The State Duma specified who and how can become a private detective
Russian Newspaper December 10, 2017
Not everyone can engage in private detective work in Russia. There are several important conditions that cannot be circumvented. Firstly, a candidate for Sherlock Holmes should not have mental disorders, alcohol and drug addiction. Secondly, he must have a law secondary or higher education or have seniority in law enforcement. Thirdly, he must have an impeccable reputation and a “clean” biography - no criminal record for a deliberate crime, no dismissal from the public service due to defamatory circumstances, no investigative or judicial proceedings, albeit incomplete, at the moment. Moreover, if a candidate for detectives served in a body that supervises or carries out licensed work, then he will also not be issued a license until the expiration of a year from the date of dismissal. This is clearly an anti-corruption measure so that former employees do not write out their own licenses.
The future detective must register as a private entrepreneur. He will receive a license for five years, but each year he must submit a medical certificate confirming the absence of mental illness and drug and alcohol dependence. By the way, they may not be able to renew the license if during the inspection it turned out that his activities threaten the safety of citizens. That is, the detective tried by force to induce his interlocutors to be frank. And this is unacceptable. After all, a private detective for an ordinary citizen is not an official representative of the government, we are not obliged to answer something, especially to provide assistance. I want - I’m talking with this person, no - it means no. Even a private security guard at his facility has more options - at least he has the right not to let a person who appears to him suspicious, say, into a store, club or office.
A real private detective is different from "Detective Gurov." He is forbidden to detain anyone
Recall that a real, not a cinematic private detective in Russia is very different from the "detective Gurov." He is forbidden to pursue a criminal with a weapon, to detain someone. He can use weapons only on the same grounds as any citizen of Russia - for hunting, shooting sports and self-defense. He has the right for his client only to collect information, analyze some facts. If during the investigation he reveals the fact of murder, robbery, he is obliged to inform the police. And to continue the investigation only with the permission of the police.
What is generally allowed to do a private detective in Russia? As a rule, Russian private investigators collect or make various inquiries. For example, about the possible heirs of a deceased relative, about potential competitors or partners, they are searching for missing people. Basically, this is work in the archives, a long and complicated correspondence. There are often “delicate” instructions to reveal adultery. But here everything must be done so that the detective himself is not accused of revealing personal information, penetrating into private life. It happens that private investigators have to identify office thieves, insiders, "mishandled Cossacks" from competitors.
