Necessary defense of the home as a circumstance precluding the criminality of the act under US criminal law

The inviolability of the home is an essential prerequisite for protection against arbitrary interference in private affairs by any person. Without the creation of reliable legal guarantees of the inviolability of the home, it becomes impossible to protect not only personal or family secrets, but also life, health, property, and other benefits. In our opinion, the most effective legal means of ensuring the inviolability of the home is the institution of necessary defense.

Over the past decades, the doctrine of the necessary defense of the home in the Russian science of criminal law was created, as a rule, under the direct influence of the criminal law of Western states, primarily, such as the United Kingdom, France and the United States. The existing legal structures of the differentiated defense regime in these countries continue to attract the constant attention of domestic researchers, based on which it would be possible to improve the Russian criminal law and the practice of its application. In this regard, we believe, it is necessary to consider in more detail the doctrinal and legislative provisions that define the specifics of the necessary defense of the home under US criminal law, as being of the greatest interest due to the high degree of concretization, which not only effectively limits the discretion of the law enforcement officer, but also ensures the convenience of perception of the norm by its main addressees (potential defenders).

The institution of the necessary defense of the home is closely related to the necessary defense of property, which is why North American legal practice sometimes allows them to be mistakenly confused. However, in contrast to the defense of property, the institution of home defense protects not just the right to certain property, but security and privacy. According to I. D. Kozochkin, the common law allows for the necessary defense against the eviction of the landlord, which additionally protects the right to housing itself, and not only the inviolability of the latter. Let us pay attention to the fact that the object of protection also determines the special circumstances of the implementation of the right of defense. This is enough to create a more preferential legal regime for harming the aggressor, although the two institutions may overlap.

It is also necessary to distinguish the necessary defense of the home from the necessary defense of the individual (self-defense and protection of third parties), since the latter involves the reflection of only a violent attack, that is, an attack. The specific feature of the home defense rule is that it should be applied when the attack itself is not yet quite obvious or directly threatening (for example, if it is at the stage of preparation).

In common law, housing is defined as the place of permanent de facto residence of at least one person. The term "dwelling" includes buildings and outbuildings on the adjacent plot. Abandoned houses are not recognized as housing.

The statutory law of individual states may define housing in a different way. For example, "any buildings or part of buildings that are used as a house or permanent residence, and part of the land plot or place on which the dwelling is located, intended for household needs... other structures available near the actual residential buildings, such as access roads, sidewalks, swimming pools, terraces, courtyards, fences, storerooms, garages and basements" (paragraph "h" of part 1 of Article 895.07 of the General Provisions on Claims and Processes for all Courts). Wisconsin); "a building that is usually occupied by a person who spends the night in it" (part 3 of Article 140.00 of the Criminal Code). New York, 1965), and here the dwelling is defined through the concept of "structure", which, in addition to the usual meaning of Part 2 of Article 140.00 of the Criminal Code of Ukraine. New York refers to "any structure, vehicle, or watercraft used for the overnight stay of people, or for carrying out business activities on board, or used as an elementary or high school, or an indoor truck, or an indoor trailer for a truck. Where a structure consists of two or more units protected or occupied separately, each unit should be considered both as a separate structure in essence and as part of the main structure." The norm, which is close to the New York one by design, is also contained in part " a "of Article 53" a " -100 of the Criminal Code. Connecticut (Section 53a of the Basic Laws) Connecticut), but it specifies that a" structure " is recognized as a dwelling regardless of the actual presence of the person residing in it. In addition, aircraft, trailers, railway wagons, as well as "any other structure or vehicle or any structure with a valid certificate of acceptance into operation"are equated to the structure, and therefore to the dwelling. According to paragraph " a " of part 5 of Article 776.013 of the Criminal Code. Florida, a dwelling is "a structure or vehicle of any kind, including any adjoining storeroom, whether the structure or vehicle is temporary or permanent, movable or stationary, having a roof, including a tent, and designed for the overnight stay of people."

The original common law rule on home defense, now called "extended", is as follows: the defender is justified in using deadly violence against the intruder if it is reasonably believed that the intruder intends to unlawfully and immediately invade the home of the defender, or intends to commit felony inside the home or cause any bodily injury to one of the residents, and deadly violence is necessary to prevent the invasion of the home.
This rule is reproduced by the statutory law of some states, characterized by I. D. Kozochkin as "the most conservative", to which he ranks Georgia, Minnesota, Florida and Utah. As an example, we give part 3, 4 of Article 104 of the Criminal Code. Maine (Section 17-"A" of the Amended Laws of the State of Maine) " Use of violence in the defense of buildings with land plots and adjacent buildings (premises)»:
"3. A person who owns or exercises control over a place of residence, or a person who is allowed or permitted to stay in it, is justified in using deadly violence against another person: ... B. When a person reasonably believes that deadly violence is necessary to prevent or stop the commission of a criminal trespass (crimi-nal trespass) by such other person as the person reasonably believes: (1) To have entered or attempted to enter the place of residence or to have remained secretly in the place of residence without a decision or permission to do so; and (2) Committing or likely intending to commit another crime (crime) in the place of residence.
4. A person has the right to use deadly violence in accordance with paragraph (B) of part 3 of this article only if he first warns the person against whom such deadly violence is to be used to stop the criminal trespass, and the violator does not comply with the request immediately, unless the person reasonably believes that it would be dangerous for him or a third person to do so." The above statutory provision equates the presence of a stranger in a home without permission to illegal entry, apparently, even in cases where such a person was originally in the home legally, but did not leave at the request of the defender. It is likely that this rule was formulated under the direct influence of English doctrine .

