- the fact of the spread of defamatory statements, their nature;
- the fact of unreliability of common statements
(at the same time, negative information about the person is considered unreliable, until its confirmation);
- the fact of the death of a person in respect of whom defamatory honor and dignity statements were distributed;
- the plaintiff's interest, its nature.
A rough list of necessary evidence:
- A copy of the print media in which defamatory statements of the plaintiff are published;
- letters, statements, other written information carriers defaming the plaintiff;
- audio recording of radio broadcasts, public statements of the defendant;
- video recording of the broadcast in a television program, public speech or statement of the defendant;
Domestic judicial practice successfully considers cases with such a subject, and the Higher Specialized Court has repeatedly explained the features of the application of the rule of law.
I think that if the statement of the defendant is really wearing defamatory statements, then it will not be difficult for the court to find a causal relationship in the statements and consequences of this.
