Private detective. A bit of history.

Detective (eng. Detective, from lat. Detectio - disclosure) - a specialist in the investigation of criminal offenses; detective police agent, detective. His responsibilities include collecting evidence and providing them to the judiciary.

Private detective - a citizen of the Russian Federation registered as an individual entrepreneur, who has received, in the manner prescribed by law, a license to conduct private detective (detective) activities and provides the services provided for in the second part of Section 3 of the Law on Private Detective and Security Activities in the Russian Federation (as amended by Federal Laws) dated March 21, 2002 N 31-ФЗ, dated January 10, 2003 No. 15-ФЗ, dated June 6, 2005 No. 59-ФЗ, dated July 18, 2006 No. 118-ФЗ, dated July 24, 2007 No. 214-ФЗ, dated December 22, 2008 N 272-FZ).

Legislation

In Russia, activities private detectives regulated by the Law on Private Detective and Security Activities in the Russian Federation (as amended by Federal Laws dated March 21, 2002 N 31-ФЗ, dated January 10, 2003 No. 15-ФЗ, dated June 6, 2005 No. 59-ФЗ, dated July 18, 2006 No. 118 -FZ, dated July 24, 2007 N 214-ФЗ, dated December 22, 2008 N 272-ФЗ). According to the law, private detective and security activities are defined as the provision on a contractual basis of services to individuals and legal entities that have special permission (license) of internal affairs agencies and individual entrepreneurs in order to protect the rights and legitimate interests of their clients.

Activities

Activities private detectives romanticized and heroized by the eponymous genre of literature and cinema, in which the personality private investigator in most cases is the main figure of the story. In such works, the main character is usually attributed to the qualities that distinguish him among colleagues. The basis of the storyline is usually the fight against crime, which is complemented by the possible personal problems of the protagonist and his relationship with others.

In real life, according to the current legislation, private detective provides the following services:
collection of information on civil cases on a contractual basis with participants in the process;
market research, collecting information for business negotiations, identifying insolvent or unreliable business partners;
the establishment of the circumstances of the unlawful use of company marks and names in entrepreneurial activity, unfair competition, as well as the disclosure of information constituting a trade secret;
elucidation of biographical and other personality-characterizing data on individual citizens (with their written consent) upon their conclusion of labor and other contracts;
search for missing citizens;
search for property lost by citizens or enterprises, institutions, organizations;
collection of information on criminal cases on a contractual basis with participants in the process. Within a day from the moment of concluding a contract with the client for the collection of such information, the private investigator is obliged to notify the person conducting the inquiry, the investigator or the court in whose proceedings the criminal case is informed.

Activity limitations

In accordance with applicable law private investigators prohibited:
to conceal from law enforcement bodies the facts of impending, committed or committed crimes that have become known to them;
impersonating law enforcement officers;
collect information related to personal life, political and religious beliefs of individuals;
to carry out video and audio recordings, photographing and filming in office or other premises without the written consent of the relevant officials or private individuals;
to resort to actions encroaching on the rights and freedoms of citizens;
to commit actions that endanger the life, health, honor, dignity and property of citizens;
falsify materials or mislead the client;
to disclose information about the customer collected in the course of fulfillment of contractual obligations, including information regarding issues of protecting the life and health of citizens and (or) protection of the customer’s property, use them for any purpose contrary to the interests of the customer or in the interests of third parties, except on the grounds provided for by the legislation of the Russian Federation;
transfer your license for use by others;
use documents and other information obtained as a result of operational-search activities by bodies authorized in this field of activity;
to receive and use information contained in special and information-analytical databases of the bodies engaged in operational-search activities, in violation of the procedure established by the legislation of the Russian Federation.

Conducting detective actions that violate the confidentiality of correspondence, telephone conversations and telegraphic messages or related to violation of guarantees of inviolability of the person or home, entails liability established by law.

Ча́стный детекти́в — гражданин Российской Федерации, зарегистрированный в качестве индивидуального предпринимателя, получивший в установленном законом порядке лицензию на осуществление частной детективной (сыскной) деятельности и оказывающий услуги, предусмотренные частью второй статьи 3 Закона о частной детективной и охранной деятельности в Российской Федерации (в ред. В России должность сыщика введена в 1669 году вместо Губного старосты и Губного целовальника. Губной целовальник — должность в Московском государстве. Название губной по мнению Татищева происходит от слова губить, губление. По сведениям Н. М. Карамзина, слово губа в древнем Немецком праве означало усадьбу, а в российском — волость или ведомство[1]. В XVI веке Губной целовальник — товарищ Губного старосты, а в XVII веке — его подчиненный, предназначавшийся для разных поручений по губным делам. Губные целовальники выбирались посадскими и уездными людьми, без всякого участия служилых людей, из тяглых классов населения, из людей «добрых и животом прожиточных, которых бы с такое дело стало», хотя бы и неграмотных.