The method of entry into the home (violent, deceptive, secret, open, with the physical movement of the perpetrator, with the use of remote influence tools, with or without overcoming obstacles), as well as the number of encroachers, do not matter. So, for example, in part 2 of Article 76-2-405 of the Criminal Code. Utah (Section 76 of the Code) Utah), "Violence in the defense of a dwelling" is enshrined: "A person who uses violence or deadly violence in the defense of a dwelling, for the purpose of both civil and criminal proceedings, is presumed to have acted reasonably and under the influence of a reasonable fear of imminent danger of causing death or serious bodily injury, if the penetration or attempted penetration is illegal and is committed or begins to be committed by the use of violence, or by rough and forceful means, or secretly or by deception, or with the purpose of committing a felony." Similar in design standards are contained in paragraph "a" of Part 1 of Article 776.013 of the Criminal Code. Florida and part " a " of Article 7.2 of the Criminal Code. Illinois, 1961, but they do not mention a secret or deceptive method of entry.

It should be noted that forcible entry into a home or the immediate threat of such entry can simultaneously act as a basis for the exercise of the right of defense of the individual, in these circumstances also allowing the intruder to cause death regardless of the degree of danger of the encroachment and not requiring an attempt to retreat before using deadly violence, but also imposing additional restrictions on the provocation of an attack (in some cases). This rule is called "castle exception" (palace clause) or "castle doctrine" (fortress doctrine). Let us consider the specifics of encroachment in the form of arbitrary deprivation of housing, which is another basis for the realization of the right of necessary defense. So, for example, item " a " part 1 of Article 776.013 of the Criminal Code. Florida allows the use of deadly violence if the assailant "forced or attempted to force another person out of a dwelling, residence, or occupied vehicle against their will." Apparently, in this case, the encroachment should consist both in the physical (violent) expulsion of the defender from his home, and in the damage or destruction of the latter. We believe that these encroachments can also be committed with the help of remote control tools (for example," smoking out " residents with toxic fumes and aerosols, the use of acoustic means, the destruction of walls with heavy construction equipment)

Please note that the original rule is specifically formulated in such a way that the requirement of cash encroachment applies only to actions aimed at invading the home, and not to actions that the encroaching person intends to commit inside the home. It also does not matter whether the perpetrator intends to commit a violent or non-violent felony inside the dwelling. Moreover, it is not necessary that the felony planned by the intruder is directed against the defender himself or other residents (for example, the intruder enters the home in order to organize an ambush to kill an outsider). All other things being equal, these features allow you to cause harm to the encroaching person earlier than is possible in self-defense (personal defense) or the protection of third parties. Moreover, when defending a home, it is allowed to cause death to the encroaching person, even if the encroachment is not associated with deadly violence or its threat, as well as with any violence or the threat of violence in general, that is, the requirement of proportionality of the encroachment to the harm caused to repel it is eliminated. This formulation of the norm can solve the problem that arises when the same actions to enter a home can, depending on the direction of the intent of the intruder, be both preparation for a crime (for example, murder or rape) and an attempt to commit a crime (for example, theft or robbery). However, we recall that causing harm to an encroaching person is lawful only if it was the only opportunity to prevent entry into the home.

Thus, the subsidiarity of the defense of the dwelling is preserved. But in this situation, this circumstance, as we believe, does not in the least hinder the exercise of the right of defense. After all, the requirement to stop the encroachment, as an attempt by the defender to stop the encroachment in another way, can be carried out, including by putting the weapon in readiness (sending a cartridge into the chamber, cocking the firing mechanism), producing a warning shot, pointing the weapon at the encroaching person, and other similar actions. If, despite the warning, the attack continues, then, thanks to the elimination of the condition of proportionality, shooting to kill will be legitimate. At the same time, an attempt to stop the encroachment in a way that does not involve causing harm to the encroaching person is not required, when it would be obviously useless or would pose a danger. That is why the use of violence becomes necessary.

The preferential legal regime of home defense was due to a number of factors. First, the special significance of the home as a good protected by criminal law (indeed, when an outsider tries to enter the home, not only the property interests of the defender and other residents, but also their life and health, are at risk at the same time). Secondly, considerations of law enforcement practice and justice require that citizens be given the legal opportunity to defend their rights in such situations by the most effective, and therefore potentially most harmful, means (because it is impossible to demand from the defender accurate knowledge of the intentions of the person trying to enter his home).

Assessing the positive features of the norm on the necessary defense of the home, it should not be assumed that initially it provides for the protection of only the defender's own home, but not the home of third parties. In the latter case, the defender will be forced to act according to the rules of necessary property defense for immediate response (often with restrictions established for the defense of third-party property, if such is allowed at all!), which in itself excludes the possibility of using deadly violence, or wait until the encroachment develops into an attack on the residents, giving the right to protect the life and health of third parties (again, in compliance with specific conditions of legality). Although the recognition of the act of the defender as lawful is also permissible on the basis of the norm on the suppression of a crime (crime prevention), which is part of the institute of circumstances that exclude the criminality of the act of law enforcement officers (law enforcement defenses). However, the defender can also distract the intruder in order to exercise the right to self-defense, which allows him to harm him immediately (that is, even before committing the actions intended by the intruder inside the home). However, interference in the conflict should not be regarded as a provocation of an encroachment for the purpose of reprisal. In addition, all of the above options for responding to the defender are permissible only if it is impossible to stop the encroachment in any other way (for example, by demanding to stop the encroachment, appealing to the authorities for protection, and so on).

However, in the criminal laws of only a few states, the original common law rule was reproduced verbatim. So, for example, in Article 609.065 of the Criminal Code of the State of Minnesota "Lawful deprivation of life" it is stated: "The deliberate taking of the life of another person is not permitted ... except in cases where it is necessary ... to prevent the commission of a felony in the place of residence of the acting person." A similar provision is contained in part 1 of Article 76-2-405 of the Criminal Code of the State of Utah.

