“The Law on Private Detective and Security Activities (hereinafter referred to as the Law), adopted in 1992, reflected the general desire of society for freedom of market relations and the ideas that existed at that time about this activity, including the possibility of combining private investigation and private protection. Since 2002, the Law began to be amended.
In total, 19 federal laws have been adopted in this regard, 13 of which over the past 5 years. The result on the face - 22 of the 23 articles of the Law are in the new edition.
Over the 23 years of the Law, society has changed, law enforcement practice and modern ideas about the organization of private investigation and private security have formed, and most importantly, professional players have appeared who understand what and how to do in the non-state security sphere (hereinafter referred to as the NSS). After the exclusion of the provisions on mixed forms of private detective activity and private protection from the Law in 2010, legislative dualism lost its meaning: regulation of these two different types of activity by one law.
Today there is no doubt that private detectives and private security guards need “their own” laws. At the same time, we are well aware of what they should be, we see the main problems that must be resolved.
Our common task is to consolidate the efforts of lawmakers, executive authorities, experts of the NSS, the Public and the Chambers of Commerce and Industry of the Russian Federation so that such laws are adopted as soon as possible, ”A. Vyborny noted.
