектив – это уже все-таки бизнесмен. А бизнес – это составление отчетов, ведение бухгалтерии, а также получение навыков по привлечению клиентов.

Как сообщает канал РБК/Бизнес-вектор, хотя детективами могут быть лишь индивидуальные предприниматели, аналогичные услуги порой предоставляют юридические лица. Так, компания «Власта-Консалтинг» консультирует по вопросам безопасности и более 20 лет защищает клиентов от фирм-однодневок и сомнительных кандидатов на работу.

«Мы должны получить не только информацию о профессиональных качествах того или иного кандидата, но и по возможности определить его личностные характеристики. Насколько он адекватно вел себя на предыдущих местах работы, действительно ли он ушел по собственному желанию или его по существу заставили покинуть компанию», –комментирует совладелец компании «Власта-Консалтинг» Владимир Соломанидин.

Согласно опросам аудиторской сети PricewaterhouseCoopers (PwC), в половине случаев угроза мошенничества возникает внутри российских компаний. В первую очередь, от руководителей среднего и высшего звена – 22% и 19%, соответственно. Еще 7% – остальные сотрудники.

Для компании «Власта-Консалтинг» проверка партнеров и персонала приносит одну половину дохода, другую – борьба с контрафактом.

В Торгово-промышленной палате РФ считают, что нужно расширять полномочия частных детективов, в том числе допустить на рынок юридические лица, а также упростить процедуру лицензирования.

Надо как раз упростить само получение лицензии. А возможно, передать все это саморегулируемым организациям.