Another approach to determining the proper defender is used in Articles 22-16-34 of the Criminal Code. South Dakota (Section 22 of the Laws of the State of South Dakota) "Lawful murder; Obstruction of attempted murder; Obstruction of felony against a person or in a residential building", which provides that "murder is lawful if it is committed by any person to prevent any attempt to ... commit any felony... the subject of which is any residential building where such person is located or committed in this residential building". As you can see, the defender here can be not only a tenant or landlord, but also a guest who is in the home at the time of the act of defense.

The above "extended" norm is gradually being replaced by a narrower one. Its specificity lies in the fact that it is decided to use deadly violence to prevent entry into a home only if the defender has a reasonable belief that the intruder intends to commit any violent felony inside the home. Note that the late rule, although it restricts the possibility of causing death to the attacker, still retains a preferential character, since it is not required that the attacker uses deadly violence or threatens them. The objective criterion of a well-founded belief is established on the basis of the presence of a weapon in the encroaching person, the utterance of threats on his part, and other similar circumstances of the encroachment. There is already a convergence of the institutions of home defense with self-defense in common law, where it is also allowed to use deadly violence even from an attack that is not coupled with such violence or the threat of it, if the attack occurs within the home of the defender.

The narrow rule on the defense of the home is also reproduced by the statutory law of some states. For example, Article 53 " a " -20 of the Criminal Code. Connecticut" The use of physical violence in the protection of buildings with land plots and adjacent buildings (premises) " allows the defender to use deadly violence "when he reasonably believes it is necessary to prevent an attempt by the violator to commit arson or any violent crime (crime of violence), or... to prevent or stop illegal forced entry into his home, as defined in art. 53 " a "-100, or to the place of work, for the sole purpose of such suppression or termination"; item "d" of Part II of Article 627.4 of the Criminal Code of Ukraine. New Hampshire (Section 62 of the Laws of the United States) New Hampshire ) "Physical violence in the defense of the individual" allows for deadly violence when the defender is reasonably convinced that the attacker "intends to use any unlawful violence in the commission of a felony against the actor in the home of such a person or on the land plot adjacent to the home". The last cited rule is even more restrictive, since it provides that the felony that the intruder intends to commit inside the home must not only be violent, as required by common law, but also directed against the defender.

Despite the newly introduced restrictions, there is a quite positive trend towards extending the preferential defense regime not only to housing, but also to places of work, places of business (territories of commercial enterprises), as well as motor vehicles belonging to the defender. As an example, we give the item " ar "part 1" m " of Article 939.48 of the Criminal Code. Wisconsin "Self-Defense and Protection of Others", according to which deadly violence is allowed if: «1. The person against whom the violence was used tried to unlawfully forcibly enter the home of the actor, a mechanical vehicle or a place of business activity, and the actor was present in the home, vehicle or place of business activity and was aware or reasonably believed that an unlawful forcible entry was taking place. 2. The person against whom the violence was used was present in the home of the actor, the motor vehicle or the place of business activity after the illegal forcible entry there, and the actor was present in the home, the vehicle or the place of business activity and was aware or reasonably believed that the person unlawfully forcibly entered the home of the actor, the motor vehicle or the place of business activity."

The Model Criminal Code of the United States (US Model Penal Code) (hereinafter referred to as the MUC) takes the opposite approach, and the defense of the home is considered under the rules on the defense of property with only some reservations. In part 3 of Article 3.11 of the Criminal Code, a dwelling is defined "as any building or structure, at least portable or temporary, or any part of it, which at this time (at the time of the commission of the act of defense – D. V.) is the home or place of residence of a person". Item " d " of part 3 of art. 3.06 The MUC allows the death of an encroaching person in the defense of property if the defender believes (has a subjective belief) that the encroaching person: 1. intends to deprive the defender of actual possession of the dwelling without claiming ownership; or 2. intends to carry out arson, night break-in and entry into the dwelling with the purpose of committing felony (burglary), robbery, criminal theft inside the dwelling or damage to property related to felonies and 2 (1). the encroaching person used deadly violence or threatened them against or in the presence of the defender or 2 (2). the use of non-lethal violence to prevent the commission of a crime would pose a significant risk of serious injury to the defender or other person.

Paragraph 1 cancels the requirement of proportionality of harm, being consistent only with the special importance of the object of protection-the home. Paragraph 2 should be applied in conjunction with paragraphs 2 (1) or 2 (2). In the latter two cases, the development of property defense into self-defense or protection of third parties is clearly visible. Thus, no exceptions to the principle of proportionality are made by the norm of the FLOUR except for paragraph 1 of paragraph " d " of part 3 of Article 3.06.

In addition to these approaches, in the statutory law of some states, there is a third one, according to which deadly violence in the defense of a home is allowed if the intruder is allowed to commit only felonies specifically stipulated by law, and not necessarily violent ones (although among the felonies, arson, breaking and entering are always called). In general, this approach can be called "hybrid" or "intermediate". As an example, we give Article 35.20 of the Criminal Code. New York " Exculpatory circumstance; the use of physical violence in the defense of buildings with land plots and adjacent buildings (premises) and the defense of the individual in the course of breaking and entering (burglary)»:
"1. Any person has the right to use physical violence against another person when he or she reasonably believes that such violence is necessary to prevent or stop what he or she reasonably believes is the commission or attempted commission of a crime by such another person related to damage to buildings with land plots and adjacent buildings. Such a person is entitled to use violence of any degree, with the exception of deadly physical violence, which he or she reasonably believes is necessary for such a purpose, and is entitled to use deadly physical violence if he or she reasonably believes it is necessary to stop or stop the commission or attempt to commit arson…
3. A person who owns or exercises control over a dwelling or occupied structure, or a person who is allowed or permitted to stay in it, reasonably believes that another person commits or attempts to commit breaking and entering into such a dwelling or structure, has the right to use deadly violence against such another person when he or she reasonably considers it necessary to prevent or stop the commission or attempt to commit such breaking and entering."