Уложение царя Алексея, предписывая выбирать Губных целовальников и других низших должностных лиц губного управления с посадов и с уездов с сох, с дворцовых сёл и чёрных волостей и со всяких сошных людей, и с патриарших, митрополичьих, архиепископских, епископских и монастырских и со всяких поместных и вотчинных земель, облегчало служилых людей тем, что с поместий и вотчин, в которых менее 20 человек крестьян, низших должностных лиц Губного управления выбирать не велено. Обыкновенно для выбора Губных целовальников уезд расписывался на кости, но допускались и самые разнообразные исключения. Законодательство

В России деятельность частных детективов регламентируется Законом о частной детективной и охранной деятельности в Российской Федерации (в ред. Федеральных законов от 21.03.2002 N 31-ФЗ, от 10.01.2003 N 15-ФЗ, от 06.06.2005 N 59-ФЗ, от 18.07.2006 N 118-ФЗ, от 24.07.2007 N 214-ФЗ, от 22.12.2008 N 272-ФЗ). Согласно закону частная детективная и охранная деятельность определяется как оказание на возмездной договорной основе услуг физическим и юридическим лицам, имеющими специальное разрешение (лицензию) органов внутренних дел организациями и индивидуальными предпринимателями в целях защиты прав и законных интересов своих клиентов.

Деятельность

Деятельность частных детективов романтизирована и героизирована одноимённым жанром литературы и кинематографа, в котором личность частного детектива в большинстве случаев является главной фигурой повествования. В подобных произведениях главному герою обычно приписываются качества, которые выделяют его среди коллег. Основой сюжетной линии, обычно, выступает борьба с преступностью, которую дополняют возможные личные проблемы главного героя и его взаимоотношения с окружающими людьми.

В связи с тем, что произведения детективного жанра имеют направленность на широкую аудиторию, реалистичность происходящего приносится в жертву зрелищности и сюжету. Профессиональный правоохранительный служащий заметит в соответствующих книгах и фильмах множество ошибок, по большей части юридического характера.

В реальной жизни, согласно действующему законодательству, частный детектив предоставляет следующие виды услуг:
сбор сведений по гражданским делам на договорной основе с участниками процесса;
изучение рынка, сбор информации для деловых переговоров, выявление некредитоспособных или ненадежных деловых партнеров;
установление обстоятельств неправомерного использования в предпринимательской деятельности фирменных знаков и наименований, недобросовестной конкуренции, а также разглашения сведений, составляющих коммерческую тайну;
выяснение биографических и других характеризующих личность данных об отдельных гражданах (с их письменного согласия) при заключении ими трудовых и иных контрактов;
поиск без вести пропавших граждан;
поиск утраченного гражданами или предприятиями, учреждениями, организациями имущества;
сбор сведений по уголовным делам на договорной основе с участниками процесса. В течение суток с момента заключения контракта с клиентом на сбор таких сведений частный детектив обязан письменно уведомить об этом лицо, производящее дознание, следователя или суд, в чьем производстве находится уголовное дело.

Ограничения деятельности

В соответствии с действующим законом частным детективам запрещается:
скрывать от правоохранительных органов ставшие им известными факты готовящихся, совершаемых или совершенных преступлений;
выдавать себя за сотрудников правоохранительных органов;
собирать сведения, связанные с личной жизнью, с политическими и религиозными убеждениями отдельных лиц;
осуществлять видео- и аудиозапись, фото- и киносъемку в служебных или иных помещениях без письменного согласия на то соответствующих должностных или частных лиц;
прибегать к действиям, посягающим на права и свободы граждан;
совершать действия, ставящие под угрозу жизнь, здоровье, честь, достоинство и имущество граждан;
фальсифицировать материалы или вводить в заблуждение клиента;
разглашать собранные в ходе выполнения договорных обязательств сведения о заказчике, в том числе сведения, касающиеся вопросов обеспечения защиты жизни и здоровья граждан и (или) охраны имущества заказчика, использовать их в каких-либо целях вопреки интересам заказчика или в интересах третьих лиц, кроме как на основаниях, предусмотренных законодательством Российской Федерации;
передавать свою лицензию для использования её другими лицами;
использовать документы и иные сведения, полученные в результате осуществления оперативно-розыскной деятельности органами, уполномоченными в данной сфере деятельности;
получать и использовать информацию, содержащуюся в специальных и информационно-аналитических базах данных органов, осуществляющих оперативно-розыскную деятельность, в нарушение порядка, установленного законодательством Российской Федерации.

Проведение сыскных действий, нарушающих тайну переписки, телефонных переговоров и телеграфных сообщений либо связанных с нарушением гарантий неприкосновенности личности или жилища, влечет за собой установленную законом ответственность.

Схожие профессии

Детекти́в — должность в полицейских структурах стран, организованных на основе англо-саксонской системы права. В России нет профессии, которая была бы аналогична профессии детектива, к примеру в полиции США. Если анализировать полномочия детективов и сравнивать их с полномочиями российских правоохранительных служащих, то правовой статус детектива будет представлять собой нечто среднее между статусом оперуполномоченного и дознавателя в России.

Частный детектив, хоть и называется детективом, не является государственным служащим, поэтому его правовое положение несколько иное. Частный детектив — своего рода фрилансер, осуществляющий предпринимательскую деятельность на свой риск. Это, с одной стороны, дает частному детективу некоторую свободу, но с другой стороны частный детектив не наделен теми императивными полномочиями, которые имеют его коллеги из государственных и муниципальных структур.

Образ сыщика, расследующего преступление, очень популярен в культуре. Существует огромное количество литературных произведений и кино на эту тему (т. н. детектив). Многие из героев таких произведений стали исключительно популярны в массовой культуре;
Одним из первых произведений подобного рода является рассказ Эдгара По «Убийство на улице Морг»;
В дальнейшем важную роль в развитии и становлении жанра сыграл образ Шерлока Холмса.
