Missing Detectives

About 85% of detectives do the work of buying and selling information: the more inaccessible the source of information, the more intermediaries and higher margins, Lyubimenko says.

“Real” detectives who are professionally engaged in operational-search activities, according to him, are extremely few: only 10-15%. These are people exclusively with relevant experience - former employees of law enforcement agencies and special services.

Shadow competitors

The financial crisis has not spared private detectives, Lyubimenko admits: demand has fallen. But the situation is much more complicated due to direct competitors who are in the blind zone of the law. The methods and goals of collecting information in the interests of clients are the same as those of private detectives, but they, unlike registered detectives, have no restrictions: they do not need licenses, and therefore there is no supervision by law enforcement agencies.

However, the biggest difficulty is that a license is more a formality and carries more prohibitions than benefits, complains the president of the Association of Investigation Professionals: "If you work exclusively under the letter of the law, no detective can get the information in the usual amount."

"You can’t work like that."

Oleg Pytov has been in private search since 1992 - it was then that the first and so far only law "On Private Detective and Security Activities" appeared in Russia. Since then, clarifications to the document have been discussed and made repeatedly, but not one of them has simplified the work of detectives.

In 2010, the law was amended on cooperation with bailiffs, recalls Pytov.

“In the course of the next investigation, I found that the defendant in the divorce proceedings, from whom there was supposedly nothing to recover, copied his apartment to a close relative. In court, it was possible to prove that the apartment was owned at the time of marriage. I brought this information to the bailiffs but they looked at me very strangely; there was no other reaction. "

There is no interaction with the bailiffs to this day, the detective summarizes, and it is not clear under what conditions it is possible to establish work.

The only license preference is the opportunity to conclude an agreement with a legal entity, continues Sergey Lyubimenko. The rest, he said, is fiscal, tax, administrative and criminal restrictions.

Detective secrets

Шпионские игры с Черным Плащом

Обращения к частным детективам в России условно можно разделить на экономические и бытовые, сразу вводит в курс дела президент Ассоциации профессионалов сыска Сергей Любименко. Экономические — это бизнес-разведка (проверка деловых партнеров, контрагентов и клиентов), а также расследования финансовых преступлений: мошенничества, сговора, незаконного обогащения, тайного вывода средств и сокрытия подобной информации.

В действительности получение действительно ценной информации сопряжено с большим количеством рисков. Любименко объясняет градацию сложности работы на примере условных — белого, серого и черного — рынков частных детективных услуг.

Белый рынок — предоставление законных услуг законным способом: например, проверка достоверности паспортных данных, наличия штрафов и задолженностей. Пропавшие сыщики

При этом необходимо быть совершеннолетним гражданином России, получить любое высшее образование и зарегистрироваться в качестве индивидуального предпринимателя.

Финансовый кризис не обошел стороной частных сыщиков, признается Любименко: спрос упал. Но гораздо сложнее ситуация из-за прямых конкурентов, которые находятся в слепой зоне законодательства. Олег Пытов в частном сыске с 1992 года — именно тогда в России появился первый и пока единственный закон "О частной детективной и охранной деятельности". С тех пор уточнения в документ обсуждали и вносили неоднократно, но ни одно из них так и не упростило сыщикам работу.

В 2010 году в закон внесли поправки о сотрудничестве с судебными приставами, вспоминает Пытов.

"В процессе очередного расследования я обнаружил, что ответчик по бракоразводному процессу, с которого якобы нечего было взыскать, переписал свою квартиру на близкую родственницу. В суде можно было доказать, что квартира находилась в собственности на момент брака. Я донес эту информацию до судебных приставов, но они очень странно посмотрели на меня, другой реакции не последовало".

Взаимодействия с приставами нет и по сей день, резюмирует сыщик, и непонятно, на каких условиях можно наладить работу.

Единственная преференция лицензии — возможность заключить договор с юридическим лицом, продолжает Сергей Любименко. Остальное, по его словам, — это фискальные, налоговые, административные и уголовные ограничения.

Детективные тайны

В России же большую часть добытых данных использовать в органах дознания, следствия или в суде невозможно, объясняет Сергей Любименко. Это приводит к тому, что даже если детективы все-таки выполняют работу правоохранительных органов, это далеко не всегда приводит к раскрытию преступления.

"Меня нанимают расследовать разбой в Балашихе. Параллельно делом занимается местный следователь. Но у него еще три таких же преступления, поэтому он не так внимателен. Я же уже четко знаю имя преступника. Для подтверждения мне нужны записи с камер видеонаблюдения, и преступление будет раскрыто. Законопроект "О частной детективной деятельности", который разрабатывается в Госдуме при участии представителей Торгово-промышленной палаты, ФАС, Росгвардии и МВД, предусматривает, что детективы смогут запрашивать документы у органов власти, а те будут обязаны их предоставить. Также в рамках расследования по разрешению следователя детектив сможет встречаться с подозреваемым или обвиняемым по уголовному делу. Обсуждается и понятие "детективная тайна" — под ней понимаются любые сведения, связанные с оказанием услуг заказчику, которые разглашать запрещено.

Однако пока даже не создана рабочая группа при комитете Госдумы по безопасности. По всей видимости, и сами правоохранительные органы, и детективы настроены скептически. Механизм их взаимодействия до сих пор не прописан, говорит Сергей Любименко: "Можно, конечно, требовать чего угодно: лицензию на оружие, доступ к секретным материалам и так далее, но нужно быть реалистами. Проработка этих вопросов, интеграция в общую систему права, исправление ошибок — длительный процесс". Например, при введении термина "детективная тайна" может усложниться ситуация с раскрытием серьезных преступлений.

К тому же, прежде чем расширить полномочия детективов, нужно ужесточить критерии выдачи лицензии и требования к профессии, подчеркивает сыщик Пытов. По его словам, хорошим примером в этом смысле может стать Израиль: недавно его приятель, бывший сотрудник милиции из Ростова-на-Дону, наконец получил в эмиграции статус помощника частного следователя — и это после пяти лет учебы в академии частного сыска.

Пока же не замеченные законодателями детективы остаются верными своим нишам. "Мое любимое дело — поиск первой, пятой или десятой любви. The only thing that is not in doubt is this, that. what According to the Russian Guard, for 2016, about 900 licenses are valid in the country. :)