It is noteworthy that only part 3 of Article 35.20 of the Criminal Code is specifically devoted to the issues of the necessary defense of the home. New York, which provides for trespassing in the form of breaking and entering. However, in part 1 of Article 35.20 of the Criminal Code. New York, in our opinion, contains a more general rule that is quite applicable to the defense of the home, if the intruder tries to carry out arson. It is significant that in this case, due to the greater degree of danger of encroachment, the law does not establish requirements for a proper defender, defining it, in contrast to Part 3 of Article 35.20 of the Criminal Code. New York, just like " any face." Similar norms are found in Article 11.81.350 of the Criminal Code. Alaska (section 11 of the Code of Laws) Alaska).

Summing up the consideration of the features of the necessary defense of the home under US criminal law, it should be said that due to the long historical development in common law, and then in the statutory norms, this institution has received a sufficiently high degree of elaboration, which allowed us to take into account the typical circumstances of encroachments on the home and provide firm legal guarantees for the defender. The experience accumulated by the North American legal science, in our opinion, can be regarded as universal, quite suitable for the perception of the domestic legislator and law enforcement officer. So, for example, the analyzed construction of the norm on the defense of the home makes it possible to practically reflect the encroachment without raising doubts about its existence and the related question about the stages of implementation of the encroaching intent.

As we believe, Russian science has so far failed to create a sufficiently successful original approach to the necessary defense of the home. The reason for this was probably the desire to obtain an abstract norm that would regulate the widest range of "encroachment – defense" situations. As a typical example, we give the opinion of M. A. Yakunkova regarding encroachments in the form of secret penetration into the home: "If the circumstances of the case – the time and place of action, the appearance and weapons of the offender-allow us to believe that ... the aggression of the criminal can turn on the person's personality... then a law-abiding citizen, without first revealing himself, can use violence… The considered situation quite falls under the action of the institute of "pre-emptive strike". Causing sudden bodily harm to a clandestine night thief who is frankly not going to come into conflict with anyone should be considered a deliberate crime on general grounds."

E. A. Baranova (penetration must be violent), S. V. Parkhomenko (encroachment must be in the form of theft at night by at least two persons, violent robbery by at least two persons, robbery or night penetration by breaking in or violence) and R. M. Yusupov (penetration must be committed by breaking in, violence or a group of persons) are also in favor of restricting the rights of the defender in the protection of the home by establishing additional requirements, only if they comply with which it is allowed to cause death to the intruder.

We have reasonable objections to the validity of these approaches. After all, law as a social regulator should not go against the natural need for physical protection of the home, at least as long as it is the legitimate interests that are being defended. For this reason, we support the conceptual assumption of causing death to the intruder when entering a dwelling or other inhabited space without special restrictions regarding the number of intruders, their condition and personality characteristics, time, situation, method, means and instrument of encroachment, as well as the requirements for a proper defender. A similar point of view is expressed, in particular, by A. P. Dmitrenko, V. N. Vinokurov and S. I. Nikulin. But it is also quite obvious that the right to defend the home should not be recognized if the person referring to it carries out illegal activities or hinders a representative of the authorities acting within the scope of their authority. In addition, it would be reasonable to borrow North American definitive norms that define the concept of housing quite broadly.

Необходимая оборона жилища как обстоятельство, исключающее преступность деяния по уголовному праву США

Неприкосновенность жилища является важнейшей предпосылкой для защиты от произвольного вмешательства в частные дела со стороны любых лиц. Без создания надежных юридических гарантий неприкосновенности жилища невозможной становится охрана не только личной или семейной тайны, но и жизни, здоровья, имущества, а также других благ. На наш взгляд, наиболее эффективным правым средством обеспечения неприкосновенности жилища представляется институт необходимой обороны.

На протяжении последних десятилетий доктрины необходимой обороны жилища в российской науке уголовного права создавались, как правило, под непосредственным влиянием уголовного права западных государств, прежде всего, таких как Великобритания, Франция и США. Неизменное внимание отечественных исследователей продолжают привлекать существующие в этих странах юридические конструкции дифференцированного режима обороны, основываясь на которых можно было бы усовершенствовать российский уголовный закон и практику его применения. В этой связи, как мы полагаем, следует более детально рассмотреть доктринальные и законодательные положения, определяющие специфику необходимой обороны жилища по уголовному праву США, как представляющие наибольший интерес благодаря высокой степени конкретизации, чем не только эффективно ограничивается усмотрение правоприменителя, но и обеспечивается удобство восприятия нормы ее главными адресатами (потенциальными обороняющимися).

Институт необходимой обороны жилища (defense of habitation) тесно связан с необходимой обороной имущества (defense of property), в силу чего североамериканская юридическая практика иногда допускает их ошибочное смешение. Однако в противоположность обороне имущества институтом обороны жилища охраняется не просто право на определенное имущество, но безопасность и неприкосновенность частной жизни. По словам И.Д. Козочкина, общее право допускает необходимую оборону и против выселения домовладельца, чем дополнительно охраняется само право на жилище, а не только неприкосновенность последнего. Обратим внимание на то, что объект защиты предопределяет и особые обстоятельства реализации права обороны. Этого достаточно, чтобы создать более льготный юридический режим для причинения вреда посягающему, хотя оба института могут пересекаться.

Также следует отличать необходимую оборону жилища от необходимой обороны личности (самообороны и защиты третьих лиц), поскольку последняя предполагает отражение лишь насильственного посягательства, то есть нападения. Специфика нормы об обороне жилища заключается в том, что она должна применяться, когда само нападение еще не является вполне очевидным или непосредственно угрожающим (например, если оно находится на стадии приготовления).

