The obligatory share in the inheritance is an exception to the general rule on inheritance by will, since this right provides a certain category of persons with the opportunity to inherit half the share that would belong to each of the heirs under the law, regardless of the contents of the will.

In addition, according to part 2 of article 1241 of the Civil Code (CC) of Ukraine, when calculating the mandatory share in the property, the cost of things of ordinary home furnishings and use is taken into account; the cost of a testament refusal established in favor of a person entitled to a mandatory part; the value of other things and property rights transferred to him as an heir.

Of course, the mandatory share in the inheritance is a guarantee of protecting the rights and interests of minor or disabled children (including adopted), disabled parents (adoptive parents), disabled spouse or spouse. However, one of the problematic issues is precisely the subjective stock of persons who have the right to an obligatory share in the inheritance.

Without the right to disinherit
So, according to the current legislation, the right to an obligatory part belongs to minor, minor, adult, but incapable children of the testator. An unemployed widow, widower and disabled parents also have this right.

Such a list is exhaustive. Thus, paragraph 19 of the decision of the Plenum of the Supreme Court of Ukraine No. 7 dated May 30, 2008 “On judicial practice in cases of inheritance” stipulates that the list of persons who are entitled to a mandatory share is exhaustive and does not need an expanded interpretation.

However, I would like to pay special attention to the children of the testator. There are no questions with young, underage children, since the legislator clearly determines that a child is considered to be a child before the age of 14, and a minor from 14 to 18 years old. Accordingly, until the child reaches the age of majority, parents are required to support him and take care of him. In this case, the right to an obligatory share in the inheritance is fully justified, because by its nature this right is aimed at protecting the interests of those people who cannot support themselves.

Of interest is the concept of "adult disabled children." In practice, a pension certificate is a confirmation of the “disability” status of children. According to paragraph 5 of paragraph 212 of the Instructions on the procedure for performing notarial acts by notaries of Ukraine, disability related to age is checked by passport, certificate of birth status of the civil status authority; disability related to a state of health (1,2,3 disability group) - according to a pension book or a certificate issued by the relevant medical and social examination body.

However, for example, a pension certificate does not always indicate disability. Since in practice very often people of retirement age work, receive wages, that is, they support themselves. Based on the foregoing, it can be concluded that such persons are not entitled to a mandatory share, based on the very nature of such a right.

Moreover, very often there are cases when adult children, despite neither the moral nor the legal law regarding the obligation to support disabled parents, do not even communicate with them, not to mention material or financial support. However, when it comes to inheritance, such “children” are the first to turn to a notary with a pension certificate confirming the so-called incapacity for work, claiming to be a mandatory part of the inheritance.

In this case, the testator has no right to deprive the inheritance of persons who claim a mandatory share in the inheritance by indicating this in the will.

If the testator in the text of the will nevertheless deprives the indicated heirs of the right to an obligatory share, then the will in this part will be declared invalid by the court. In this situation, high-quality legal advice in Kiev will help you.

Inheritance for help
As stated above, the size of the mandatory share in the inheritance is half the share that would belong to the person who has the right to the mandatory part in the inheritance, in case of inheritance by law. However, the legislation of Ukraine provides for cases when the mandatory share can be changed.

So, according to part 2 of article 1241 of the Civil Code of Ukraine, the size of the mandatory share in the inheritance can be reduced by the court taking into account the relationship between these heirs and the testator, as well as other circumstances of significant importance. Such circumstances, for example, may be the heir’s failure to maintain relations with the testator, despite the existing need for this, poor relations with the testator, etc.

In addition, an heir who claims to have an obligatory share in the inheritance can be eliminated from the right to inherit by applying to the court with a claim for removal from the right to inherit.

In particular, part 5 of article 1224 of the Civil Code of Ukraine stipulates that, by a court decision, a person can be removed from the right to inherit by law if it is established that he has avoided providing assistance to the testator, who, due to his advanced age, serious illness or injury, was in a helpless state.

In considering this category of cases, the court must establish both the fact of the person’s refusal to provide assistance to the testator, and the fact that the testator is helpless due to his advanced age, serious illness or injury and the testator’s need for help from this person.

Thus, based on the nature of the right to an obligatory share in the inheritance, it is advisable to amend article 1241 of the Civil Code of Ukraine, which states that the right to the obligatory share in the inheritance is given to the adult disabled children of the inheritor who need material assistance and to whom such assistance was provided by the testator .

Обязательная доля в наследстве является исключением из общего правила о наследовании по завещанию, поскольку это право предоставляет определенной категории лиц возможность наследовать половину доли, которая принадлежала бы каждому из наследников по закону независимо от содержания завещания.

Кроме того, согласно части 2 статьи 1241 Гражданского кодекса (ГК) Украины, при расчете обязательной доли в состав имущества учитывается стоимость вещей обычной домашней обстановки и употребления; стоимость завещательного отказа, установленного в пользу лица, имеющего право на обязательную часть; стоимость других вещей и имущественных прав, перешедших к нему как к наследнику.

