On the one hand, it is possible to condemn the guardianship authorities for the zealous fulfillment of their duties to deprive of parental rights, and the colleagues ’assertion that no matter what the parents are, they are most dear to their children, I myself think is right. Sometimes there are excesses in the work of the Board of Trustees when they work for the result in the interests of their statistics. There is also a corruption moment. After all, you can make money on a good little boy from a dysfunctional family, giving it to "decent" people for education.
But on the other hand, children who are with parents who lead an immoral lifestyle themselves become dangerous to society. I know from experience how cruel they can be because of their bitterness, impunity. In such cases, neither preventive work with parents, nor punitive measures for them, nor any results on the positive formation of the child’s personality will give. And while remaining in such a family, children rarely become PEOPLE. And the choice arises: to save the "family" or somehow minimize the threat to society and perhaps give the child a chance to become a HUMAN.
I do not presume to say that the removal of children from the family is an effective way to save baby souls. The reason for this situation, as colleagues expressed, lies in the field of morality, the sincerity of society. In general, everything has long been spelled out in the work of guardianship councils and other government agencies that are responsible for working with families and children. The question is whether all the human and material resources of the state are involved and in general, is it interested in such fruitful work.

The terrible figures of inexorable statistics frighten and dazzle at the same time: almost 11 thousand people were deprived of parental rights in Russia only in the first half of 2011. According to the Ministry of Internal Affairs, from the beginning of the year, 45.5 thousand parents who did not fulfill their responsibilities in raising minors were identified and registered in the country. How many of them will be deprived of parental rights is still unknown. And this is with the state setting on the priority of family education!

Criminal reports are full of terrible cases of cruel treatment of bad parents with their children. Moreover, not always fathers and mothers are bitter drunkards, as is commonly thought. Alas, boys and girls are thrashing how much in vain, they are mocking them in “normal”-looking families. Although most often parental cruelty (and cruelty can be understood as complete indifference to the fate of one’s own child) is still related to alcohol or drugs.
According to sociological studies that Rosbalt cites, the most common cause of child abuse by parents is the poor performance of their offspring at school. According to the study, 87.4 percent of Moscow teenagers feel comfortable in the family, while 12.6 percent feel unprotected, superfluous, and useless to anyone. Only 60 percent of children talk about the manifestations of love, care, and a warm relationship from their parents.
Guardianship and trusteeship agencies, which are required to monitor the fate of children, sometimes make decisions about the deprivation of parental rights, based on the thesis "no matter what happens." That is, it is easier to take the child away from the parents until something “serious” happens, than to somehow influence them for a long time, to monitor the situation in the family and in the home, and so on. Here is a case in point, which was described by Pravda.Ru, candidate of legal sciences, member of the International Bar Association Igor Schmidt:

“Last year I had a chance to participate in a very unusual lawsuit. The guardianship authorities initiated a lawsuit depriving the parental rights of a 29-year-old single mother, a resident of Vologda. According to the authorities, her 11-year-old daughter was deprived of proper care by her mother , the girl was often left alone, did poorly at school.Five times in a row, a special commission checked this family, came home (mother and daughter lived in a dormitory room), but there was only one girl on hand.

They started to understand. In general, the mother was not seen in alcoholism, was not registered, the neighbors had a rather high opinion of her. She explained to the court why she is often not at home in the evenings - she works at two jobs, one of them is the second shift at the local factory. The court heeded the arguments of the defense and parental rights of the young woman still did not deprive. But in the whole country, according to statistics, the courts satisfy the claims of the guardianship and guardianship authorities regarding the deprivation of parental rights in 85 percent of cases! That is, parents, albeit for some reason stumbled, have almost no opportunity to "get on their feet" and begin, so to speak, a new life. Alas, this is the practice ...

Based on what indicators can a child be removed from the family? In general, if you look, there are no official, written on paper, legislatively approved rules or recommendations on this subject. Neither the Family Code nor Federal Law No. 48 "On Guardianship" is talking about this specifically. But still, you must agree, there must be clear criteria that would give the appropriate authorities a certain algorithm of action! But they are not there.

Therefore, the guardianship authorities take decisions at their discretion. Very often, unfortunately, at the forefront is not so much the fate of the child as the desire to protect themselves from error. Such reinsurance in no way affects the professional reputation of guardianship specialists. But the law punishes for negligence. "
In principle, according to statistics from the apparatus of the Commissioner for Children's Rights under the President of the Russian Federation, Pavel Astakhov, the number of children whose parents were deprived of parental rights has decreased by 11.1 percent since 2008. Is it a lot or a little? No one knows that. For me, so even if a single child is left without parents, this is already grief of a universal scale. And here in Moscow alone for a year without mothers and fathers were more than 700 kids.

At the IV congress of the Commissioners for the Rights of the Child recently held in Moscow, wild numbers were heard in the constituent entities of Russia, after which you grab your head: as if we had declared war on children. Well, or they are fighting against children without declaring war. Only by rough estimates over the past 10 years, the number of pedophiles in the country has increased three to four times, and the number of sexual crimes against children compared to 2005 - almost 20! 44 percent of minor Internet users have been sexually harassed at least once.
In general, also by very rough estimates, about 10 million children under the age of 14 regularly go to the World Wide Web. For incomplete 2011, according to Pavel Astakhov, voiced at the congress, 4.9 thousand crimes against the sexual integrity of minors were registered in Russia. More than a thousand children received serious harm to health. In total, 48.1 thousand underage Russians became victims of criminal attacks by adults, 723 of whom died.

According to the Commissioner, the problem of early warning of child abuse in families in Russia is being addressed, to put it mildly, not effectively enough. And the deprivation of the parental rights of bad parents is just one of many ways to fight for children's rights. Mother or father, whatever they are, still remain the most important people for the children ...