В общем праве жилище определяется как место постоянного фактического проживания хотя бы одного лица. В понятие «жилище» включаются здания и хозяйственные постройки на прилегающем участке. Заброшенные дома жилищем не признаются.

Статутное право отдельных штатов может определять жилище иным образом. Например, «любые строения или часть строений, которые используются как дом или постоянное место жительства, и часть земельного участка или места, на котором находится жилище, предназначенная для бытовых нужд… другие имеющиеся около собственно жилых строений сооружения, такие как подъездные пути, тротуары, плавательные бассейны, террасы, внутренние дворы, изгороди, кладовки, гаражи и подвалы» (п. «h» ч. 1 ст. 895.07 Общих положений об исках и процессах для всех судов шт. Висконсин); «строение, которое обычно занято лицом, ночующим в нем» (ч. 3 ст. 140.00 УК шт. Нью-Йорк 1965 г.), причем здесь жилище определяется через понятие «строение», к которым помимо обычного значения ч. 2 ст. 140.00 УК шт. Нью-Йорк относит «любое сооружение, транспортное средство или водное судно, используемые для ночевки людей, или для осуществления предпринимательской деятельности на его борту, или используемые как начальная или средняя школа, или крытый грузовой автомобиль, или крытый прицеп для грузового автомобиля. Там, где строение состоит из двух или более единиц охраняемых или занимаемых отдельно, каждую единицу следует считать одновременно как отдельным строением по существу, так и частью основного строения». Флорида, жилищем является «строение или транспортное средство любого вида, включая любую примыкающую кладовку, является ли строение или транспортное средство временным или постоянным, передвигающимся или неподвижным, имеющее крышу, включая палатку, и созданное для ночевки людей».

Первоначальная норма общего права об обороне жилища, ныне именуемая «расширен-ной», сводится к следующему: обороняющийся оправдывается в применении смертельного насилия против посягающего, если обосновано полагает, что посягающий намеревается незаконно и немедленно вторгнуться в жилище обороняющегося либо намеревается совершить внутри жилища фелонию или причинить любое телесное повреждение кому-нибудь из жильцов, и смертельное насилие необходимо, чтобы предотвратить вторжение в жилище.
Данная норма воспроизводится статутным правом некоторых штатов, характеризуемых И.Д. Козочкиным как «наиболее консервативные», к которым он причисляет Джорджию, Миннесоту, Флориду и Юту. В качестве примера приведем ч. ч. 3, 4 ст. 104 УК шт. Мэн (раздел 17-«A» Уточненных законов шт. Мэн) «Применение насилия при обороне зданий с земельными участка-ми и прилегающими постройками (premises)»:
«3. Лицо, владеющее или осуществляющее контроль над местом проживания, или лицо, которому разрешено или дозволено находиться в нем, оправдывается в применении смертельного насилия против другого лица: … B. Когда лицо обоснованно полагает, что смертельное насилие необходимо чтобы пресечь или прекратить совершение преступного нарушения владения (crimi-nal trespass) таким другим лицом, которое лицо обоснованно полагает: (1) Проникшим или пытающимся проникнуть в место проживания или тайно оставшимся в месте проживания без раз-решения или дозволения на то; и (2) Совершающим или вероятно намеренным совершить другое преступление (crime) в месте проживания.
4. Лицо вправе применить смертельное насилие в соответствии с пунктом «B» части 3 на-стоящей статьи, только если сначала предупредит лицо, против которого подлежит применению такое смертельное насилие, чтобы прекратить преступное нарушение владения, а нарушитель не подчинится требованию немедленно, за исключением случаев, когда лицо обоснованно полагает, что делать предупреждение было бы опасным для него или третьего лица».

Изложенная статутная норма приравнивает нахождение постороннего лица в жилище без разрешения к незаконному проникновению, по всей видимости, даже в тех случаях, когда такое лицо первоначально находилось в жилище законно, но не удалилось по требованию обороняющегося. Вероятно, что указанное правило было сформулировано под непосредственным влиянием английской доктрины .

Способ проникновения в жилище (насильственный, обманный, тайный, открытый, с физическим перемещением виновного, с использованием орудий дистанционного воздействия, с преодолением препятствий или без такового), а равно и количество посягающих значения не имеют. Так, например, в ч. 2 ст. 76-2-405 УК шт. Юта (раздел 76 Кодекса шт. Юта), «Насилие при обороне жилища» закреплено: «Лицо, применяющее насилие или смертельное насилие при обороне жилища, для цели как гражданского, так и уголовного судопроизводства предполагается действовавшим обоснованно и под влиянием обоснованного страха неминуемой опасности причинения смерти или тяжкого телесного повреждения, если проникновение или попытка проникновения является противоправной и совершается или начинает совершаться путем применения насилия, или грубым и силовым способом, или же тайно или путем обмана, или с целью совершения фелонии». Близкие по конструкции нормы содержатся в п. «a» ч. 1 ст. 776.013 УК шт. Флорида и ч. «a» ст. 7.2 УК шт. Иллинойс 1961 г., однако в них не говорится о тайном или обманном способе проникновения.

Нужно отметить, что насильственное проникновение в жилище или непосредственная угроза такого проникновения может одновременно выступать и как основание для реализации права обороны личности, при данных обстоятельствах также дозволяющего причинить посягающему смерть вне зависимости от степени опасности посягательства и не требующего попытки отступить перед применением смертельного насилия, но накладывающего и дополнительные ограничения относительно провокации нападения (в ряде случаев). Такая норма получила название «castle exception» (дворцовая оговорка) или «castle doctrine» (доктрина крепости).