Безусловно, обязательная доля в наследстве является гарантией защиты прав и интересов несовершеннолетних или нетрудоспособных детей (в том числе усыновленных), нетрудоспособных родителей (усыновителей), нетрудоспособного супруга или супруги. Однако одним из проблемных вопросов является как раз субъектный склад лиц, которые имеют право на обязательную долю в наследстве.

Без права лишить наследства
Так, согласно действующему законодательству, право на обязательную часть принадлежит малолетним, несовершеннолетним, совершеннолетним, но нетрудоспособным детям наследодателя. Такое право также имеют нетрудоспособная вдова, вдовец и нетрудоспособные родители.

Такой перечень является исчерпывающим. Так, пунктом 19 постановления Пленума Верховного Суда Украины № 7 от 30 мая 2008 года «О судебной практике по делам о наследовании» предусмотрено, что перечень лиц, которые имеют право на обязательную долю, является исчерпывающим и в расширенном толковании не нуждается.

Однако особое внимание хотелось бы уделить детям наследодателя. С малолетними, несовершеннолетними детьми вопросов не возникает, поскольку законодатель четко определяет, что малолетним считается ребенок до достижения 14 лет, несовершеннолетним - с 14 до 18 лет. Соответственно, до достижения ребенком совершеннолетия родители обязаны содержать его, заботиться о нем. В этом случае право на обязательную долю в наследстве оправдано в полной мере, ведь по своей природе это право направлено на защиту интересов тех лиц, которые не могут сами себя содержать.

Интерес вызывает понятие «совершеннолетние нетрудоспособные дети». На практике подтверждением статуса «нетрудоспособности» детей является пенсионное удостоверение. Согласно абзацу 5 пункта 212 Инструкции о порядке совершения нотариальных действий нотариусами Украины, нетрудоспособность, связанная с возрастом, проверяется по паспорту, свидетельству органа гражданского состояния о рождении; нетрудоспособность, связанная с состоянием здоровья (1,2,3 группа инвалидности), - по пенсионной книжке или справке, выданной соответствующим органом медико-социальной экспертизы.

Впрочем, к примеру, пенсионное удостоверение далеко не всегда свидетельствует о нетрудоспособности. Так как на практике очень часто люди пенсионного возраста работают, получают заработную плату, то есть сами себя содержат. На основании вышеизложенного можно сделать вывод, что такие лица не имеют права на обязательную долю, исходя из самой природы такого права.

Более того, очень часто бывают случаи, когда совершеннолетние дети, несмотря ни на моральный, ни на юридический закон относительно обязанности содержать нетрудоспособных родителей, даже не общаются с ними, не говоря уже о материальной или финансовой поддержке. Однако когда речь заходит о наследовании, такие «дети» первыми обращаются к нотариусу с пенсионным удостоверением, подтверждающим так называемую нетрудоспособность, претендуя именно на обязательную часть в наследстве.

При этом наследодатель не имеет права лишить наследства лиц, которые претендуют на обязательную долю в наследстве, путем указания об этом в завещании.

Если же наследодатель в тексте завещания все-таки лишит указанных наследников права на обязательную долю, то завещание в этой части будет признано судом недействительным. В данной ситуации Вам поможет качественная юридическая консультация в Киеве.

Наследство за помощь
Как было изложено выше, размер обязательной доли в наследстве составляет половину доли, которая принадлежала бы лицу, имеющему право на обязательную часть в наследстве, в случае наследования по закону. Однако законодательством Украины предусмотрены случаи, когда обязательная доля может быть изменена.

Так, согласно части 2 статьи 1241 ГК Украины, размер обязательной доли в наследстве может быть уменьшен судом с учетом отношений между этими наследниками и наследодателем, а также других обстоятельств, имеющих существенное значение. Такими обстоятельствами, к примеру, могут быть неподдерживание наследником связей с наследодателем, несмотря на существующую необходимость в этом, плохие отношения с наследодателем и т.д.

Кроме того, наследника, который претендует на обязательную долю в наследстве, можно устранить от права на наследование путем обращения в суд с иском об устранении от права на наследование.

В частности, частью 5 статьи 1224 ГК Украины предусмотрено, что по решению суда лицо может быть устранено от права на наследование по закону, если будет установлено, что оно уклонялось от предоставления помощи наследодателю, который из-за преклонного возраста, тяжелой болезни или увечья был в беспомощном состоянии.

При рассмотрении такой категории дел суд должен установить как факт уклонения лица от предоставления наследодателю помощи, так и факт пребывания наследодателя в беспомощном состоянии в связи с преклонным возрастом, тяжелой болезнью или увечьем и потребностью наследодателя в помощи этого лица.

Таким образом, исходя из природы права на обязательную долю в наследстве, целесообразно внести изменение в статью 1241 ГК Украины, в которой закрепить, что право на обязательную долю в наследстве имеют совершеннолетние нетрудоспособные дети наследователя, которые нуждаются в материальной помощи и которым такая помощь предоставлялась наследодателем.