Рассмотрим специфику посягательства в форме произвольного лишения жилища, выступающего еще одним основанием реализации права необходимой обороны. Так, например, п. «a» ч. 1 ст. 776.013 УК шт. Флорида дозволяет применение смертельного насилия, если посягающий «вытеснил или пытался вытеснить против воли другое лицо из жилища, места пребывания или занятого транспортного средства». По всей видимости, в этом случае посягательство должно заключаться как в физическом (насильственном) изгнании обороняющегося за пределы его жилища, так и в повреждении или уничтожении последнего. Полагаем, что указанные посягательства могут совершаться и с помощью орудий дистанционного воздействия (например, «выкуривание» жильцов ядовитыми дымами и аэрозолями, применение акустических средств, разрушение стен тяжелой строительной техникой).

Обратим внимание на то, что первоначальная норма специально сформулирована таким образом, что требование наличности посягательства применяется только к действиям, направленным на вторжение в жилище, а не к действиям, которые посягающий намеревается совершить внутри жилища. Также не имеет значения, намерен ли виновный совершить внутри жилища насильственную или ненасильственную фелонию. Причем не обязательно, чтобы планируемая посягающим фелония была направлена против самого обороняющегося или других жильцов (на-пример, посягающий проникает в жилище с целью организации засады для убийства постороннего лица). При прочих равных условиях указанные особенности позволяют причинить вред посягающему лицу раньше, чем это возможно при самообороне (личной обороне) или защите третьих лиц. Более того при обороне жилища допускается причинение посягающему смерти, даже если посягательство не сопряжено со смертельным насилием или его угрозой, а равно с любым насилием или угрозой насилием вообще, то есть устраняется требование соразмерности посягательства вреду, причиненному для его отражения. Данная формулировка нормы способна решить проблему, возникающую, когда одни и те же действия по проникновению в жилище могут, в зависимости от направленности умысла посягающего, являться как приготовлением к преступлению (например, убийству или изнасилованию), так и покушением на преступление (например, кражу или грабеж). Однако напомним, что причинение вреда посягающему лицу является правомерным, только если это было единственной возможностью для пресечения проникновения в жилище.

Таким образом, субсидиарность обороны жилища сохраняется. Но в данной ситуации указанное обстоятельство, как мы полагаем, нисколько не препятствует реализации права обороны. Ведь требование о прекращении посягательства, как попытка обороняющегося пресечь посягательство иным способом, может осуществляться в том числе путем приведения в готовность оружия (досылание патрона в патронник, взведение ударного механизма), производства предупреди-тельного выстрела, наведения оружия на посягающего и других подобных действий. Если не-смотря на предупреждение посягательство продолжается, то, благодаря устранению условия о со-размерности, стрельба на поражение будет правомерной. В то же время попытка прекратить посягательство способом, не связанным с причинением посягающему вреда, не требуется, когда она была бы заведомо бесполезной или представляла бы опасность. Именно поэтому применение насилия становится необходимым.

Льготный правовой режим обороны жилища был обусловлен рядом факторов. Во-первых, особая значимость жилища как охраняемого уголовным правом блага (действительно, при по-пытке постороннего лица проникнуть в жилище под угрозу одновременно ставятся не только имущественные интересы обороняющегося и других жильцов, но еще их жизнь и здоровье). Во-вторых, соображения правоприменительной практики и справедливости требуют предоставления гражданам юридической возможности защищать свои права в таких ситуациях наиболее действенными, а значит и потенциально наиболее вредоносными, средствами (ведь невозможно требовать от обороняющегося точной осведомленности о намерениях лица, пытающегося проникнуть в его жилище).

Оценивая положительные особенности нормы о необходимой обороне жилища, нельзя за-бывать, что изначально она предусматривает защиту только собственного жилища обороняющегося, но не жилища третьих лиц. В последнем случае обороняющийся будет вынужден для немедленного реагирования действовать по правилам необходимой обороны имущества (зачастую с ограничениями, установленными для обороны имущества третьих лиц, если таковая вообще разрешена!), что уже само по себе исключает возможность применения смертельного насилия, либо выжидать до тех пор, пока посягательство не перерастет в нападение на жильцов, дающее право на защиту жизни и здоровья третьих лиц (опять же таки, с соблюдением специфических условий правомерности). Хотя признание деяния обороняющегося правомерным допустимо и на основании нормы о пресечении преступления (crime prevention), входящей в институт обстоятельств, исключающих преступность деяния правоохранительных служащих (law enforcement defenses). Впрочем, еще обороняющийся может отвлечь на себя посягающего, чтобы воспользоваться правом на самооборону, позволяющим незамедлительно (то есть еще до совершения внутри жилища задуманных посягающим действий) причинить ему вред. Однако при этом вмешательство в конфликт не должно быть расценено как провокация посягательства с целью расправы. К тому же все перечисленные варианты ответных действий обороняющегося допустимы лишь при невозможности пресечь посягательство иным способом (например, требованием прекратить посягательство, обращением к властям за защитой и так далее).

Однако в уголовных законах лишь некоторых штатов первоначальная норма общего права была воспроизведена дословно. Так, например, в ст. 609.065 УК шт. Миннесота «Правомерное лишение жизни» говорится: «Умышленное лишение жизни другого человека не разрешено… исключая случаи, когда это необходимо при… пресечении совершения фелонии в месте проживания действующего лица». Аналогичное положение содержится и в ч. 1 ст. 76-2-405 УК шт. Юта.

Другой подход к определению надлежащего обороняющегося применяется в ст. 22-16-34 УК шт. Южная Дакота (раздел 22 свода законов шт. южная Дакота) «Правомерное убийство; Воспрепятствование покушению на убийство; Воспрепятствование фелонии против личности или в жилом доме», предусматривающей, что «убийство является правомерным, если оно совершается любым лицом для воспрепятствования любому покушению на… совершение любой фелонии… предметом которой является любой жилой дом, где находится такое лицо или совершаемой в этом жилом доме». Как видно, обороняющимся здесь может быть не только жилец или домовладелец, но и гость, находящийся в жилище на момент акта обороны.

Вышеизложенная «расширенная» норма постепенно вытесняется более узкой. Ее специфика заключается в том, что смертельное насилие для пресечения проникновения в жилище раз-решено применять только при наличии у обороняющегося обоснованного убеждения о намерении посягающего лица совершить любую насильственную фелонию внутри жилища. Заметим, что поздняя норма хотя и ограничивает возможность причинения посягающему смерти, но все же сохраняет льготный характер, поскольку не требуется, чтобы посягающий применял именно смертельное насилие или угрожал им. Объективный критерий обоснованного убеждения устанавливается на основании наличия оружия у посягающего, высказывания угроз с его стороны и других подобных обстоятельств посягательства. Здесь уже наблюдается смыкание институтов обороны жилища с самообороной в общем праве, где также допускается применять смертельное насилие даже от нападения, не спряженного с таким насилием или угрозой им, если нападение происходит в пределах жилища обороняющегося.

Узкая норма об обороне жилища воспроизводится и статутным правом некоторых штатов. Например, ст. 53«a»-20 УК шт. Коннектикут «Применение физического насилия при защите зданий с земельными участками и прилегающими постройками (premises)» разрешает обороняющемуся применять смертельное насилие, «когда он обоснованно полагает таковое необходимым, чтобы пресечь покушение на совершение нарушителем поджога или любого насильственного преступления (crime of violence), или… чтобы пресечь или прекратить неправомерное насильственное проникновение в свое жилище, как определено в ст. 53«a»-100, или на место работы, с единственной целью такого пресечения или прекращения»; п. «d» ч. II ст. 627.4 УК шт. Нью-Гемпшир (раздел 62 законов шт. Нью-Гемпшир ) «Физическое насилие при обороне личности» допускает смертельное насилие, когда обороняющийся обоснованно убежден, что посягающий «намерен применить любое неправомерное насилие при совершении фелонии против действующего лица в жилище такого лица или на прилегающем к жилищу земельном участке». Последняя процитированная норма носит еще более ограничительный характер, поскольку предусматривает, что фелония, которую посягающий намерен совершить внутри жилища должна быть не только насильственной, как того требует общее право, но и направленной против обороняющегося.

Несмотря на вновь вводимые ограничения, появилась и вполне положительная тенденция к распространению льготного режима обороны не только на жилище, но и на места работы, места предпринимательской деятельности (территории коммерческих предприятий), а также механические транспортные средства, принадлежащие обороняющемуся. В качестве примера приведем п. «ar» ч. 1 «m» ст. 939.48 УК шт. Висконсин «Самооборона и защита других лиц», согласно которому смертельное насилие дозволено, если: «1. Лицо, против которого было применено насилие, пыталось неправомерно насильственно проникнуть в жилище действующего лица, механическое транспортное средство или на место предпринимательской деятельности, а действующее лицо присутствовало в жилище, транспортном средстве или на месте предпринимательской деятельности и сознавало или обоснованно полагало, что происходит неправомерное насильственное проникновение. 2. Лицо, против которого было применено насилие, находилось в жилище действующего лица, механическом транспортном средстве или на месте предпринимательской деятельности после незаконного насильственного проникновения туда, а действующее лицо присутствовало в жилище, транспортном средстве или на месте предпринимательской деятельности и сознавало или обосновано полагало, что лицо неправомерно насильственно проникло в жилище действующего лица, механическое транспортное средство или на место предпринимательской деятельности».

В Модельном Уголовном Кодексе США (US Model Penal Code) (далее – МУК) наблюдается противоположный подход, и оборона жилища рассматривается по правилам об обороне имущества лишь с некоторыми оговорками. В ч. 3 ст. 3.11 МУК жилище определяется «как любое здание или строение, хотя бы переносимое или временное, или какая-либо его часть, которые в данное время (на момент совершения акта обороны – Д.В.) являются домом или местом жительства лица». Пункт «d» ч. 3 ст. 3.06 МУК допускает причинение смерти посягающему лицу при обороне имущества, если обороняющийся полагает (имеет субъективное убеждение), что посягающий: 1. намерен лишить обороняющегося фактического владения жилищем, не заявляя иск о праве владения; или 2. намерен осуществить поджог, ночной взлом и проникновение в жилище с целью совершения фелонии (burglary), грабеж, преступную кражу внутри жилища или повреждение имущества, относящееся к фелониям и 2 (1). посягающий применял смертельное насилие или угрожал им против или в присутствии обороняющегося или 2 (2). применение несмертельного насилия для предотвращения совершения преступления создавало бы для обороняющегося или другого лица значительную угрозу причинения тяжкого вреда здоровью.

Абзац 1 отменяет требование соразмерности вреда, сообразуясь лишь с особой важностью объекта защиты – жилища. Абзац 2 должен применяться в совокупности с абзацами 2 (1) или 2 (2). В двух последних случая явственно прослеживается перерастание обороны имущества в само-оборону или защиту третьих лиц. Таким образом, никаких исключений из принципа соразмерности норма МУК кроме абзаца 1 п. «d» ч. 3 ст. 3.06 не делает.

Кроме перечисленных подходов в статутном праве некоторых штатов существует и третий, согласно которому смертельное насилие при обороне жилища допускается, если посягающий на-мерен совершить в жилище только специально оговоренные законом фелонии, причем не обязательно насильственные (хотя среди фелоний всегда называются поджог, взлом и проникновение). В целом этот подход можно назвать «гибридным» или «промежуточным». Как пример приведем ст. 35.20 УК шт. Нью-Йорк «Оправдательное обстоятельство; применение физического насилия при обороне зданий с земельными участками и прилегающими постройками (premises) и обороне личности в ходе совершения взлома и проникновения (burglary)»:
«1. Любое лицо вправе применить физическое насилие против другого лица, когда он или она обосновано полагает, что такое насилие необходимо, чтобы пресечь или прекратить то, что, как он или она обоснованно полагает, является совершением или покушением на совершение таким другим лицом преступления (crime), связанного с повреждением зданий с земельными участками и прилегающими постройками. Такое лицо вправе применить насилие любой степени, за исключением смертельного физического насилия, которое он или она обоснованно полагает не-обходимым для такой цели, и вправе применить смертельное физическое насилие, если он или она обосновано полагает таковое необходимым, чтобы пресечь или прекратить совершение или покушение на совершение поджога…
3. Лицо, владеющее или осуществляющее контроль над жилищем или занятым строением, или лицо, которому разрешено или дозволено находится в нем, обосновано полагающее, что другое лицо совершает или покушается на совершение взлома и проникновения в такое жилище или строение, вправе применить смертельное насилие против такого другого лица, когда он или она обоснованно полагает таковое необходимым, чтобы пресечь или прекратить совершение или покушение на совершение такого взлома и проникновения».

Обращает на себя внимание то, что вопросам необходимой обороны жилища специально посвящена только ч. 3 ст. 35.20 УК шт. Нью-Йорк, предусматривающая посягательство в виде взлома и проникновения. Однако в ч. 1 ст. 35.20 УК шт. Нью-Йорк, по нашему мнению, содержится более общая норма вполне применимая и к обороне жилища, если посягающий пытается осуществить поджог. Показательно, что в этом случае из-за большей степени опасности посягательства закон не устанавливает требований к надлежащему обороняющемуся, определяя его, в отличие от ч. 3 ст. 35.20 УК шт. Нью-Йорк, просто как «любое лицо». Аналогичные нормы есть в ст. 11.81.350 УК шт. Аляска (раздел 11 свода законов шт. Аляска).

Подводя итог рассмотрению особенностей необходимой обороны жилища по уголовному праву США, следует сказать, что благодаря длительному историческому развитию в общем праве, а затем и в статутных нормах данный институт получил достаточно высокую степень проработки, позволившую учесть типовые обстоятельства посягательств на жилище и обеспечить твердые юридические гарантии для обороняющегося. Накопленный североамериканской юридической наукой опыт, на наш взгляд, можно расценивать как универсальный, вполне подходящий для восприятия отечественным законодателем и правоприменителем. Так, например, проанализированная конструкция нормы об обороне жилища делает возможным практическое отражение посягательства без возникновения сомнений в его наличности и связанного с этим вопроса о стадиях реализации намерения посягающего.

Как мы полагаем, российской науке до настоящего времени не удалось создать достаточно удачный оригинальный подход к необходимой обороне жилища. Причиной тому, вероятно, по-служило стремление получить абстрактную норму, которая урегулировала бы самый широкий круг ситуаций «посягательство – оборона». В качестве характерного примера приведем мнение М.А. Якунькова относительно посягательств в виде тайного проникновения в жилище: «Если обстоятельства дела – время и место действия, внешний вид и вооруженность правонарушителя – позволяют полагать, что… агрессия преступника может обратиться на личность человека… то законопослушный гражданин, предварительно не обнаруживая себя, может применить насилие… Рассмотренная ситуация вполне подпадает под действие института «упреждающего удара». Причинение внезапных телесных повреждений тайному ночному воришке, откровенно не собирающемуся вступать с кем-либо в конфликт, должно рассматриваться как умышленное преступление на общих основаниях».

За ограничение прав обороняющегося при защите жилища посредством установления дополнительных требований, лишь при соблюдении которых допускается причинение смерти посягающему, выступают также Е.А. Баранова (проникновение должно быть насильственным), С.В. Пархоменко (посягательство должно быть в виде кражи в ночное время не менее чем двумя лицами, насильственного грабежа не менее чем двумя лицами, разбоя или ночного проникновения путем взлома или насилия) и Р.М. Юсупов (проникновение должно совершаться путем взлома, насилия или группой лиц).

Справедливость указанных подходов вызывает у нас обоснованные возражения. Ведь право как социальный регулятор не должно идти против естественной необходимости в физической защите жилища, по крайней мере, до тех пор, пока обороняются именно законные интересы. По-этому мы поддерживаем концептуальное допущение причинения смерти посягающему при проникновении в жилище или иное обитаемое помещение без специальных ограничений, касающихся количества посягающих, их состояния и характеристик личности, времени, обстановки, способа, средства и орудия посягательства, а также требований к надлежащему обороняющемуся. Близкая точка зрения высказывается, в частности, А.П. Дмитренко, В.Н. Винокуровым и С.И. Никулиным. Но вполне очевидно и то, что право обороны жилища не должно признаваться, если ссылающееся на него лицо осуществляет противоправную деятельность или препятствует представителю власти, действующему в рамках полномочий. Кроме того, было бы разумным заимствовать североамериканские дефинитивные нормы, определяющие понятие жилище достаточно широко.

By the way, colleagues, a new ruling of the Plenum of the Supreme Court of the Russian Federation on the necessary defense has appeared, which virtually excludes the previously existing condition of proportionality of the damage caused in repelling the attack. Very interesting reading. In fact, it is written for that unfortunate owner of the mini-hotel who shot the attackers. As far as I know, the Supreme Court acquitted him and released him from punishment.

Кстати, коллеги, появилось новое постановление Пленума Верховного суда РФ по необходимой обороне, в котором фактически исключают ранее существовашее условие соразмерности причиненного вреда при отражении нападения. Очень интересное чтиво. Фактически написано под того несчастного владельца минигостиницы, который расстрелял нападающих. Насколько мне известно, Верховный суд его оправдал и освободил от наказания.
